CAF/ 5/11/93 ORDINANCE NO. 4556 AN ORDINANCE GRANTING A VkRIATION FOR PROPERTY LOCATED AT 412 NORTH PINE STREET WHEREAS, Susan A. Ramstedt (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 412 North Pine Street (hereinafter referred to as Subject Property), legally described as: Lot 53 In H. Roy Berry Co's 1st Addition to Castle Height, being a subdivision of the South 1/2 of the Southeast 1/4 of the Northwest 1/4 and the North 95.02 feet of the East 1/2 of the Southwest 1/4 all in Section 34, Township 42 North, Range 11, East of the Third Principal Meridian and WHEREAS, Petitioner seeks a variation from Section 14.1102.A to allow a twenty-four foot (24') front yard setback, instead of the required 30 feet, in order to construct a porch; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 22-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of April, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of April, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 22-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.A to allow a twenty-four foot (24') front yard setback, instead of the required 30 feet, in order to allow for the construction of a porch. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 BA 22-V-93 Page 2 of 2 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
