AN ORDINANCE GRANTING A SPECIAL USE IN THE NATURE OF
PLANNED UNIT DEVELOPMENT FOR PROPERTY GENERALLY
KNOWN AS 412 ' 414 EAST RAND ROAD
WHEREAS, Deerfield Federal Savings Trust #287 (hereinafter referred
to as Petitioner) has filed a petition for a Special Use in the
nature of a Planned Unit Development with respect to property
generally known as 412.- 414 East Rand Road (hereinafter referred
to as the Subject Property); and
WHEREAS, the Subject Property is legally described as follows:
The South 88 feet of the North 550 feet of the Southeast
quarter of the Northeast quarter of Section 34 (except the
East 400 feet) in Township 42 North, Range 11, East of the
Third Principal Meridian, lying easterly of the center line of
Rand Road, and also that part of the North half of the
Southeast quarter of the Northeast quarter of Section 34,
Township 42 North, Range 11, East of the Third Principal
Meridian, lying Northeast of Rand Road (except the North 550
feet of the East 400 feet thereof) excepting from the above
described tracts of land, taken as a whole, the East 130.00
feet thereof, all in Cook County, Illinois
and also
Lots 1 and 2 in Clarewood Subdivision, being a Subdivision of
the East 130 feet of the following described tracts of land
taken as a whole, the South 88 feet of the North 550 feet of
the Southeast Quarter of the Northeast 1/4 of ?Section 34
(except the East 400 feet) in Township 42 North, Range 11,
East of the Third Principal Meridian, lying Easterly of the
Center line of Rand Road, and also thatpart of the North 1/2
of the Southeast 1/4 of the Northeast 1/4 of Section 34,
Township 42 North, Range 112, East of the Third Principal
Meridian, lying Northwest of Rand Road (except the North 550
feet and except the East 400 feet thereof) all in Cook County,
Illinois;
and
WHEREAS, Petitioner desires to create a Planned Unit Development
providing for 11 townhomes as shown on the Site Plan attached
hereto; and
WHEREAS, a public hearing was held on the request for Special Use,
designated as ZBA Case No. 11-SU-93, before the Zoning Board of
Appeals of the Village of Mount Prospect on the 25th day of
February, 1993, pursuant to proper legal notice having been
published in the Mount Prospect Herald on the 9th day of February,
1993; and
WHEREAS, the Zoning Board of Appeats has submitted its findings on
the proposed Special Use to the President and Board of Trustees;
and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that the best interests of the
Village of Mount Prospect will be attained by granting to the
Subject Property the Special Use in the nature of a Planned Unit
Development as requested in ZBA 11-SU-93.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That a Special Use in the nature of a Planned Unit
Development is hereby granted to allow the Subject Property to be
developed with 11 townhomes as shown on the Site Plan attached

hereto and hereby made a part hereof as Exhibit "A".
SECTION TWO: That the Planned Unit Development granted herein is
subject to the following specific plans and conditions:
1. Project Site Plan #9240 by Fitzgerald Associates Architects.
2. Preliminary Landscape Plan #9240 dated 4/19/93 by Fitzgerald
Associates Architects, subject to a revised landscape concept
along the east lot line acceptable to the Planning Department.
3. Preliminary Engineering Plan dated 4/8/93 by Brighton
Engineering, subject to submittal of revised final engineering
meeting all applicable provisions of Chapter 16 (Development
Code) of the Village Code of Mount Prospect.
4. Building elevations #9240 by Fitzgerald Associates Architects,
including face brick on the first floor east, west and south
elevations and all sides of the garages.
5. The mailbox location for the development shall be a "community
box" located in the landscape area north of the entry drive.
6. All utilities shall be from underground service. The
developer shall remove the existing wood poles on Hill Street
as part of the project utility work.
7. Homeowners Association Declaration and By-Laws shall be
submitted to the Planning Department for review and approval.
8. The developer shall provide any improvements to Rand Road as
required by the Illinois Department of Transportation.
9. The driveway apron between the Curb line and sidewalk shall be
concrete.
SECTION THREE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
