HomeMy WebLinkAboutRes 50-08 10/07/2008 RESOLUTION NO. 50-08 A RESOLUTION APPROVING A PLAT OF VACATION OF PUBLIC UTILITY EASEMENT AT TIMBERLANE APARTMENTS. 601-605 EAST PROSPECT AVENUE WHEREAS, Lawrence Management ("Petitioner") has requested approval of a Plat of Vacation for the purpose of vacating a twenty (20') foot wide public utility easement located at the southwest corner of the Timberlane Apartments located at 601-605 East Prospect Avenue, Mount Prospect, Illinois ("Property"), and legally described as: That part of Lot 1 bounded and described as follows: beginning at the most northerly southwest corner of said lot 1; thence north along the most westerly west line of said Lot 1, a distance of 20.0 feet (the most westerly west line of said lot 1 also being the east line of William Street); thence east along a line 20.0 feet north of and parallel with the most northerly south line of said Lot 1, a distance of 200.0 feet; thence south along a line parallel with the most westerly west line of said Lot 1, a distance of 20.0 feet to the most northerly south line of said Lot 1; thence west along the most northerly south line of said Lot 1, a distance of 200.0 feet to the place of beginning, all in Tech Resubdivision, being a Resubdivision of Lots 5 an 7 in Gleich's Industrial Park, being a Subdivision of part of the west 'Y2 of the northeast % and part of the west 'Y2 of the southeast % of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and Property Index Number: 08-12-428-008-0000; and WHEREAS, the Petitioner is seeking to vacate the easement in order to construct a future property maintenance building at the eastern of the easement; and WHEREAS, the easement does not have any utilities placed within its boundaries which begin on the west side of the property with its property line along William Street and extends 200 feet to the east into the center of the apartment complex; and NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: That the Plat of Vacation for property at 601-605 East Prospect Avenue, a copy of which is attached to this Resolution as "Exhibit A", is hereby approved for appropriate execution and recording.
