HomeMy WebLinkAboutOrd 744 02/07/1961 '1 i/- ~ ORDINANCE NO.--L..{. / AN ORDINANCE TO REPEAL ARTICLES IV and V OF CHAPTER 24 OF THE MUNICIPAL CODE OF MOUNT PROSPECT OF 1957 AS AMENDED, AND TO ADOPT A NEW ARTICLE IV, Fire Prevention Code, OF CHAPTER 24 Miscellaneous Regula- tions WHEREAS, the corporate authorities of the Village of Mount Prospect deem it is in the best interests of the residents of the Village of Mount Prospect and will promote the public health, safety and general welfare of its resi- dents to repeal Articles IV and V of Chapter 24, Miscellan- eous Regulations, and to adopt a new Article IV, Fire Pre- vention Code, prescribing regulations governing conditions hazardous to life and property from fire or explosion and establishing a Bureau of Fire Prevention and providing offi- cers therefor and defining their powers and duties, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That Article IV, Flammable Liquids, and Article V, Liquid Petroleum Gases, of Chapter 24, Miscel- laneous Regulations, of the Municipal Code of Mount Prospect of 1957 As Amended, be and the same are hereby repealed and rescinded in their entirety. Section 2: There is hereby adopted a new Article IV, Fire Prevention Code, of Chapter 24, Miscellaneous Regu- lations, which said Article IV shall hereafter read as fol- lows: - 2 - "Article IV. Fire Prevention Code Section 24.401 Adoption of Fire Prevention Code recommended by the National Board of Fire Under- writers. The Fire Prevention Code, other than the pro- visions thereof relating to fees for licenses and permits and relating to penalties, recommended by the National Board of Fire Underwriters, 1960 Edi- tion, and subsequent amendments thereto, adopted prior to the adoption of this Code, is hereby adopted as the Fire Prevention Code of the village and is hereby made a part of this Code. Three copies of such Fire Prevention Code and amendments thereto have for more than the past fifteen days been, now are and hereafter shall be kept on file in the office of the village clerk. Where any pro- visions of such Fire Prevention Code are in conflict with the state law, the provisions of this Code or other ordinances of the village, the state law, the provisions of this Code and such village ordinances shall prevail. Section 24.402 Establishment and Duties of Bureau of Fire Prevention. A. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Depart- ment of the Village of Mount Prospect which is here- by established and which shall be operated under the supervision of the Chief of the Fire Department. B. The Fire Chief shall be Chief of the Bureau of Fire Prevention, which bureau shall consist of the Fire Chief, Superintendent of Building, and three other members to be appointed by the Chief of the Bureau. C. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department may recommend to the corporate authorities of the Village of Mount Prospect the employment of technical inspectors. Section 24.403 Definitions. Wherever the word ''Municipality'' is used in the Fire Prevention Code, it shall be held to mean the Village of Mount Prospect. Section 24.404 Prohibition of Storage and location of certain matter. A. Storage of flammable liquids in outside aboveground tanks referred to in Section l6.22a of the Fire Prevention Code is hereby prohibited. - 3 - B. New bulk plants for flammable liquids referred to in Section 16.51 of the Fire Prevention Code are hereby prohibited. C. Bulk storage of liquified petroleum gas referred to in Section 2l.6a of the Fire Prevention Code is hereby prohibited. D. Storage of explosives and blasting agents referred to in Section l2.6b of the Fire Prevention Code is hereby prohibited. Section 24.405 Modifications. The Bureau of Fire Prevention shall have power to modify any of the provisions of the Fire Preven- tion Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Bureau of Fire Prevention shall be entered upon the records of the department and a signed copy shall be furnished the applicant. Section 24.406 New Materials, Processes or Occupancies Which may Require Permits. The Village President,the Chief of the Fire Department and the Bureau of Fire Prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies, which shall require permits, in addition to those now enumerated in said code. The Chief of the Fire De- partment shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons. Section 24.407 Appeals. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within 30 days from the date of the decision of the appeal. There- upon the said President and Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent infor- mation. The decision of the President and Trustees shall be final. - 4 - Section 24.408 Permits. It shall be unlawful to construct, install or enlarge any tank, pump or piping equipment for the storage or handling of flammable or volatile liquids such as defined in this article without having first obtained a permit therefor. Application for such permits shall be made to the Village Clerk, and shall be accompanied by a drawing to scale show- ing the location as well as plans showing the type and nature of installation or alteration. Section 24.409 Approval. No such permit shall be issued until the Build- ing Inspector has certified that the contemplated work fully complies with the ordinances of the vil- lage. For installation of fuel oil tanks having a capacity of more than two thousand gallons and less than 20,000 gallons - $75.00. For installation of tanks for storage of gaso- line having a capacity of less than 10,000 gallons - $75.00. For installation of fuel oil tanks having a capacity of 20,000 gallons or more - $75.00. For installation of gasoline storage tanks having a capacity of 1,000 or over - $75.00. For installation of tanks for other flammable liquids - $75.00. Section 24.410 Penalties. A. Any person who shall violate any of the provisions of the code hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved there- under, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modi- fied by the Chief of the Fire Prevention Bureau or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor, punishable by a fine of not less than $10.00 nor more than $200.00 or by imprisonment for not less than 10 days nor more than six months, or by both such fine and imprisonment. The imposition of one penalty for any and all such persons shall be required to correct or remedy such violations or de- fects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. B. The application of the above penalty shall not be held to prevent the enforced removal of pro- hibited conditions. - 5 - Section 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 4: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of ordinances which may be and are hereby repealed. rw ~ ~ PASSED this~day of ;Iit~ APPROVED this~day of 7-~'J , 1961. , 1961. \!?r~JQ,~~ Village Presi ent
