HomeMy WebLinkAboutOrd 738 12/06/1960 -1-)) ORDINANCE No.M AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF NOUNT PROSPECT ZONING ORDINANCE AS ANENDED \~EREAS, a Notice of Public Hearing on the question of granting a variation on the use of the following-described property: Lot 5 in Block 29 in Prospect Park Country Club, being a sub. of the SE 1/4 of Sec. 11 and the S 15 acres of the E 1/2 of the NE 1/4 of Sec. 11, Twp. 41 N., R. 11, East 3rd P.M. in Cook County, Illinois, was duly published in the ~.'Iount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and 1~{EREAS, a public hearing was held by the Board of Appeals of the Village of IYiount Prospect in the Village Hall on the 28th day of October, 1960, at the hour of 8:00 P.M., and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remon- strances and objections with reference thereto; and W:~EREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said hearing, recommended that a variation not be granted; and lVHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, DO HEREBY FIND AS FOLLOWS: 1. The petitioner and owner of said property is Donald J. Boyle. 2. That the aforesaid property is now zoned in the R-l (Single Family Residence) District. - 2 - 3. The applicant's petition is for a variation to permit the addition of a screened patio to extend approxi- mately 3' 8" into the six foot side yard area of the premises. 4. That the granting of the variation will not de- crease an adequate supply of light and air to adjacent pro- perty, will not increase congestion in public streets; will not increase the fire hazard; will not endanger public safety; will not diminish or impair the values of property in the surrounding area; and will not in any manner impair the pub- lie health, safety, morals and welfare of the Village of Mount Prospect, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That there is hereby granted for the following-described property the right to erect and maintain on said property a screened patio to extend approximately 3'8" into the six foot side yard area of the following-described premises: Lot 5 in Block 29 in Prospect Park Country Club, being a sub. of the SE 1/4 of Sec. 11 and the S 15 acres of the E 1/2 of the NE 1/4 of Sec. 11, Twp. 41 N., R. 11, East 3rd P.M. in Cook County, Illinois. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. - 3 - Section 4: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning Ordinance which may be and are hereby repealed. ;( PASSED this / )5Jday -';II..
