ORDINANCE NO. 10 48
AN ORDINANCE TO AMEND SECTIONS 13.101,
13.106, 13.107 and 13.114.1 OF
CHAPTER 13 OF THE f1UNICIPAL CODE OF
MOUNT PROSPECT OF 1957, AS AMENDED
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
Section 1: That Section 13.101 of Chapter 13 of the
Municipal Code of Mount Prospect of 1957 as amended, be and
the same is hereby amended to and shall hereafter read as
follows:
"Section 13.101 Definitions. Unless the context
otherwise requires, the following terms as used
in this article shall be construed according to
the definitions given below.
Alcoholic liquor - any spirits, wine, beer,
ale or other liquid containing more than one-
half of one per cent of alcohol by volume, which
is fit for beverage purposes.
Retail sale - the sale for use or consumption
and not for re-sale.
Restaurant - any public place kept, used,
maintained, advertised and held out to the public
as a place where meals are served, and where
meals are actually and regularly served, without
sleeping accommodations, such space being pro-
vided with adequate and sanitary kitchen and
dining room equipment and capacity and having
employed therein a sufficient number and kind of
employees to prepare, cook and serve suitable
food for its guests.
Hotel - every building or other structure,
kept, used, maintained, advertised and held out
to the public to be a place where food is
actually served and consumed and Sleeping
accommodations are offered for adequate pay to
travelers and guests, whether transient, perman-
ent, or residential, in which twenty-five or
more rooms are used for sleeping accommodations
and dining rooms being conducted in the same
building or buildings, structure or structures
being provided with adequate and sanitary
kitchen and dining room equipment and capacity.
Club - a corporation organized under the laws
of this State, not for pecuniary profit, solely

for the promotion of some common object other
than the sale or consumption of alcoholic
liquors, kept, used and maintained by its mem-
bers, through the payment of annual dues, and
o\~ing or hiring or leasing a building or
space in a building, of such extent and char-
acter as may be suitable and adequate for the
reasonable and comfortable use and accommoda-
tion of its members and their guests and pro-
vided with suitable and adequate kitchen and
dining room space and equipment and maintain-
ing a sufficient number of servants and
employees for cooking, preparing and serving
food and meals for its members and guests;
provided that such club files with the Village
President at the time of its application for a
license under this article, two copies of a
list of names and residences of its members,
and similarly files within ten days of the
election of any additional member his name and
address, and provided that its affairs and
management are conducted by a Board of Directors,
Executive Committee, or similar body chosen by
the members at their annual meeting, and that no
member or any officer, agent, or employee of the
club is paid, or directly receives, in the form
of salary or other compensation any profits from
the distribution or sale of alcoholic liquor to
the club or its members or its guests introduced
by members beyond the amount of such salary as
may be fixed and voted at any annual meeting by
the members or by its Board of Directors or other
governing body out of the general revenue of the
club.
Original package - 'original package' means
any bottle, flask, jug, can, cask, barrel, keg,
hogshead or other receptacle or container, what-
soever, used, corked or capped, sealed and
labeled by the manufacturer of alcoholic liquor,
to contain and to convey any alcoholic liquor."
Section 2: That Section 13.106 of Chapter 13 of the
Municipal Code of Mount Prospect of 1957 as amended, be and
the same is hereby amended to and shall hereafter read as
follows:
"Section 13.106 License fees. Every person,
firm or corporation engaged in the retail
sale of alcoholic liquor in the village shall
pay an annual license fee. Such licenses
shall be divided into the following classes:

Class "A" license, which shall authorize
the licensee to sell and offer for sale at re-
tail in the premises specified in such license
alcoholic liquor for consumption on said
premises and also alcoholic liquor in its
original ~ackage. The annual fee therefor
shall be $1500.00.
Class "B" license, which shall authorize
the licensee to sell and offer for sale at re-
tail in the premises specified in such license
alcoholic liquor only for consumption on the
said premises. The annual fee therefor shall
be $1000.00.
Class "C" license, which shall authorize
the licensee to sell and offer for sale at re-
tail in the premises specified in such license
alcoholic liquor in its original package only.
The annual fee therefor shall be $1000.00.
Class "D" license for issuance to private
clubs and civic or fraternal organizations not
operated for pecuniary profit, which shall
authorize the licensee to sell and offer for
sale at retail in the premises specified in
such license alcoholic liquor to its members
and guests only for consumption on the said
premises. The annual fee therefor shall be
$250.00."
Section 3: That Section 13.107 of Chapter 13 of the
Municipal Code of Mount Prospect of 1957 as amended, be and
the same is hereby amended to and shall hereafter read as
follows:
"Section 13.107 Number of licenses. There
shall be issued in the village no more than:

three class "A" licenses;
one class "B" license;
one class "C" license;
one class "D" license
to be in effect at any time."
Section 4: That Section 13.114.1 of Chapter 13 of the
Municipal Code of Mount Prospect of 1957 as amended, be and
the same is hereby amended by adding thereto Section
13.114.1 B as follows:

liB. The display or sale of alcoholic liquor
in its original package under a class "c"
license in premises where any other commod-
ities, excepting such items as cigars,
cigarettes and those items customarily
associated with package liquor stores, are
sold or offered for sale, shall be conducted
only in a portion of such premises set aside
or physically separated from that portion of
the premises used in connection with the dis-
play or sale of such other commodities. 11
Section 5: That this ordinance shall be in full force
and effect from and after its passage and approval according
to law.
Section b: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed,
reserving however, to the Village of Mount Prospect any
rights which have accrued to it against any person, firm or
corporation under any ordinances, or sections of ordinances
which may be and are hereby repealed.
