ORDINANCE NO. (-,71
AN ORDINANCE GRANTING A VARIATION FROM
THE VILLAGE OF MOUNT PROSPECT ZONING
ORDINANCE AS AMENDED
WHEREAS, a Notice of Public Hearing on the question of
a variation from the Village of Mount Prospect Zoning Ordi-
nance as amended to permit the erection of a sign on the
following-described property located in the R-l (Single-
Family Residence) District:
Strip of land 70' x 280' adjoining on the
north Lots 23 and 24 in Owner's Subdiv.,
Sec. 13, Twp. 41 N~ R. 11, East of 3rd
P.M. in Cook County
was duly published in the Mount Prospect Herald, a newspaper
of general circulation in the Village of Mount Prospect; and
WHEREAS, a Public Hearing was held by the Board of
Appeals of the Village of Mount Prospect in the Village Hall
in the Village of Mount Prospect on the 17th day of April,
1959, at the hour of 8:00 P.M. pursuant to the provisions of
the aforesaid Public Notice, and all persons who desired to
be heard were heard and an opportunity given to all persons
who desired to make remonstrances and objections with
reference thereto; and
WHEREAS, the Board of Appeals of the Village of Mount
Prospect, pursuant to Section 16 (B)(2) of said zoning
ordinance, subsequent to said hearing, recommended by letter
dated April 21, 1959 that the variation requested be granted;
and
WHEREAS, the corporate authorities of the Village of
Mount Prospect, after considering the matter as aforesaid,

do hereby find as follows:
1. That, based on the facts presented to the Board of
Appeals at the aforesaid public hearing, the provisions of
Section 4 of the said zoning ordinance insofar as such pro-
visions apply to prohibit the erection and maintenance of a
temporary sign on the aforesaid property as petitioned would
involve practical difficulties to the property owner in the
use of such property and in the use of other property in the
area owned by said property owner;
2. That the said application of such provisions of the
zoning ordinance to the above-described property would re-
sult in particular hardship to the said property owner in
view of the particular conditions that exist on and surround-
ing said property;
3. That the erection and maintenance of a temporary
sign on the above-described property as petitioned satisfies
the requirements for variation in harmony with the general
purpose and intent of the zoning ordinance; and
WHEREAS, the corporate authorities of the Village of
Mount Prospect do desire to grant a variation as hereinafter
set forth, which said variation is specifically limited as
herein provided,
NO'tJ, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
Section 1: That the application to the below-described
property of the provisions of Section 4, R-l District, of
the Village of Mount Prospect Zoning Ordinance as amended is

hereby suspended for a period of 24 months from the date of
passage of this ordinance
strip of land 70' x 280' adjoining on the
north Lots 23 and 24 in Owner's Subdiv.,
Sec. 13, Twp. 41 N., R. 11, East of 3rd
P.M. in Cook County
to the sole extent that the erection and maintenance of one
sign no larger than 17' x 11' as petitioned is hereby made
permissible during the said period of 24 months.
Section 2: That the variation granted hereby apply
only to the property owner of record of the above-described
property as of the date of the passage of this ordinance
and shall expire before the termination of the said 24 month
period with a change of ownership of said property.
Section 3: That the zoning plan of the Village of
Mount Prospect, as amended, be and the same is hereby
modified to conform to the above variation.
Section 4: That this ordinance shall be in full force
and effect from and after its passage and approval according
to law.
Section 5: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed,
reserving however, to the Village of Mount Prospect any
rights which have accrued to it against any person, firm or
corporation under any ordinances or sections of the zoning
ordinance which may be and are hereby repealed.
