"
AN ORDINANCE GRANTING A VARIATION FROM
THE VILLAGE OF MOUNT PROSPECT ZONING
ORDINANCE AS AMENDED
\fHEREAS, a notice of public hearing on the ques-
tion of granting a variation on the use of the following
described property:
Lot 20, Sub Lot L/7, Block 8 of Section
12, Township 41 North, Range 11 East of
the 3rd Principal Meridian, in Cook
County, Illinois
was duly published in the Mount Prospect Herald, a news-
paper of general circulation in the Village of Mount Pros-
pect; and
vffiEREAS, a public hearing was held by the Board
of Appeals of the Village of Mount Prospect in the Village
Hall on the 30th day of January, 1959 at the hour of 8:00
P.M., and all persons who desired to be heard were heard
and an opportunity given to all persons who desired to make
remonstrances and objections with reference thereto; and
\fHEREAS, the Board of Appeals of the Village of
Mount Prospect subsequent to said hearing, recommended that
a variation not be granted; and
vffiEREAS, the corporate authorities of the Village
of Mount Prospect, after considering the matter as afore-
said, do hereby find as follows:
1. The Petitioner and owner of said property
is the St. Mark's Lutheran Church.
2. That the aforesaid property is now zoned
in the R-l District and pursuant to Section 4 of the Zoning
Ordinance, one of the uses established thereunder is for
church purposes.
3. The applicant's petition is for the purpose
of allowing a children's playground in conjunction with

the facilities and services offered by St. Mark1s Lutheran
Church, and also for additional off-street parking as
necessary and desired in consideration of the services con-
ducted by said st. Mark's Lutheran Church.
4. That it is in the public interest of the
Village of Mount Prospect and in the best interests of pub-
lic safety of the residents of said Village to have avail-
able in conjunction with the facilities offered by said
church adequate space for a children's playground and also
when needed additional space for off-street parking, all
of which will, in the opinion of the corporate authorities,
enhance the public welfare, public safety, public health
and public morals of the Village of Mount Prospect.
5. That for so long as St. Mark's Lutheran Church
owns said property it is in the public interest to grant
a variation from the application of the Zoning Ordinance
of the Village of Mount Prospect to permit the said lot
to be used by the said church for a children's playground
and additional parking facilities.
NOW, THEREFORE, BE IT ORDAINED By the President
and Board of Trustees of the Village of Mount Prospect, Cook
County, Illinois:
Section 1: That there is hereby granted for the
following-described property the right to use said property
by st. Mark's Lutheran Church for a children's playground
and additional parking facilities under the present R-l
zoning district of the Village of Mount Prospect Zoning
Ordinance as amended:
Lot 20, Sub Lot L/7, Block 8 of Section
12, Township 41 North, Range 11 East of
the 3rd Principal Meridian, in Cook
County, Illinois

Section 2: That no building or structure shall
be erected on said property.
Section 3: That the variation granted hereby
shall apply only to the st. Mark's Lutheran Church and is
for the sole purpose of a children's playground and addi-
tional parking facilities in connection with and incidental
to the operation of st. Mark's Lutheran Church.
Section 4: That the Zoning Plan of the Village
of Mount Prospect as amended, be and the same is hereby
modified to conform to the instant variation.
Section 5: That this ordinance shall be in full
force and effect from and after its passage, approval and
publication according to law.
Section 6: That all ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed, reserving, however, to the Village of Mount Pros-
pect any rights which have accrued to it against any person,
firm or corporation under any ordinances or sections of the
Zoning Ordinance which may be and are hereby repealed.
