AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 214 SOUTH HI LUSI
WHEREAS, Peter J. Orel (hereinafter referred to as Petitioner) has
filed an application for a variation from Chapter 14 of the Village
Code of Mount Prospect, Illinois, for property generally located at
214 South Hi Lusi (hereinafter referred to as Subject Property),
legally described as:
Lot 256 in Colonial Manor, being a subdivision in the
East Half of the Northeast Half of Section 11, Township
41 North, Range 11 East of the Third Principal Meridian,
in Cook County, Illinois
and
WHEREAS, Petitioner seeks a variation from Section 14.102.B.2 allow
a two foot (2') setback along the interior side property line,
instead of the minimum 5' in order to replace an existing one-car
garage with a two-car garage; and
WHEREAS, a public hearing was held on the variation requested being
the subject of ZBA Case No. 70-V-92 before the Zoning Board of
Appeals of the Village of Mount Prospect on the 22nd day of
October, 1992, pursuant to due and proper notice thereof published
in the Mount Prospect Herald on the 6th day of October, 1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variation
being the subject of ZBA 70-V-92 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLJ%GE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grant to the Subject Property a variation
from Section 14.102.B.2 to allow a two foot (2') setback along the
interior side property line, instead of the minimum 5' required, in
order to replace an existing one car detached garage with a two car
detached garage, subject to the following conditions:
1. Gutters being installed on the north side of the garage; and
2. The installation of 5/8" Class X drywall shall be added to the
interior garage wall abutting the property wall.
SECTION THREE: Except for the variation granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FIVE: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction

begins within one (1) year from the date of passage of this
Ordinance.
SECTION SIX: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form in
the manner provided by law.
