CAF 12/9/92 ORDINANCE NO. 4502 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 10 EAST SUNSET ROAD WHEREAS, Gianfranco Giovagnoli (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 10 East Sunset Road (hereinafter referred to as Subject Property), legally described as: Lot 114 in Country Club Terrace, a subdivision of part of Lot 16 and part of Lot 18 in the Owners Subdivision of Section 13, Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois, according to plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on May 20, 1955, as Document Number 1595957; and WHEREAS, Petitioner seeks a variation from Section 14.1102.D.4 to allow a seven foot (7') service-walk to encroach into the side yard setback, rather that the maximum allowed of 36". WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 75-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 12th day of November, 1992, pursuant to due and proper notice thereof published in the Mount ProsDect Herald on the 27th day of October, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 75-V-92 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14%1102.D.4 to allow a seven foot (7') service walk along the side of the house, rather than the allowed maximum of 36", provided the Petitioner provides appropriate measures relative to drainage. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction BA 75-V-92 Page 2 of 2 begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
