UHEREAS, a notice of public [tearing on the question
of granting a variation to permit the erection of buildings
higher than authorized by the Zoning Ordinance on the Iollmv-

of general circulation in the Village of Lount Prospect; and

Appeals of the Village of Mount Prospect in the Village Hall
on the 6th day of January, 1961, at the hour of 8:00 P.H. and
all persons who desired to be heard and an opportunity given
to all persons who desired to 111ake remonstrances and obj ec-
tions with reference thereto; and
':rJE~ZI~EAS, the Board of Appeals of the\lillage of
Eount Prospect, subsequent to said hearing, recOIrmended that
variations as requested be granted; and

of liourd: Prospect, after considerin.g the matter as aforesaid,

1. The petitioner and QT,rm.er of said property is
Rand~urst Corporation.
2. That the aforesaid property is novv zoned in tile
3-3 (Retail and Service) District.

3. The applicant's petition is for variations to
permit the erection of a building without the application
of the height limitation on the buildings to beerected
thereon, which such limitation prevents a building higher
than thirty (30) feet and for a water tower not in excess
of one hundred fifty (150') feet.
4. That the regional shopping center as proposed
requires and demands a height in excess of the present limi-
tation. That the greater height will reduce the fire hazard
in that the necessary square foot area for shopping areas
will be spread over a larger portion of the building, and it
will thereby improve the public safety of the residents of
the Village.
5. That the erection of a 150 foot water tmver
will provide necessary water pressure for water facilities
of the shopping center and will increase the capacity for
fire protection.
6. That the granting of the variations will not
decrease an adequate supply of light and air to adjacent
property; will not increase congestion in the public streets;
will decrease the fire hazard; will improve public safety;
will not diminish or impair the value of property in the
surrounding area; and will not in any manner impair the pub-
lic health, safety, morals and welfare of the Village of
hount Prospect,

Section l: That there is hereb:;,;. granted for the
following-described property the right to erect a building
without application of the height limitations presently
existing in the Zoning Ordinance of the Village of hount
Prospect, Illinois, on the following-described premises,
with the unCierstanding that the height limitation v.lill be
as hereinafter set forth:
W 1/2 of SE 1/4 of Sec. 27 and West 460
feet as measured along the N line of the
E 1/2 of the SE 1/4 of Sec. 27, all in
Township 42 N, R. 11, East of the Third
Principal Neridian
Variations Granted
iJater Tower to a height not to exceed 150
feet.
Shopping Center buildings, etc. The dome
in the center of the proposed shopping
center building to a height not to exceed
85 feet; and
The balance of buildings in said shopping
center to a height not to exceed 65 feet;
provided, however, that the shopping center
buildings for which these variations are
granted are those buildings described in
the plan submitted to the Building Depart-
ment in their application for building per-
mit and as submitted to the Board of Appeals
of the Village of hount Prospect in Case No.
61-2.
Section 2: That the Zoning Plan of the Village of
Mount Prospect as amended, be and the same is hereby amended
to modify and conform to the instant variation.
Section 3: That this Ordinance shall be in full
force and effect from and after its passage, approval and
publication according to law.

Section 4: That all ordinances or parts of ordi-
nances in conflict herewith be and the same are hereby re-
pealed, reserving however, to the Village of Eount Prospect
any rights which have accrued to it against any person, firm
or corporation under any ordinances or sections of the Zoning
Ordinance which may be and are hereby repealed.
