This Ordinance amends Ordinance No. 6656 granting a variation for property located at 500
W. Central Road to extend the effective date of said Ordinance, which one year extension
would provide for the variation to be effective through and including December 20, 2024.
Discussion
On December 20, 2022, a Zoning Map Amendment (I-1 to B-5), and a Variation for increased
density to twenty residential dwelling units was approved via Ordinance No. 6656. Over the
course of the past ten months, the property owner, Mr. Younus, has engaged a number of
consultants, lenders, contractors, etc., as well as maintained dialogue with Village officials, in
order to advance the project. The market conditions in 2023 have been challenging for
property owners and developers of real estate due to rising interest rates, tax uncertainty, and
fluctuations in the cost of building materials. Mr. Younus is therefore seeking approval for a
twelve-month extension of Ordinance No. 6656 to provide more time for the necessary
permitting and construction to commence.
Alternatives
1. Adopt an Ordinance amending Ordinance No. 6656 granting a variation for property
located at 500 W. Central Road to extend the effective date of said Ordinance, which
one year extension would provide for the variation to be effective through and including
December 20, 2024.
2. Action at the discretion of the Village Board.
Staff Recommendation
Staff recommends that the Village Board adopt an Ordinance amending Ordinance No. 6656
granting a variation for property located at 500 W. Central Road to extend the effective date
of said Ordinance, which one year extension would provide for the variation to be effective
through and including December 20, 2024.

AN ORDINANCE AMENDING ORDINANCE NO. 6656
WHEREAS, Thomas Budzik did seek a variation from Chapter 14 (Zoning) of
the Village Code, which variation was the subject of PZ -09-22 before the
Planning and Zoning Commission; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect did on December 20, 2022, adopt Ordinance No. 6656, granting a
variation to property located at 500 West Central Road; and
WHEREAS, pursuant to the regulations of the Village Code of Mount Prospect,
Section 14.203(C)(13) of the Zoning Code provides that permits must be
issued, and construction begun within one year following the passage of said
Ordinance; and
WHEREAS, while the Petitioner is desirous of converting the office building into
a residential building, being the subject of Ordinance No. 6656, permits will not
have been issued within the one year required; and
WHEREAS, the Petitioner is requesting that Ordinance No. 6656 be amended
to provide for a one year extension to the effective date of said Ordinance,
which one year extension would provide for the variation to be effective
through and including December 20, 2024.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That the recitals set forth hereinabove are incorporated as
findings of fact by the President and Board of Trustees of the Village of Mount
Prospect.
SECTION TWO: That the President and Board of Trustees of the Village of
Mount Prospect do hereby amend Ordinance No. 6656 by extending the
effective date for the variation granted therein for a period of one year, so that
said variation shall be valid for a period through and including December 20,
2024.

after its passage, approval and publication in the manner provided by law.

WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have given consideration to the
request herein and have determined that the request meets the standards of the Village and that the granting

public utilities (water and storm) that cross the east side of the site, in a form acceptable to the
Village;
7. The Petitioner shall make good faith efforts to modify the site plan to include two entrances into the
parking area from the existing curb cut in front of the subject property;
& Compliance with all applicable Village Code requirements, including but not limited to zoning, fire
code, sign code regulations, and building regulations."
SECTION THREE: The Village Clerk is hereby authorized and directed to record a certified copy of this
Ordinance and Exhibit "A" Site Plan with the Recorder of Deeds of Cook County on title to the Subject
Property.

RE: Extension of Ordinance #6656
Mr. Bill,
On December 20, 2022, Ordinance #6656 was passed, approving the Zoning Map Amendment pertaining
to my property at 500 W. Central Rd. (PIN 03-34-326-008-0000) from 1-1 Limited Industrial to B-5 Central
Commercial, allowing for an increased density to twenty residential dwelling units (as previously
depicted in the plans prepared by Thomas Architects, dated 9/14/22).
The purpose of this correspondence is to seek approval for a twelve-month extension of the
aforementioned Ordinance, which would allow ample time for the necessary permitting and
construction to commence. Over the course of the past ten months, I have in earnest, engaged a
number of consultants, lenders, contractors, etc., as well as maintained dialogue with Village officials in
order to get the project to the point where its economic, architectural, and logistic feasibility would
prove achievable.
As you have no doubt kept apprised of, overall market conditions in 2023 have been challenging for
owners and developers of real estate. Between rising interest rates, tax uncertainty, and fluctuations in
the cost of building materials, project specific underwriting has been somewhat of a moving target.
However, despite these challenges, I am confident that the progress made over the past ten months will
ultimately lead to a successful adaptive reuse project at 500 W. Central. My goal of repurposing an
outdated and vacant office building into a vibrant and attractive apartment property remains a top
priority.
I appreciate your willingness to consider my request for an extension and I welcome any questions or
