Information
The Prospect and Main TIF was created in order to incentivize economic improvement to the
Village's downtown. Part of the original plan was to help fellow units of local government make
improvements to the recreational opportunities in this part of the Village. The TIF law allows
such enhancements because they create an environment more conducive to the primary goal
of commercial growth.
The IGA before the Village Board furthers a project to make improvements to Lions Park,
which is owned and operated by the Mt. Prospect Park District. The project will enhance
recreational and athletic facilities available to the general public at no charge, while also
accommodating the dedicated use of these facilities by community organizations, including but
not limited to School District 57.
Under the terms of the IGA, the Village will contribute a total of $250,000 to the project:
$59,000 will be paid from the Prospect and Main TIF; and $191,000 will be paid from CDBG
funds. The total budget for the project is approximately $1.8 - $2.0 million and includes the
following improvements:
• New playground with areas for 2-5 year olds and 5-12 year olds
• New game court including half court basketball, four square, and hopscotch
• New adult fitness stations with concrete surfacing
• Refurbishing of existing tennis courts and baseball fields
• New picnic grove with picnic and game tables
• New prairie detention area featuring pollinator plants and art installation
• New 8 -foot wide asphalt walking loop with bench seating
The Mt. Prospect Park District proposed a timeline of October - November 2023 for public
bidding for the project, with construction commencing in March 2024 and substantial
completion in September 2024.
The Mt. Prospect Park District applied for $250,000 in CDBG funds to support the rehabilitation
of Lions Park. The park is eligible for CDBG funding because it is considered a public facility
and the improvements will benefit low- and moderate -income residents. The Village receives
an annual allocation of CDBG funds from HUD, but CDBG dollars are limited and the funding
requests from subrecipients always exceed the CDBG dollars available. The Village was able to
allocate up to $191,000 in CDBG funds, and will contribute TIF funds in the amount of
$59,000, to bring the total Village contribution to $250,000 for the Lions Park project. The
CDBG funds are earmarked to support construction of the accessible walking loop, which has a
scope of work and service area most in alignment with CDBG objectives. Other sources of
funding for the Lions Park project include Mt. Prospect Park District, Mount Prospect School
District 57, the Illinois Department of Natural Resources.

A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT,
THE MT. PROSPECT PARK DISTRICT AND MOUNT PROSPECT SCHOOL DISTRICT 57
REGARDING THE REDEVELOPMENT AND USE OF IMPROVEMENTS AT LIONS PARK
WHEREAS, both the 1970 Illinois Constitution (Article VII, Section 10) and the
Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.) authorize and encourage
intergovernmental cooperation; and
WHEREAS, the Mt. Prospect Park District, Mount Prospect School District 57, and the Village
are units of government, or instrumentalities and/or agencies of local government, within the
meaning of the 1970 Constitution of the State of Illinois, Article VII, Section 10, having the
power and authority to enter into an intergovernmental agreement; and
WHEREAS, the Village believes it is in the interests of its residents to promote the
redevelopment and/or reconditioning of athletic and recreational facilities at Lions Park which
is owned and operated by the Mt. Prospect Park District by providing for the project; and
WHEREAS, pursuant to the Prospect and Main TIF, the Village seeks to allocate funds to the
Mt. Prospect Park District for use in redeveloping and/or reconditioning the athletic and
recreational facilities at Lions Park to benefit the Mount Prospect residents living in the vicinity
of the park; and
WHEREAS, the Village can use Community Block Grant Development ("CBGD") to help with
the redevelopment and/or reconditioning of Lions Park athletic and recreational facilities; and
WHEREAS, the Park District and the School District also will contribute funds for the Project;
and
WHEREAS, the Mt. Prospect Park District and Mount Prospect School District 57 and the
Village find it is in their interest to enter into an agreement that sets forth their obligations
pertaining to the project and the use of the athletic and recreational facilities at Lions Park.
NOW THEREFORE BE IT ORDAINED/ RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Board of Trustees do hereby authorize the Village of Mount Prospect
to enter into an Intergovernmental Agreement with the Mt. Prospect Park District and Mount
Prospect School District 57 regarding the redevelopment and use of improvements at Lions Park
attached hereto and made part of this Resolution as Exhibit A.
SECTION TWO: That the Mayor is authorized to sign the agreement and the Village Clerk to
attest.
SECTION THREE: That this Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.

INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF MOUNT
PROSPECT, THE MT. PROSPECT PARK DISTRICT AND MOUNT PROSPECT
SCHOOL DISTRICT 57 REGARDING THE REDEVELOPMENT AND USE OF
IMPROVEMENTS TO LIONS PARK
This Intergovernmental Lease Agreement ("Agreement") is made and entered into this day
of , 2023 (`Effective Date"), by and between the Village of Mount Prospect, an
Illinois home rule municipal corporation (hereinafter referred to as "Village"), the Mt. Prospect Park
District, an Illinois unit of local government (hereinafter referred to as "Park District"), and Mount Prospect
School District 57, an Illinois public school district (hereinafter referred to as "School District")
(collectively "Parties") to set forth terms for the redevelopment and use of recreational and athletic facilities
at Lions Park, a public park that is owned and operated by the Park District. "Lions Park" as used herein
shall not refer to or incorporate "Lions Park School" owned and operated by the School District and which
is located adjacent to Lions Park.
RECITALS:
WHEREAS, Article VII, Section 10, of the Constitution of the State of Illinois, Ill. Const.,
art. VII, sec.10(a), provides that in furtherance of the exercise of their powers, units of local
government may contract or otherwise associate among themselves to obtain or share services and
to exercise, combine, or transfer any power or function, in any manner not otherwise prohibited;
and
WHEREAS, Chapter 5, Illinois Compiled Statutes, Act 220, Section 1, et seq., titled the
"Intergovernmental Cooperation Act," provides that any power or powers, privileges or authority
exercised or which may be exercised by a unit of local government may be exercised jointly with
another unit of local government; and
WHEREAS, the Parties are units of government within the meaning of the 1970
Constitution of the State of Illinois, Article VII, Section 10, having the power and authority to
enter into an intergovernmental agreement; and

WHEREAS, the Village believes it is in the best interests of its residents to promote the
redevelopment and/or reconditioning of athletic and recreational facilities at Lions Park which is
owned and operated by the MPPD by providing funding for the project; and
WHEREAS, pursuant to the Illinois Tax Increment Allocation Redevelopment Act, 65
ILCS 5/11-74.4-1, et seq., as from time to time amended (hereinafter referred to as the "Act"), the
Village is engaged in efforts to make improvements within its Prospect/Main Tax Increment
Financing District (hereinafter referred to as the "TIF") within the Village limits, in which existing
conditions permit such area to be classified as a "conservation area" or "blighted area" as required
by the Act; and
WHEREAS, pursuant to the TIF, the Village seeks to allocate funds to the Park District
for use in redeveloping and/or reconditioning the athletic and recreational facilities at Lions Park
(the "Project") to the benefit of Mount Prospect residents living in the vicinity of the park; and
WHEREAS, the Village can use Community Block Grant Development ("CBGD") to help
with the redevelopment and/or reconditioning of Lions Park athletic and recreational facilities; and
WHEREAS, the Park District and the School District also will contribute funds for the
Project; and
WHEREAS, in exchange for providing funding for the Project, the Village believes these
improved facilities should be readily available for the use of Mount Prospect citizens residing in
the vicinity to Lions Park; and
WHEREAS, the Parties have determined that it is in their best interest to enter into an
agreement that sets forth their obligations pertaining to the Project and the use of the athletic and
recreational facilities at Lions Park;

NOW, THEREFORE, in consideration of the mutual agreements, obligations and
covenants set forth in this Agreement, and upon the further consideration stated in the foregoing
Recitals, it is agreed by the Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois, the Board of Commissioners of the Mt. Prospect Park District, Cook County, Illinois, and
the Mount Prospect School District 57 Board of Education on this day of
2023, as follows:
Section 1. Incorporation. The above Recitals are incorporated by reference into this
Section 1 as though fully set forth herein.
Section 2. Funding The Proiect. The Village shall contribute $250,000 to the funding
for the Project with these funds allocated as follows: (1) $59,000 from the TIF and (2) $191,000
from CDBG funds. This Village funding shall be sent to the Park District as it will be responsible
for the administration of the construction contracts for the Project. Additionally, the Park District
and the School District shall contribute mutually agreed upon funding for the Project.
Section 3. Availability of Lions Park Athletic and Recreational Facilities to the
General Public. The Parties recognize and agree that after completion of the Project the athletic
and recreational facilities at Lions Park, the MPPD shall make these facilities readily available for
the use and enjoyment of the general public at no charge. To that end, the Parties shall work
together to establish a schedule that opens up the Lions Park athletic and recreational facilities to
the general public at no charge while also accommodating the use of these facilities by community
organizations that depend on access to and use of the Lions Park resources. Such use includes but
is not limited to the School District's use of Lions Park pursuant to its intergovernmental
agreement with the Park District as amended by the Second Amendment to the Amended and
Restated IGA. Nothing is this Agreement is intended to abridge or otherwise limit the use set forth
in such intergovernmental agreement between the School District and the Park District.

Section 4. Term. This Agreement shall have a term of 10 years that shall automatically
renew for an additional ten-year term unless terminated by consent of the Parties.
Section 5. General Provisions.
5.1. Governing Law and Venue. This Agreement shall be interpreted under, and
governed by, the laws of the State of Illinois. Any claim, suit, action or proceeding brought in
connection with this Agreement shall be in the Circuit Court of Cook County, Illinois, and all the
Parties consent to the personal and subject matter jurisdiction of said Circuit Court and waive any
claim that venue therein is not proper.
5.2. Modification of the Agreement. This Agreement shall not be modified, altered,
or amended in any way except in writing agreed upon by all the Parties.
5.3. Notices. All written notices made pursuant to this Agreement shall be directed to
the specified individuals at the addresses set forth below by any of the following means: personal
service, overnight courier or first class mail, postage pre -paid.

5.4. Entire Agreement. This Agreement constitutes the entire agreement between the
Parties and supersedes and replaces any and every other prior or contemporaneous agreement,
negotiation, understanding, commitments and/or other writings with respect to the subject matter
herein.
IN WITNESS WHEREOF, the Village of Mount Prospect, the Mt. Prospect Park District
and School District 57 have caused this Agreement to be executed by their respective officials on
the dates indicated.
