Action Item
This action item includes recommendations to award two (2) professional service contracts for
work necessary to remove lead residue from the former Police department gun range at Fire
Station 12. Individually, these contracts do not meet the Village Purchasing Policy threshold
for Village Board action ($50,000). However, in the interest of transparency, staff is
presenting these items for Village Board approval because the items collectively will cost
$67,800.
Hygieneering, Inc (Hygieneering), an environmental hygiene and consulting firm from
Willowbrook, Illinois, was retained by Public Works Department staff to complete a survey for
asbestos and lead at the former Police Department gun range in the basement of Fire Station
12. Fire Station 12 is situated at 1601 West Golf Road.
This space at Fire Station 12 is no longer needed to serve as a gun range due to the
construction of a new facility at the new Police Department Headquarters. Public Works now
plans to rehabilitate the space for possible future utilization as an inhabited space for Fire
Department personnel (i.e., as a workout or training area).
Public Works plans to clean the former gun range space to satisfy regulatory limits that would
technically allow the space to operate as a commercial day care facility. This standard is
essentially the highest attainable.
The scope of the survey included a visual inspection to determine the existence and location of
suspected asbestos containing materials and suspected lead-based paint throughout the areas
associated with the former gun range.
In addition to the visual inspection, bulk samples from suspect asbestos containing materials
were collected utilizing semi -destructive methods. Lead-based paint sampling was conducted
via bulk sampling and laboratory analysis. Additionally, dust wipe samples were collected from
various surfaces to establish the presence and extent of lead dust present. The field work
associated with the asbestos and lead based paint survey and sampling was conducted by an
IDPH licensed asbestos building inspector and EPA accredited lead risk assessor. The field
work associated with the survey was performed on August 8, 2023.
The findings of the survey resulted in no asbestos present; however, lead dust was
determined to be present on various surfaces within the former gun range, in the adjoining
control room and within exhaust ductwork and equipment. The Lead Surface Wipe Samples
were analyzed by EMSL Laboratories Inc. and analytical results ranged between 130 pg
lead/ft2 (130 micrograms per square foot) and 320,000 pg lead/ft2 (320,000 micrograms per
square foot). The highest lead dust levels exceed the OSHA acceptable level of <200 pg
lead/ft (less than 200 micrograms per square foot).
As a result of the sample analysis, and the Village's desire to repurpose the space, staff issued
an RFP for demolition/lead mitigation services to establish lead levels at or below that which is
required by OSHA to theoretically reutilize the space as day care center.
Further, staff has requested a proposal from Hygieneering for project oversight, environmental
air monitoring, sampling and analytical testing.

Site Clean-up Work
The lowest cost proposal for requisite cleanup work was submitted by Safe Environmental
Corporation (SEC) of Hammond, Indiana.
Staff conducted a post proposal meeting with the principal of SEC to discuss the firm's
understanding of the proposal requirements and communicate the Village's performance
expectations.
In addition, reference checks, including Leopardo Companies, Berglund Construction, and the
City of Harvey, Illinois. These projects ranged from $500,000 to $3,000,000 and all involved
the removal of lead and or asbestos. The feedback was exceptional with each stating they
would use them again for other projects. Berglund stated that SEC is their preferred
demolition contractor, and they use them exclusively on any project needing asbestos or lead
abatement. The City of Harvey stated that the demolition of their gun range went very well
and SEC's involvement was instrumental in achieving compliance for proper disposal and lead
mitigation.
Based on this due diligence, staff is confident that Safe Environmental Corporation has
adequate resources, experience and appropriate supervisory personnel to successfully execute
this proposed contract.
Proiect Management and Compliance Testing
Hygieneering has performed air testing and environmental testing services for the Village in
the past and has exceeded expectations. It is the opinion of staff that the firm is best
qualified to perform oversight for this potentially very technical industrial hygiene project.
Attached is a table that delineates the fees and services provided by Hygieneering. Please note
that sample collection and laboratory testing service are both included. In addition, it is
relevant to note that the scope of work is scalable and will vary based on the amount of time
and the amount of testing required to satisfactorily clean the site for its intended reuse. For
example, if the site can be cleaned in 10 days, the cost is reduced to approximately $22,400.
The $32,000 award recommendation envisions a worst-case clean-up scenario.
Alternatives
1. Accept the proposal as submitted by Safe Environmental Corporation.
2. Accept the proposal as submitted by Hygieneering, Inc.
3. Action at the discretion of the Village Board.
Staff Recommendation
Staff recommends accepting the lowest cost proposal as submitted by Safe Environmental
Corporation of Hammond, Indiana for specified lead mitigation and associated demolition of
the former gun range at 1601 Golf Rd for a cost not -to -exceed $35,800.
Staff also recommends that the Village Board accept the proposal from Hygieneering, Inc. of
Willowbrook, Illinois to provide project oversight and compliance monitoring for the gun range
clean-up project in an amount not to exceed $32,000.
The total recommended award is $67,800.

RE: A proposal to provide the Mount Prospect Public Works Department with project
management/air monitoring, wipe sampling and project documentation services to support
safe, legal, and cost-effective demolition and lead abatement/mitigation activities. These
services will support the removal and disposal of interior finishes in the Gun Range and lead
containing materials identified by the Hygieneering project design dated August 18, 2023, at
the building located at the Fire Station, 1601 Golf Road, Mount Prospect, Illinois for the
Mount Prospect Public Works Department.
Introduction
The services identified in this proposal v�ill ensure that the selected lead activities at 1601 Golf Road, Mount
Prospect is performed in a safe, legal, and cost-effective manner. These services will ensure cost effectiveness
while properly managing the current & long-term liabilities that are associated with this type of work activity.
Our services are provided by IDPH licensed and credentialed professionals under the direct supervision of a
staff of Certified Industrial Hygienists and Certified Safety Professionals. All services are backed by an A
rated Professional Liability and General Liability Insurance policy with a $10 million aggregate.
Project Management, Testing & Project Documentation Services
Hygieneering, Inc. will provide On -Site Project Management Services to ensure that work progress and work
plans are properly executed, and conditions are documented through daily inspection and testing services.
Project Management Services Include:
1. Establishing work zones and coordinating the demolition and remediation work within them.
2. Collecting lead air samples. Samples will be analyzed by a third -party accredited laboratory with 48-
hour T/A for results. Lead air samples are collected and analyzed at a rate of $30.00 per sample (240
samples).
3. Daily documentation of the project.
4. The collection and analysis of lead wipe samples to compare to existing OSHA regulations for
horizontal surfaces following lead abatement. Lead wipe samples are collected and analyzed at a rate
of $30.00 per sample (30 samples).
5. A final lead report documenting daily activity, air sample results, waste disposal records and
regulatory notification (if necessary). This documentation is required and crucial to protect Mount
Prospect Public Works Department from long-term liability or to support legal defense.
Cost of Services
Project Management/Air Monitoring Services will be billed at $1,320.00 per ten (10) hour shift per Project
Manager and Air Sample Professional (estimated 15 shifts total). *A shift is defined, as up to ten consecutive
working hours, additional time spent on the project will be billed at a rate of $120.00 per straight time hour
and $180.00 per overtime hour. Certified Safety Professional/ Certified Industrial Hygienist time is billed at a
$175.00 per hour rate (20 hours). Travel expenses will be billed at $120.00 per day per person on-site (20
trips). Project closeout costs, 5% of the project value, will be billed at completion of project for office
support, technology, printing, binding, and shipping final reports. Environmental insurance will be billed at
4% of the total project cost.
At this time, to support this project as defined in this proposal, Hygieneering, Inc.'s estimated cost
is $32,000.00, plus a 3% credit card processing fee, if applicable.

PROPOSAL/CONTRACT TERMS AND CONDITIONS AGREEMENT
1. This Proposal/Contract'I crms and Conditions Agreement is an integral part of the Proposal dated October 24, 2023 to Mount Prospect Public Works Department (hereinafter the
"Client") and supersedes any and all conflicting Clicot Terms and Conditions, Contract or PO or any other client instrument used to retain Hygieneering, loc. for its services.
2. These Terms and Conditions are integral to any and all Agreements utilized by the client to retain Hvgieneering for any/all Professional Services. Any additions, deletions, or
changes to Hy�g eneering's Proposal for work or these Terms and Conditions by the Client shall be subject to acceptance in writing prior to execution of work by Hyg eneering.
Advising Hygieneering to commence work or prepare for work prior to accepted changes in writing by Hygieneering will constitute acceptance by Client of Hygieneering's
proposal and all of its Terms and Conditions.
3. Client acceptance of Hygieneering's proposal in writing, via email, purchase order, contract or other mechanism, follower] by client canceling or delaying work after Hygieneering
has incurred costs to commence accepted work obligates client to be charged and pay for such expenses incurred, regardless of -whether or not the work is performed.
a. The scope of the project shall be only that as is described in this Agreement that Hygieneering and Client agree are necessary to carry out and complete the project. The
project scope shall not be altered except by mutual agreement and proper written authorization to proceed via change order or contract modification.
b. If, during the course of the prescribed work, additional services are requested, such additional scope of work and compensation shall be agreed to in writing prior to
undertaking additional work.
C. If, for anv reason additional services, are requested by the Client, and Hygentering delivers them in good faith without written authorization, Hygieneering shall be
compensated in accordance with its then prevailing fee schedule or rate sheet as applicable.
d. For those projects involving conceptual project development work, activities are often not fully definable in the initial planning. As the project progresses, the facts
uncovered may dictate a change in direction which may alter the scope. Hygieneering will inform the client of identified unusual situations so that negotiation of change in
scope can be accomplished if required.
4. Estimates, opinions and statement of probable construction costs prepared by Hygieneering are its best judgment as a design professional and are supplied for the general guidance
of the Client. Specialty contractor labor, materials, contractor bid and costing method and market conditions will dictate actual contractor pricing, which may vary from
Hygieneering estimates.
5. Hygieneering shall not be responsible for a Contractor's construction means, methods, techniques, warranties, sequence or procedures, nor for safety
precautions, progruns and
integrity of any such Contractors; or other third party's' work, nor for the acts or omissions of any Contractor or third persons, their agents or employees.
6. Hygieneering makes no warranty, either expressed or implied, as to its findings, design, recommendations, plans, drawings, calculations, specifications, or professional advice other
than that they have been prepared in accordance with current generally accepted professional practices.
7. The Client shall make no demand for liquidated or actual damages for delays, nor demand for damages resulting from loss of use or lost business opportunities due to project
delays.
8. Drawings, calculations, and specifications developed by Hygieneering as instruments of service are and shall remain the exclusive property of Hygieneering until they are paid for in
full.
9. Unless stated otherwise in the proposal, the Client shall pay Hygieneering as the work proceeds, with fees and other project costs invoiced as the work progresses.
a. Terms shall be net thirty (30) days.
b. Overdue accounts are subject to a service charge of 1.5 percent per month on the unpaid balance. This is an annual rate of 18 percent.
C. Invoices shall be considered correct as rendered if not questioned in writing within 10 days of invoice.
d. Failure to pay any invoice when due shall entitle Hygieneering to suspend or terminate all wort: on the project, at its option. In the event of such suspension or termination,
Client waives- all rights, claims, ctc., which it might otherwise have against Hygieneering as a direct or indirect result of such suspension or termination.
C. Should Hygieneering bring any action or proceeding at law or in equity to enforce payment of unpaid invoices, together with any and all service charges, and if Hygieneering
recovers judgment in any sum, Hygieneering shall also recover as reasonable counsel fees, 40 percent of the amount decreed due for principal, service charges and interest, as
well as litigation and collection expenses, witness fees and court costs.
10. Hygieneering shall not be liable for an error or omission in its project scope and design services beyond its insurance policy coverage.
11. This Agreement may be terminated by either party upon ten (10) days written notice should the other party fail substantially to perform in accordance with its terms.
a. In the event this Agreement is terminated, I Iygieneering shall be paid compensation due for services performed to the termination date, including reimbursable expenses and
termination expenses, pursuant to this parag aph.
b. Neither party shall hold the other responsible for damages or delay caused by acts of God, strikes, lockouts, accidents, or other events beyond the party's control.
C. Hygncnecring will not be responsible for special, accidental or consequential damages. Nor shall it be responsible for damage caused by other parties.
d. Under no circumstances will Hygieneering be liable for damages of any kind that exceed its insurance policy terms and coverage.
12. In the event any provisions of this agreement shall be held to be invalid and unenforceable, the remaining provisions shall be valid and binding upon the parties. One or more
waivers by either party of any provisions, terms, condition, or covenant shall not be construed by the other party as a waiver of a subsequent breach of the same by the other party.
13. This Agreement shall be binding upon both parties and their respective successors, assigns, and personal representative. Neither party shall assign its or his interest in this
Agreement without written consent of the other. This Agreement shall be governed by the laws of the State of Illinois.
14. The client named on this proposal/contract agrees that Hygieneering, Inc. incurs substantial recruiting, screening, training, administrative and marketing expenses in connection
with the I Iyg eneering, Inc. staff members that it provides to deliver EI IS services for the client. The client agrees that if the client hires, directly or indirectly, any I Iygieneering,
Inc. employee within 365 days of the contracted service, the client will pay $50,000 to I I% gieneering, Inc.
15. fees
a. Insurance hees: Special insurance requirements of the client and/ or project that cost over and beyond what our extensive coverage currently offers will be billed to the client
for this project work.
b. Project Logistics Fees: A fee for client data management, security, storage, backup with redundancy and protection from cyber malicious activity will be assessed for this
project per the project Proposal/Agreement.
16. This Agreement constitutes the entire and integrated Agreement between the Client and Hygieneering, and supersedes all prior negotiations, representations or agreements,
whether written or oral except as are specifically incorporated by reference. This Agreement may not be amended except by written instrument signed by Hygieneering.
17. COVID-19 and Environmental/Occupational Hcalth Services: Hygieneering believes that the standard for cleaning and/or testing of the workplace should be in compliance with
CDC, OSILA, AIIIA, WHO and applicable State and Local standards. Given that new information about COVID-19 cones out weekly, Hygieneering cannot guarantee that
individuals who later occupy the treated spaces will not contract COVID-19 or that guidance from these agencies will not have changed. Reliance on the previously mentioned
standards meets the definition of "Professional Standard of Care", which I Ivg eneeeing is held to uphold. Our work will he based on standards in place at the time of our
proposals. These are unprecedented times. Hygieneering accepts no liability for any work outside its Professional Standard of Care. Environmental and occupational health
services that Hygieneering provides to identify and control contaminants such as but not limited to viruses (COVID-19), Microbiologrical Organisms (mold and Legionella), Lead,
Asbestos, Silica, and Hexavalent chromium arc no exception.

Safe Environment Corp proposes to provide all labor, materials and equipment to perform the
removal and disposal of all interior finishes on walls and ceiling. Safe Environment Corp will also
remove and dispose of the contaminated bullet backstop materials and decontaminate all
remaining surfaces in the former Shooting Range Area, As noted in the Hygieneering Scope of
Work and provided drawings.

Mold remediation is becoming increasingly necessary to remove
mold spores, pollen, bacteria, and viruses that linger in walls,

Village of Mount Prospect
Public Works Gun Range Demolition and Remediation Project
Project Location: Fire Station, 1601 Golf Road, Mount Prospect
• All work will be in strict accordance with IDPH, OSHA, and U.S. EPA rules and
regulations.
• Safe Environment will utilize one project superintendent to oversee this project. His
duties include all pre -project planning including notices and project submittals, project
scheduling, scheduling of labor and supplies, project oversight on a daily with the on-site
project management and post job close out which includes a final walkthrough and all
paperwork forwarded as required.
• One project supervisor will run each shift with assistance of one foreman per 6-8
workers. The supervisor will stay in direct contact on a daily basis with the project
superintendent. He is responsible for all on site activities including maintaining the
schedule, corresponding labor with the superintendent, ordering all supplies and
equipment as needed, corresponding the inner and outer activities of his job site and to
make sure all work is being performed in accordance with all IDPH, EPA, and OSHA
regulations.
• The foreman on site will work with the supervisors and are responsible for the work force
performing the actual work. They maintain the aggressive and safe level of work being
performed on all phases of work. They correspond with the supervisor on a constant basis
in all areas of regulations, productivity, and safety.
• Safe Environment utilizes a work force that is made up of the following:
Supervisors: 3+ years of experience
Foremen: 2+ years of experience
Labor: I year of experience
All personnel will be fully IDPH licensed with current OSHA physicals.
• Safe Environment will staff each shift accordingly to keep this project on schedule.
• Proper engineering controls will be used to maintain low air counts below 0.01 f/cc to
protect against any lost time due to project shut downs or Type C use.
• Constant on site coordination with project manager will be kept at all times during prep,
removal, and all three clean cycles to help maintain the schedule.
• All material will be properly wet and handled prior to disposal in a six -sided lockable
waste trailer.
• Proper and correctly built scaffolding will be used on this project. The scaffolding will be
built by a competent person and will be built in accordance with all OSHA regulations.
Kick plates and safety bars will be installed on all scaffolding used on this project.
• All electrical components will be locked out and tagged out and will be verified by the
on-site supervisor in accordance with IDPH and OSTIA regulations.
• Safe Environment will take a very aggressive approach to maintain the schedule on this
project. Safe Environment maintains a large labor force at all times with a very qualified
team of project managers, supervisors, foremen and labor.
