AN ORDINANCE GRANTING A SPECIAL USE AND
VARIATION FOR PROPERTY
COMMONLY KNOWN AS 1216 CRABTREE LANE
WHEREAS, Steven and Ellyn Schwartz (hereinafter referred no as
Petitioners) have filed an application for a Special Use and
variation from Chapter 14 of the village Code of Mount Prospect,
Illinois, for property commonly known as 1216 Crabtree Lane
(hereinafter referred to as Subject Property), legally described
Lot 149 in Brickman Manor 1st Addition Unit 92, being a
subdivision of part of the West 1/2 of the Southwest 1/4 of
Section 26, Township 42 North, Range 11, East of the Third
Principal Meridian, according no plat thereof recorded
November 18, 1959 as Document 917715808 in Cook County,
Illinois
and
WHEREAS, Petitioners seek a Special Use permit, as provided in
Section 14.1101.C.8, to allow a garage designed to house a
commercial vehicle with a licensed weight of more than 8,000 pounds
and a variation from Section 14.102.B.3 to allow an accessory
structure with a height of 12' 6", instead of the 12' maximum
allowed; and
WHEREAS, a public hearing was held on the Special Use and
variation requested, being the subject of ZBA Case No. 8-SU-93 and
ZBA 9-V-93, before the Zoning Board of Appeals of the Village of
Mount Prospect on the 25th day of February, 1993, pursuant to due
and propez notice thereof published in the Mount Prospect Herald on
the 9th day of February, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendations no the President and Board of Trustees of the
Village of Mount Prospec5 and the President and Board of Trustees
of the Village have gmven further consideration to the Special Use
Permit and being the sub2ect of ZBA 8-SU-93 and the variation being
the subject of ZBA 9-V-93, and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said requesms.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals sem forth hereinabove are incorporamed
herein as findings of fact by the President and Board of Trustees
of the village of Mounm Prospect.
~ The President and Board of Trustees of the Village of
Mount Prospect hereby granm to the Subject Proper~y a Special Use
designed to house a commercial vehicle weighing more than 8,000
pounds and a variation from Section 14.102.B.3 to allow an
accessory strucmure, specifically the garage, with a height of
twelve fee~ slx inches (12' 6"). The Special Use which is the
subject of this Ordinance shall be binding on the Petitioners in
this reques~ and all future propermy owners. The Special Use
granted herein ms subjecn to 5he condition that any commercial
vehicle shall be housed in the garage am all times and that no home
occupation shall be conducted from the premises.

SECTION THREE: Except for the Special Use and variation granted
herein, all other applicable Village of Mount Prospect Ordinances
and regulations shall remain an full force and effect as ~o the
Subject Proper~y.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: The Village Clerk is hereby directed to record a
certified copy of this Ordinance with the Cook County Recorder of
Deeds or register with the Registrar of Titles, whichever is
applicable.
SECTION SIX: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in pamphlet form ~n
the manner provided by law.
