PRESENTATION OF GRANT AWARD FOR PEDESTRIAN SIGNAL
Illinois House of Representative Sidney Mathias, representing the 53rd District, will be presenting a grant
award at the September 16th Village Board Meeting. The $45,000.00 grant, sponsored by Representative
Mathias, has come from the Illinois Department of Commerce and Economic Opportunity (IDCEO). The
Engineering Division completed the grant application earlier this summer and was recently notified of the
award. The money will be used to install LED countdown pedestrian signals at the following three
intersections:
1. Euclid Avenue & Wheeling Road - adjacent to Euclid Elementary School
2. Route 83 & Lincoln Street - adjacent to St. Raymond School and near Lincoln Junior High School
3. Route 83 & Central Road - adjacent to library, condos & downtown shopping
Plans have already been prepared and contractors selected for the project. Work is expected to be
completed before the end of the year. Please include this item on the September 16th Village Board
Meeting Agenda.

On June 24, 2008 Mayor Irvana Wilks, Corporation Counsel Everette Hill, Village
I Manager and Administrative Assistant Doreen Jarosz met with Sanae Amafuji regarding
her request for a new Class "S" liquor license. The Class "S" designation provides for
full liquor service in a restaurant with a lounge. Ms. Amafuji currently operates Nina
Restaurant at 1730 W. Golf Road with a Class "R" liquor license. The Class "R" liquor
license provides for full service liquor at dining tables only. In conjunction with the
request for a Class liS" license, Ms. Am afuji is planning to move the restaurant from its
current location to a new, larger location within the same "Mount Prospect Commons"
Shopping Center. The new location is the site of the former Spice Rack Kitchen
operation which closed a number of years ago.
During the normal application review and background check the Police Department
reported that Ms. Am afuji had been arrested several times on charges of driving while
intoxicate. However, none of the charges resulted in findings of guilt. This raised
concerns with the Mayor who serves as the Local Liquor Commissioner. The June 24
meeting was held to discuss the circumstances surrounding the charges. During those
discussions it was also determined that Ms. Amafuji was not operating her
establishment in accordance with the requirements of the Village Liquor Code. The two
material violations were: 1) she was serving patrons at a sit down bar in violation of the
Class "R" designation and 2) she was allowing patrons to purchase and possess bottles
of alcohol which she maintained for them in a manner somewhat similar to a "wine club"
operation. Again, the Village Code does not provide for that type of service
arrangement.

After considerable discussion with Ms. Amafuji and consultation with Village Counsel
and staff, the Mayor determined that it would be in the best interest of the Village if the
requested Class "S" liquor license be issued as a Class "XX" license. The Class "XX"
license provides for the sale of alcoholic liquor with special conditions. In this case the
"XX" license will operate under the rules and regulations that govern a Class "S"
designation. Other special conditions are attached hereto as Exhibit A. Ms Amafuji has
been apprised of these special conditions and has agreed to strictly abide by same.
Failure to do so could result in severe penalties up to and including license revocation.
This is the first Class "XX" issued by the Village.
A completed application has been submitted along with all required fees and
documents. The petitioner has submitted to fingerprinting and background checks. If the
Village Board considers this request favorably an Ordinance creating a Class "XX"
would be appropriate. At the same time the existing Class "R" license would be deleted.

RE: New Class XX Liquor License for Nina Restaurant 1774-1778 West Golf Road
This Class XX License is issued to OSAKA CORPORATION, DBA NINA RESTAURANT, is
subject to the following conditions:
1. Strict compliance with each and every regulation of a Class S Liquor License.
2. Strict compliance with each and every regulation of the Village of Mount Prospect.
3. SANAE AMAFUJI along with all current employees must successfully complete a
certified liquor server's course and provide proof thereof to the Local Liquor Control
Commissioner. All future employees must also submit proof of a successfully completed
certified liquor server's course within fourteen days of completion.
4. Confirmation of attendance by SANAE AMAFUJI at a state approved alcohol or
dependency agency that tests for and treats alcohol dependency. This shall include
compliance with each and every requirement of such agency. The Village must receive
proof of such attendance and compliance no later than December 31,2008.
5. Written notification by SANAE AMAFUJI, to the Mount Prospect Village Manager, of any
traffic stop of SANAE AMAFUJI by any police agency of any jurisdiction where SANAE
AMAFUJI either took a blood/alcohol content test or refused to take such a test after
being given an opportunity to do so. If SANAE AMAFUJI is charged with either
operating a motor vehicle with a blood/alcohol content in excess of .08 or of a refusal to
take such a test, the Mount Prospect Local Liquor Control Commissioner may conduct a
hearing on the validity of the charge. If the charge is found by the Mount Prospect Local
Liquor Control Commissioner to be valid, the privilege of distributing alcoholic
beverages pursuant to this license shall be revoked. This shall apply irrespective of any
finding of not guilty by a court of law.
If there is a violation of or non-compliance with any of the above provisions, this Class XX
license shall be subject to revocation.

AN ORDINANCE AMENDING CHAPTER 13 OF THE
VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT,
COOK COUNTY, ILUNOIS ACTING IN THE EXEROSE OF THEIR HOME RULE POWERS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of
Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses
available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized.
Said list is hereby amended by decreasing the number of Class" R" Liquor Licenses by One (1)
Osaka Corporation d/b/a Nina Restaurant 1730 West Golf Road and increasing the number of
Class "XX" Liquor Licenses by One (1) Osaka Corporation d/b/a/ Nina Restaurant 1774-1778 West Golf
Road.
