ORDINANCE NO. 675

AN ORDINANCE GRANTING A VARIATION FROM
THE VILLAGE OF MOUNT PROSPECT ZONING
ORD INANCE AS AMENDED
WHEREAS, a notice of public hearing on the question
of granting a variation on the use of the following de-
scribed property:
Lots 26 and 27 in H. Roy Berry Co.'s Colon-
ial Manor, a subdivision in the Northeast
1/4 of Section 11 and of the Northwest 1/4
of Section 12, Township 41 North, Range 11,
East of the Third Principal Meridian
was duly published in the Mount Prospect Herald, a newspaper
of general circulation in the Village of Mount Prospect; and
WHEREAS, a public hearing was held by the Board of
Appeals of the Village of Mount Prospect in the Village Hall
on the 28th day of August, 1959, at the hour of 8 :00 P.M.,
and all persons who desired to be heard were heard and an
opportunity given to all persons who desired to make remon-
strances and objections with reference thereto; and
WHEREAS, the Board .of Appeals of the Village of
Mount Prospect, subsequent to said hearing, reconnnended that
a variation not be granted; and
WHEREAS, the corporate authorities of the Village
of Mount Prospect, after considering the matter as aforesaid,
DO HEREBY FIND AS ,f'OLLOWS:
1. The petitioners and owners of said property are
Dr. Harry Vanoucek and Dr. Gregory Padovani.
2. That the aforesaid property is now zoned in the
R-3 (Apartment) District, and pursuant to Section 6 of the
Zoning Ordinance, the operation of a dental office is not
permitted whereas under authorized Use No.3, uses similar

to a general hospital for humans is authorized.
3. The applicants' petition is for the purpose of
permitting the erection of a building for a dental office.
4. That it is in the public interest of the Village
of Mount Prospect and in the best interests of the public
health, safety and welfare of the residents of said Village
to have available and adequate facilities in the Village for
dental offices.
5. That it is in the public interest to grant a
variation from the application of the Zoning Ordinance of
the Village of Mount Prospect to permit the erection of a
building on the following-described property to be used
solely for dental offices and for no other purpose,
NOW, THEREi"ORE, BE IT ORDAINED By the President
and Board of Trustees of the Village of Mount Prospect, Cook
County, Illinois:
Section 1: That there is hereby granted for the
following-described property the right to use said property
for dental offices by Dr. Harry Vanoucek and Dr. Gregory
Padovani:
Lots 26 and 27 in H. Roy Berry Co.'s Colon-
ial Manor, a subdivision in the Northeast
1/4 of Section 11 and of the Northwest 1/4
of Section 12, Township 41 North, Range 11,
East of the Third Principal Meridian.
Section 2: That any building erected thereon shall
be used solely for dental office purposes and no other, or
such purposes as are authorized by the R-3 District as set
up in Sec. 6 of the Zoning Ordinance or as may be hereafter
amended.

Section 3: 'that the Zoning PIan of the Village of
Mount Prospect as amended, be and the same is hereby amended
to modify and conform to the instant variation.
Section 4: That this Ordinance shall be in full
force and effect from and after its passage, approval and
publication according to law.
Section 5: That all ordinances or parts of ordi-
nances in conflict herewith be and the same are hereby
repealed, reserving however, to the Village of Mount Prospect
any rights which lIlve accrued to it against any person, firm
or corporation under any ordinances or sections of the Zoning
Ordinance which may be and are hereby repealed.
