Waive the rule requiring two readings of an ordinance and adopt AN ORDINANCE AMENDING CHAPTER 18 OF THE MOUNT PROSPECT VILLAGE CODE IN REGARD TO UNSCHEDULED DISEMBARKMENT BY HIRED OR CHARTERED TRANSPORTATION Mayor Hoefert presented an ordinance that amends Chapter 18 of the Village Code regarding unscheduled disembarkment by hired chartered transportation. Mayor Hoefert provided a brief statement, making it clear the proposed ordinance is not an attempt to fix or debate the national immigration policy. The proposed ordinance will regulate and discourage unscheduled disembarkments, or "drop offs," of migrants or other passengers within our Village. Mayor Hoefert added many communities in the Northwest suburbs have already passed similar ordinances. Mayor Hoefert stated it is important to have a plan in place with the intent of treating everyone humanely, and ultimately, to protect the interests of the residents and businesses in Mount Prospect. Mayor Hoefert opened the floor for discussion. Public Comment Steve Polit 601 N. Wilshire Drive • Expressed concerns regarding some of the clauses in the proposed ordinance Mary Anne Benden Mount Prospect resident • Requested a list of organizations that are accepting donations to assist migrants Village Manager Michael Cassady stated staff is working on this and will push the information out to the community. Mae DiBenedetto Mount Prospect resident Asked a question regarding the proposed ordinance Resident • Expressed concern for the safety of the community when/if buses arrive in Mount Prospect Dave DiPrima 420 S. We Go Trail Staff responded to the residents' questions. Trustee Matuszak added that the proposed ordinance only addresses the anticipated and unscheduled bus drop-offs of migrants in Mount Prospect. The proposed ordinance does not attempt to solve the national migrant problem or associated issues. Carol Delahunty Mount Prospect Resident • Seeking asylum is legal • Statistically, immigrants have a lower rate of criminal activity than Americans. • The ordinance addresses many of the concerns brought forward by residents. • The Village of Mount Prospect is a caring community; we will continue to support those in need in our community. Board Comments: • Reasonable approach to this matter; requested a copy of the application that will be required from the bus companies Mr. Cassady stated this will be made available to the Board Village should be prepared to respond to unexpected situations and the possibility that buses of migrants could be sent back to the Village from Chicago This is an unfortunate set of circumstances for suburban communities to be faced with; many have enacted similar ordinances. The proposed ordinance is the Village's first step to address the issue. Public Comment: Vito LiRossi Mount Prospect resident • Stated that Chicago sent a bus of migrants from Chicago to Burr Ridge in September 2022. Village Manager Michael Cassady stated this is an evolving situation and urged residents to stay engaged. Motion by John Matuszak, second by Bill Grossi to approve the ordinance as presented: Yea: Vincent Dante, Augie Filippone, Teri Gens, Bill Grossi, John Matuszak, Colleen Saccotelli Nay: None Final Resolution: Motion Passed Ordinance No. 6715 COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Steve Polit 601 N Wilshire Drive • Expressed concern regarding resident's misconception that they cannot ask questions or comment on items listed on the consent agenda. Mayor Hoefert replied, stating items placed on the consent agenda are usually routine or non- controversial items. He added that members of the Board and residents can request the removal of an item from the consent agenda for separate discussion before the consent agenda is presented for approval. This practice has been in place for many years. Carole Delahunty Mount Prospect resident Expressed excitement for the new restaurants that have recently opened or will be opening soon. CONSENT AGENDA Mayor Hoefert requested items 6.9 and 6.11 be removed from the consent agenda for separate discussions. Citing a professional conflict, Trustee Filippone announced he is abstaining from the vote on item 6.7. His request was acknowledged by the clerk and will be recorded accordingly in the meeting minutes. Waive the rule requiring two readings of an ordinance and adopt AN ORDINANCE ESTABLISHING THE MOUNT PROSPECT ELK GROVE TOWNSHIP FIRE PROTECTION AND EMERGENCY MEDICAL ASSISTANCE SPECIAL SERVICE AREA IN THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ITEM 6.9 REMOVED FROM THE CONSENT AGENDA FOR SEPARATE DISCUSSION. 6.10. A RESOLUTION TO APPROVE A COLLECTIVE BARGAINING AGREEMENT BETWEEN METROPOLITAN ALLIANCE OF POLICE MOUNT PROSPECT SERGEANTS CHAPTER #85 AND THE VILLAGE OF MOUNT PROSPECT. Resolution No. 5-24 6.11. A RESOLUTION AUTHORIZING A SPECIAL SERVICE AREA AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND GULLO PARTIES (AS DEFINED IN THE ATTACHED AGREEMENT) ITEM 6.11 REMOVED FROM THE CONSENT AGENDA FOR SEPARATE DISCUSSION Items removed from the Consent Agenda: Discussion and Vote: 6.9 Waive the rule requiring two readings of an ordinance and adopt AN ORDINANCE ESTABLISHING THE MOUNT PROSPECT ELK GROVE TOWNSHIP FIRE PROTECTION AND EMERGENCY MEDICAL ASSISTANCE SPECIAL SERVICE AREA IN THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS Director of Finance Amit Thakkar presented the final ordinance to establish the Mount Prospect Elk Grove Township Fire Protection and Emergency Medical Assistance Special Service Area (SSA) in the Village of Mount Prospect. Mr. Thakkar provided background information on the Elk Grove Rural Fire Protection District which has been inoperable for EMS and Fire services since October 1, 2023. The Village of Mount Prospect, the City of Des Plaines, and Elk Grove Village currently serve the unincorporated area previously served by the Rural Fire District. Mr. Thakkar displayed a map of the current Fire/EMS response map and estimated calls for each of the responding fire departments. Mr. Thakkar stated the Village proposed the establishment of an SSA to serve this unincorporated area. The Village began the statutory process to do so in September 2023. A public hearing was held on November 7, 2023, followed by a 60 -day objection period. Adoption of the ordinance presented tonight is the final step. To establish the SSA, an initial $1.0 million tax levy will be imposed beginning in year one. Mr. Thakkar stated the first SSA levy proceeds will be received in March 2025. This levy will affect only the unincorporated properties previously served by the Elk Grove Rural Fire Protection District. The Special Service Area Tax line will replace the Elk Grove Rural Fire District Levy. Mr. Thakkar stated the levy will result in an overall increase of 4.9 percent in the total tax bill. Future increases will be capped at 5 percent per established legislation. Mr. Cassady reminded everyone that the $1.0 million levy would not impact residents of Mount Prospect. The impact is only on properties of the unincorporated service area. Mr. Thakkar stated the SSA pays for the cost of responding to calls within the Fire District. In addition, the Village's response time in South Mount Prospect should improve with operations from Fire Station 11. Mr. Thakkar displayed a timeline of next steps, which include the renovation of Fire Station 11. Fire and EMS operations are expected to begin in the second or third quarter of 2024. Mr.Thakkar reminded anyone who has questions about the SSA can find information on the transparency page on the Village website. Mr. Cassady noted that all those impacted by the SSA received notification. Per state statute, a 60 -day objection period is required to allow those directly affected by the SSA, to bring questions or concerns forward. Mr. Cassady stated the Village was contacted by someone who owns several properties within the subject area with concerns of double taxation if the area were to be annexed into the Village of Elk Grove at a time in the future. Mr. Cassady stated after discussions with the property owner, who supports the establishment of the SSA, the parties arrived at an agreement that states if annexation occurs, the Village of Mount Prospect will abate taxes levied for the SSA and agree the SSA will not increase over 5 percent on an annual basis (item 6.11). Public Comment: Bill Scott Mount Prospect resident • Asked if capital funds is already in the budget to renovate Station 11 Mr. Cassady responded, stating the 2023 budget was amended in late 2023 and reserved S1 million in capital expenses related to the fire station improvements. This budget time will be brought back to the Board for approval in March when final renovation plans are completed. Steve Polit 601 N. Wilshire Drive • Questioned if there are any changes in the SSA from the public hearing on November 7 to present. • Regarding the proposed agreement with Gullo Properties (item 6.11), asked if the same conditions will pertain to those who reside north of the tollway (if annexed) Mr. Cassady responded, stating that although the agreement pertains only to the Gullo properties, it has always been the Village's stance that if an annexation occurs, the Village will abate back the fire levy. Mr. Cassady stated the agreement with the Gullo parties avoids a legal challenge to the SSA. Mr. Cassady also stated that there have been no changes to the SSA since November 7, 2023. Motion by John Matuszak, second by Bill Grossi to approve the ordinance as presented (item 6.9) Yea: Vincent Dante, Augie Filippone, Teri Gens, Bill Grossi, John Matuszak, Colleen Saccotelli Nay: None Final Resolution: Motion Passed Item removed from the Consent Agenda 6.11 A RESOLUTION AUTHORIZING A SPECIAL SERVICE AREA AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND GULLO PARTIES Discussion specific to this item continued. Trustee Filippone expressed concern that the agreement pertains only to a developer (later corrected by Village Manager Cassady to be a property owner) and does not provide the same benefits to other property owners of the subject area. Expressed concern that this will add confusion to those residents who will be voting on an upcoming referendum in which they will decide to dissolve the District. Trustee Filippone also expressed concern that there is conflicting language from a 2020 settlement agreement between Elk Grove Village and Gullo when compared with the proposed subject Gullo Parties agreement. Mr. Cassady clarified that the referendum Trustee Filippone referenced is only for those residing in the Fire District boundaries. Mr. Cassady stated the proposed agreement is in the best interest of the Village. To give a blanket provision to all property owners in the SSA would dilute its purpose and threaten the integrity of the SSA. OLD BUSINESS NEW BUSINESS VILLAGE MANAGER'S REPORT ANY OTHER BUSINESS Trustee Filippone reminded everyone that Monday, January 15th is Martin Luther King Day and urged the community to maintain a day of service to honor his life and legacy. Trustee Saccotelli reminded everyone that Coffee with Council is Saturday, January 13th from 9:00 a.m. to 11:00 a.m. in the Community Room at Village Hall. Mayor Hoefert announced the Chamber of Commerce is hosting their annual Dynamic Year Breakfast on January 24th at Old Orchard Country Club and will feature his "State of the Village" address. He stated that the event is open to the public and tickets can be purchased through the Chamber of Commerce.
