HomeMy WebLinkAboutOrd 693 09/18/1959 ORDINANCE NO.H.B. AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED ". WHEREAS, a notice of public hearing on the question of granting a variation on the use of the following de- scribed property: Lots 7 and 8, H. Roy Berry's Colonial Manor Sub., Sec. 11/12, Township 41 North, Range 11, was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall on the 26th day of June, 1959 at the hour of 8:00 P.M., and all persons who desired to be heard were heard and an oppor- tunity given to all persons who desired to make remonstrances and objections with reference thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said hearing, recommended that a variation not be granted; and WHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, DO HEREBY FIND AS FOLLOWS: 1. The petitioner and owner of said property is Dr. Frank Powles, D.D.S. 2. That the aforesaid property is now zoned in the R-3 (Apartment) District, and pursuant to Section 6 of the Zoning Ordinance, the operation of a dental office is not permitted whereas under authorized use No.3, uses similar to a general hospital for humans is authorized. 3. The applicant's petition is for the purpose of permitting the erection of a building for a dental office. 4. That it is in the public interest of the Village - 2 - of Mount Prospect and in the best interests of the public health, safety and welfare of the residents of said Village to have available and adequate facilities in the Village for dental offices. 5. That it is in the public interest to grant a variation from the application of the Zoning Ordinance of the Village of Mount Prospect to permit the erection of a building on the following-described property to be used solely for dental offices and for no other purposes, NOW, THEREFORE, BE IT ORDAINED By the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1: That there is hereby granted for the following-described property the right to use said property for dental offices by Dr. Frank Powles, D.D.S: Lots 7 and 8, H. Roy Berry's Colonial Manor Sub., Sec. 11/12, Township 41 North, Range 11 Section 2: That any building erected thereon shall be used solely for dental office purposes and no other, or such purposes as are authorized by the R-3 District as set up in Section 6 of the Zoning Ordinance or as may be here- after amended. Section 3: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 5: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby , . ... - 3 - repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning Ordinance which may be and are PASSED this /1/ day of day of / APPROVED this it! repealed. ~~ , 1959. ~L 1959.
