Police hagistrate, of the [,:unicipal Code of Lount Prospect
of 1957 as amended, to provide for the requirement of bond,
duties, disposition of monej"s and compensation; and

corporate authorities of the Village
of ]Y..ount Prospect believe it is in the public interest of
the residents of the Village of l.~OUl1"t Prospect to adopt the
amendments hereinafter set forth,

Section l: That Article 4 Police liagistrate, of
the l:Iunicipal Code of Hount Prospect of 1957 as amended, be
further amended to add the following sections thereto:
"8.403. Bond.
Before entering upon the duties of his office,
the police magistrate shall execute a bond as pro-
vided hv lavl.

3 .lj.04. Duties Generally - Dispos ition of Fines
and Costs.
The police magistrate shall perform the duties
imposed upon him by the laws of the state, this Code
and other ordinances of the Village. It shall be
the duty of the police magistrate to pay over to the
Village Treasurer all fines and costs collected in
such cases as are heard by him and to make such re-
ports ~vith respect thereto, all on forms and by pro-
cedures prescribed from time to time by the Village
I.ianager. It shall further be the duty of the police
magistrate to impose such costs as are provided in
the Illinois Revised Statutes comparable thereto,
as it may be amended from time to time.

8.405. Bail - Procedure Upon Receipt.
i:Jhenever bail is paid to either the police
magistrate or a member of the Police Department
the amount of monev so received shall be thereafter

cared for in accordance'with a procedure as is from
time to time established by the Village lilanager. The
total amount of bail money so received shall be de-
posited in a special account at such bank as may be
from time to time authorized bv the President and

Board of Trustees of the Village, and said account
to be under the jurisdiction of the Clerk of the
Police Hagistrate Court arid to be identified as
lIBail Bond and Fines - Special Account.!! The money
so collected shall be paid over to the Village Trea-
surer in accordance with such procedure as is frOiITl time
to time authorized to be used by the Village ];.]anager.
8.406. Compensation; substitute to be paid by
police magistrate.
The police magistrate shall be paid such com-
pensation as shall be established by ordinance or
resolution adopted by the president and board of
trustees. It shall further be the duty of the police
magistrate to pay from his ovm funds, to any judge who
shall sit in his place and stead in the event of the
absence of the police lliagistrate such sum of money
as may be from time to time established by resolution
of the president and board of trustees.

8.407. Clerk.
There is hereby created the office of Clerk of
the Police Magistrate Court. It shall be the duty of
the Clerk to attend all regular sessions of the police
magistrate's court, and to assist the police magistrate
in li:eeping the records of all proceedings held in the
court, including the disposition of every case which
shall be heard by the police magistrate or whomsoever
shall be sitting in his place and stead. The compen-
sation to be paid to such Clerk shall be such sum as
shall be established by ordinance or resolution adopted
by the pr'esident and board of trustees. The Clerk
shall be appointed by the president, by and \vitl1 the
consent of the members of the board of trustees.))
Section 2: T:lO.t this Ordirlance shall be in full
force and effect from and after its passage, approval and
publication according to law.
Section 3: That all ordinances or parts of ordi-
nances in conflict here'\vith be and the same are herebv re-

pealed, reserving hmvever, to the Village of Hount Prospect

any rights which ~lave accrued to it against any person, firm
or corporation under any ordinances or sections of ordinances
\vhich may be and are hereby repealed.
