I ORDINANCE NO. bC/j . , AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a Notice of Public Hearing with respect to the question of rezoning the following-described property from R-l (Single-Family Residence) District to B-3 (Business- Retail and Service) District use: Lots 5, 6, and 8 in Maplewood Heights, being a subdivision of the east 15 chains of that part lying north of railroad of the Southeast one- quarter of Sec. 12 (except the southerly 60 ft. for road) and also of Block 26 in Busse's Eastern addition to Mt. Prospect in the East one half of Sec. 12, Twp. 41 North, R-12, East of the 3rd Principal Meridian, in Cook County, Illinois, was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 17th day of April, 1959 at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said public hearing, recommended by letter dated April 21, 1959 that the aforesaid property be rezoned as hereinafter specified, and WHEREAS, the corporate authorities of the Village of Mount Prospect, having further considered this matter, have determined that the property hereinafter described should be rezoned as hereinafter specified in the public interest of the Village of Mount Prospect, - 2 - NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, "An Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for spec- ified uses; regulating and limiting the height and bulk of build- ings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and sur- rounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisions" passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by reclassifying the following-described real estate from R-l (Single-Family Residence) District to B-3 (Business-Retail and Service) District use: Lots 5, 6, and 8 in Maplewood Heights, being a subdivision of the East 15 chains of that part lying north of railroad of the Southeast one- quarter of Sec. 12 (except the southerly 60 ft. for road) and also of Block 26 in Busse's Eastern addition to Mt. Prospect in the East one half of Sec. 12, Twp. 41 North, R-12, East of the 3rd Principal Meridian, in Cook County, Illinois. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, - 3 - reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be and are hereby repealed. i, PASSED this r-~) day of " / t- t, ' 1959. \ I "" r , r I / APPROVED this I ~" day of I ' 1959.
