AN ORDINANCE GRANTING A SPECIAL USE AND
VARIATION FOR PROPERTY
COMMONLY KNOWN AS 1430 WEST BONITA AVENUE
WHEREAS, Satwant and Iqbal K. Singh (hereinafter referred to as
Petitioners) have filed an application for a Special Use and
variation from Chapter 14 of the Village Code of Mount Prospect,
Illinois, for property commonly known as 1430 Bonita Avenue
(hereinafter referred to as Subject Property), legally described
as:
Lot 12 in Kathcon Subdivision Unit 2, being a
resubdivision of those parts of Lot "K" in Kirchoff
Subdivision ;and Lot 9 of Kathcon Subdivision (being also
a resubdivision of Lot "K") of the Northwest Quarter of
the Northwest Quarter and the North 10 chains of the
Southwest Quarter of the Northwest Quarter of Section 11,
Township 41 North, Range 11, East of the Third Principal
Meridian, all in Cook County, Illinois;
and
WHEREAS, Petitioners seek a Special Use permit, as provided in
Section 14.1101.C.8, to allow a garage designed to house more than
two vehicles and variations from Section 14.3016.A.3 to allow a
driveway width of twenty-six feet eight inches (26' 8"), rather
than the permitted 21 feet and Section 14.1102.E to allow a total
lot coverage of 48%, rather than the maximum allowed 45%; and
WHEREAS, a public hearing was held on the Special Use and
variations requested, being the subject of ZBA Case No. 66-SU-92
and ZBA 67-V-92, before the Zoning Board of Appeals of the Village
of Mount Prospect on the 24th day of September, 1992, pursuant to
due and proper notice thereof published in the Mount ProsDect
Herald on the 8th day of September, 1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendations to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the Special Use
and being the subject of ZBA 66-SU-92 and variations being the
subject of ZBA 67-V-92, and have determined that the best interests
of the Village of Mount Prospect would be served by granting said
requests.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grant a Special Use to allow a 3-car garage
on the subject Property, a variation from Section 14.3016.A.3 to
allow a driveway width of twenty-six feet eight inches (26' 8").

SECTION THREE: Except for the Special Use and variations granted
herein, all other applicable Village of Mount Prospect Ordinances
and regulations shall remain in full force and effect as to the
Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
