AN ORDINANCE Ar~NDING THE VILLAGE OF
MOUNT PROSPECT ZONING ORDINANCE AS
A~NDED
WHEREAS, the corporate authorities of the Village of

Mount Prospect on the 24th day of March 1959

annexed to the Village of Mount Prospect the following-
described property:
The West 460 feet as measured along the
North line of the East Half of the
South East Quarter of Section 27, Town-
ship 42 North, Range 11 East of the
Third Principal Meridian (except that
part conveyed to County of Cook by deed
dated October 4, 1941 and recorded
October 8, 1941 as Document 12771139).
and
WHEREAS, in connection with the annexation of said
property and in the interests of public welfare, safety
and health of the residents of the Village of Mount
Prospect the corporate authorities of the said Village
deemed it necessary to determine the proper zoning to be
applied to said property when so annexed; and
vTHEREAS, a Notice of Public Hearing vlith respect to
the question of establishing zoning of the aforesaid
property was duly published in the Mount Prospect Herald,
a newspaper of general circulation in the Village of
Mount Prospect; and
vJHEREAS, a Public Hearing was held by the Board of
Appeals of the Village of Mount Prospect in the Village
Hall in the Village of Mount Prospect on the 30th day of
January, 1959, at the hour of 8:00 P. M. pursuant to the
provisions of the aforesaid Public Notice, and all persons
who desired to be heard were heard, and an opportunity
given to all persons who desired to make remonstrances

and objections with references thereto; and
WHEREAS, the Board of Appeals of the Village of Mount
Prospect, subsequent to said Public Hearing, recommended
that if said property be annexed to the Village of Mount
Prospect the aforesaid property be zoned in accordance
with their recommendation and thereafter upon further con-
sideration of said matter by a proper committee of the
Board of Trustees of said Village, the corporate authorities
of the Village of Mount Prospect do hereby find that it is
in the public interest and will aid and promote the public
safety, health and welfare of the residents of the Village
of Mount Prospect to zone the property as hereinafter set
forth:
NOVl, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOAP~ OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
Section 1: That an ordinance entitled., llAn ordinance
classifying, regulating and restricting the location of
trades and industries and the location of buildings
designed for specified uses; regulating and limiting the
height and bulk of buildings hereafter erected or altered,
regulating and limiting the intensity of the use of lot
areas and regulating and determining the area of yards,
courts and other open spaces within and surrounding such
buildings; establishing the boundaries of districts for
said purposes; and prescribing penalties for the violation
of its provisionsll passed and approved December 4, 1923
and amendments thereto (and known as Ordinance No. 52) as
amended, be further amended by classifying the following
described real estate as a B-3 District:

Section 2: That the Zoning Plan of the Village of
Mount Prospect as amended, be and the same is hereby
amended to conform to the above change.
Section 3: That this ordinance shall be in full
force and effect from and after its passage, approval
and publication according to law.
Section 4: That all ordinances or parts of ordi-
nances in conflict herewith be and the same are hereby
repealed, reserving however, to the Village of Mount
Prospect any rights which have accrued to it against
any person, firm or corporation under any ordinance or
sections of said Zoning Ordinance which may be and are
hereby repealed.

In consideration of the zoning of the property "B_3" by
the Village of Mount Prospect, Cook County, Illinois, pursuant
to ease No. 59-5, it is agreed and covenanted in the event
that application shall not be made for a building permit as
hereinafter provided, and said building permit not issued prior
to November 1, 1961, then the owners of said land agree and con-
sent to any action taken by the Village Board of the said Village
of Mount Prospect to rezone said land for the uses permitted
under a "R-l" classification as set forth in the Zoning Ordinance
of the Village of Mount Prospect in effect as of October 1, 1958;
provided, however, that such action by the Board of Trustees of
the Village of Mount Prospect shall be taken not later than
February 1, 1962, after which date, if no such action is taken,
this covenant shall be void. Said application for a building
permit shall be for the erection of a shopping center substanti-
ally in accordance with the plans submitted by the Petitioner
at the public hearing in case No. 58-19 and on file with the
Village of Mount Prospect. Nothing herein contained shall
impair the right of the owner or future owners of the land to
apply to the Village of Mount Prospect at any time for varia-
tions, changes or amendments in the zoning ordinances applicable
to said land, or, in the event said land is rezoned ffR-l," to
institute such proceedings as they desire, to vary, alter or
amend the zoning laws or ordinances affecting said land. The
purpose of this covenant is solely to permit the Village of
Mount Prospect, if it so desires, within the time limits above
set forth, to rescind the zoning granted pursuant to ease No.
59-5 if a permit is not issued as aforesaid.
