ORDINANCE NO. &5)
AN ORDINANCE TO ANNEX CERTAIN TERRITORY
TO THE VILLAGE OF MOUNT PROSPECT,
COOK COUNTY, ILLINOIS
WHEREAS, on August 11, 1958, the following petition was
filed with the Village Clerk of the Village of Mount Prospect:
"PETITION TO ANNEX
Your Petitioner, THE EXCHANGE NATIONAL BANK OF
CHICAGO, as Trustee under Trust Agreement dated September
7, 1955, and known as Trust Number 5891, represents that
it is the owner of the East twenty (20) acres of the fol-
lowing described land, and ALFRED BUSSE and MARTHA BUSSE
represent that they are the owners of record in fee
simple of all of the following described land except the
East twenty (20) acres thereof, and that said land and
territory is located in the County of Cook and State of
Illinois:
The South 1653.37 feet of the East Half (t) of
the Southwest Quarter (t) (measured on the East
line of said tract) of Section 35, Township 42
North, Range 11, East of the Third Principal
Meridian (excepting from said tract that part
thereof described as follows: Commencing at the
Southeast corner of the Southwest Quarter of
Section 35, Thence West along the South line of
the said Southwest Quarter for a distance of
1108.91 feet, thence North along a line which
makes an angle of 9000' with the last described
line for a distance of 33.0 feet to an intersec-
tion with the North line of Central Road for a
beginning; thence West along the North line of
Central Road for a distance of 150.0 feet,
thence North along a line which makes an angle
of 9000' with the last described line for a
distance of 158.47 feet to an intersection with
the Southerly right of way line of Rand Road
(Route #12) thence Southeasterly along the said
Southerly Right of i~ay line of Rand Road for a
distance of 178.29 feet to a point on the West
line of Mt. Prospect Road extended North, thence
South 62.11 feet along said West line to the

point of beginningj and excepting from said
tract that part thereof described as follows:
Commencing at the Southeast corner of the South-
west Quarter of Section 35 thence \'fest along the
South line of the said Southwest Quarter for a
distance of 1318.91 feet, thence North along a
line which makes an angle of 9000' with the last
described line for a distance of 33.0 feet to an
intersection with the North line of Central Road
for a beginningj thence East along the North
line of Central Road for a distance of 60.0 feet,
thence North along a line which makes an angle of
90001 with the last described line for a distance
of 158.47 feet to an intersection with the
southerly right of way line of Rand Road (Route
#12) thence Northwesterly along the Southerly
Right of Way line of Rand Road for a distance of
71.27 feet to a point, thence South along a line
which makes an angle of 57017' with the last
described line measured from Southeast to South
for a distance of 197.02 feet to the point of
beginning) ,

The Southwest Quarter (t) of the Southwest Quar-
ter (t) of Section 35, Township 42 North, Range
11, East of the Third Principal Meridian (ex-
ceptin~ from said tract that part of the South
Half (2) of said Southwest Quarter (t) of the
Southwest Quarter lying West of Rand Road in Cook
County, Illinois.
Your Petitioners further represent:
(1) The above described land and territory
is not within the corporate limits of
any municipalitYj
(2) The above described land and territory
is contiguous to the Village of Mt.
Prospect, Illinoisj
(3) The above described land and territory
has no electors and inhabitants residing
thereon and therein.
Your Petitioners further represent that contempor-
aneously with the filing of this Petition, your Peti-
tioners have filed a Petition to Zone said land upon
annexation as I1B_l" to permit the use thereof for the
erection of a shopping center.

Your Petitioners further represent that this Petition
for Annexation is filed subject to the granting of the
Petition to so zone said property, and that in the event
the Village shall decline to so zone said property, then
this Petition shall be likewise denied, or withdrawn.
Your Petitioners further represent and agree that in
the event the Village shall see fit to zone said land in
accordance with the Petition to Zone, and said land is so
zoned, that this Petition for Annexation will not be
withdrawn by your Petitioners and your Petitioners will
proceed diligently to perform all acts necessary to cause
a legal and proper annexation to the Village of Mt.
Prospect to be made of said land.
WHEREFORE, your Petitioners pray that said above
described land and territory be annexed to and become
a part of the Village of Mt. Prospect, Cook County,
Illinois.

WHEREAS, the President and Board of Trustees of the
Village of Mount Prospect have considered the question of
annexation of the territory described in said petition; and
11HEREAS, the President and the Board of Trustees of
the Village of Mount Prospect have independently determined
that said property, as described in the aforesaid petition,
is not within the corporate limits of any municipality,
that it is contiguous to the present Village limits of the
Village of Mount Prospect, that no electors reside thereon,

and that the aforesaid petitioners constitute the owners of
record of all the land described in the aforesaid petition,

be and the same is hereby annexed to the Village of Mount
Prospect, Cook County, Illinois, pursuant to the provisions
of Section 7-6 (a) of the Cities and Villages Act as
amended.
Section 2: That this ordinance shall be effective
upon its passage and approval according to law.
Section 3: That the Village Clerk of the Village of
Mount Prospect is hereby authorized and directed to record
with the Recorder of Deeds of Cook County, Illinois, a
certified copy of this ordinance, together with an accurate
map of the territory annexed, attached hereto and made a
part hereof.
