CAF 5/11/93 ORDINANCE NO. 4552 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1132 JUNIPER LANE WHEREAS, Walter $olak (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1132 Juniper Lane (hereinafter referred to as Subject Property), legally described as: Lot 522 in Brickman Manor First Addition Unit Number 4 being a subdivision of the South Half of Section 26, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from Section 14.1102.D to allow an interior side yard setback of 6 feet, instead of the minimum allowed 9 feet, to allow a deck; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 24-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of April, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of April, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 24-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.D to allow an interior side yard setback of six feet (6'), rather than the minimum 9 feet required, to allow a deck. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 BA 24-V-93 Page 2 of 2 of Chapter 14 of the Village Code, the variation granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
