AN ORDINANCE TO AHEi\1I) SECTION 18.322 (a)
OF CaAPTER 18 Traffic OF THE CODE OF THE
VILLAGE OF hOUNT PROSPECT OF 1957 AS
AYJ.ENDED
~~~EREAS, the corporate authorities of the Village of
Mount Prospect in an effort to determine a reasonable and safe
absolute maximum speed limit on public roadways within the
Village of Hount Prospect not under the jurisdiction of the
State of Illinois, where the County of Cook, State of Illinois
have appointed a traffic committee to investigate and make
recommendations concerning the proper maximum speed limits
desirable on streets, highways and public roadways within said
Village limits; and
~~{EREAS, after said traffic investigation the said
committee has made recommendations in the interest of public
safety that the absolute maximum speed limit within the Village
of Mount Prospect in residential zoned areas on public road-
ways, streets and highways not under the jurisdiction of the
State of Illinois or County of Cook, State of Illinois, be
twenty-five (25) N.P.Il. unless the legal limit is otherwise
established and posted; and
l~dEREAS, based upon said investigation and recommen-
dation the corporate authorities of the Village of :tvIount Pros-
pect find in the interest of public safety that said recommen-
dation is reasonable,
NOW, THSREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF HOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
Section 1: That Section 18.322 Speed Restrictions.
(a) of Chapter 18 Traffic, shall be and the same is hereby

amended to and shall hereafter read as follows:
nSection 18.322 Speed Restrictions (a) No
person shall drive a vehicle upon any public high-
way at a speed greater than is reasonable and proper
having regard to the traffic in use of the way or so
as to endanger the life or limb or injure the pro-
perty of any person. If the rate of speed of any
motor vehicle,
(1) through the business or industrial
district of the Village exceeds
twenty (20) M.P.H., or
(2) if the rate of speed of any motor
vehicle through the residential dis-
tricts (as set forth in the Village
of Mount Prospect Zoning Ordinance)
on a public highway, roadway or
street solely within the Village of
Mount Prospect and not within the
jurisdiction of the State of Illi-
nois or County of Cook, State of
Illinois, exceeds twenty-five (25)
H.P.H. unless another legal limit
is otherwise established and posted,
such rates of speed shall be prima facie evidence
that the person operating such motor vehicle is
running at a rate of speed greater than is reason-
able and proper having regard to the traffic in use
of the way or so as to endanger the life or limb or
injure the property of any person. II
Section 2: The Chief of Police of the Village of
Mount Prospect shall cause to be posted along the various
streets within the Village of Mount Prospect not under the
jurisdiction of the State of Illinois or County of Cook, State
of Illinois, signs giving notice of the maximum limit of speed
established by this ordinance.
Section 3: That this Ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.

Section 4: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed, reser-
ving however, to the Village of Mount Prospect any rights which
have accrued to it against any person, firm or corporation under
any ordinances or sections of ordinances which may be and are
hereby repealed.
