WOW 'l'HERElORE, BE IT ORDADlED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That the Municipal Code or the Tillage of Moant Prospect is hereby amended by adding thereto Chapter l8-A Bicycles, the saae to read as follows: .CHAPTER 18-1. BICYCL&S Section l8-A-l.J.pplicability of traffic laws. Eve~ person riding a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this state declaring rules of the road applicable to the driver of a vehicle except as to special regulations in this article and except as to those provisions of laws and ordinances which by their natnre can have no appliea.ion. Section 18-1.-2. Obedience toofficial traffic deviees and signs a) Any person operating a bicycle shall obey the instructions of official traffic signals, signs and markings unless otherwise directed by a police officer. b) On a~ street or intersection where .U. turns or other turns are prohibited and signs are erected and in place so indicating, no person operating a bicycle shall disobey the direction of ~ such sign, except where such person dismounts fro. the bicycle to make a~ such turn, in which eTent such person shall then obey the regulations applicable to pedestrians. Section l8-A-3. Manner of riding. a) Any person operating a bicycle shall not ride other than upon or astride the permanent and regular seat attached thereto, nor carr,y ~ other person upon such bicycle other than upon a firmly attached and regular seat thereon. b) 10 bicycle shall be used to ca~ more persons at one time than the number for which it is designed and and equipped. Page One I I - 2 Section 18-1.-4. Regulations for operation of bicycles generally. It shall be unlawful for any person to operate a bicycle in any of the following described manners or any of the following enumerated conditions: 1) At a speed greater than is reasonable and prudent under conditions then existing. 2) Upon any street or highway except as Rear to the right hand side as practicable and with due care when passing ~ standing vehicle or any Tehicle proceeding in the same direction. 3) To emerge from any alley, public or private drive- way or building upon any street sidewalk or sidewalk area without yielding the right of war to all Tehicles and pedestrians approaching upon a~ street, highway, sidewalk or sidewalk area 4) B.r attaching the bicycle or the rider in a~ manner to a~ bus or Tehicle upon the street or highway. 5) B.r toving or drawing a~ coaster, sled, person on roller skates, toy vehicle or other similar vehicle upon the street or highway. S) Riding in groups upon any street or highway, except in single file. 7) Car~ing any package, bundle or article which prevents or interferes with the rider keeping both hands upon the handlebars. 8) Riding with both hands removed from the handlebars, or both feet froll!. the pedals or practice any acrobatic riding upon ~ bicyle upon the street or highway. 9) Parking or leaTing any bicycle upon the street or highway other than against the curb thereof or upon any sidewalk without supporting saae in an upright position by a kickstand or rack, or against any building, in such manner as to afford the least obstruction to pedestrian traffic. Section 18-.4-5. .Ridi~ on Sidewalks. a) Bo person shall ride a bicycle upon a sidewalk within a business district. Page Two - 3 Section 18-.1-6. Equipment Required. a) Eve~ bicycle when in use at night time shall be equipped with a lUlJ> on the front which shall ellit a white light visible froll a distance of at least fiTe hundred feet to the front and with a red reflector on the rear of a type which shall be Tisible from all distances froll fifty to three hundred feet to the rear when directly in front of lawful apper beau on a Ilotor Tehicle. A. Imp emitting a red light visible froll a distance of five hundred feet to the rear Ilay be used in addition to the red reflector. b) No person shall operate a bicycle unless it is equipped with a bell or other device capable or giving a signal audible for a distance of at least one hundred feet, except that a bicycle shall not be equipped with nor shall aqy person o.pon a bicycle use any siren or whistle. c) ETe~ bicycle shall be equipped with a brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement. Section l8-A-7. .Duty of Parents or Guardians; Applicability of Provisions of Chapter. a) No parent of any child or guardian of any ward shall authorize or knowlingly permit any such child or ward to violate any of the provisions of this chapter. b) This chapter shall be applicable to all bicycles operated upon any street, alley, highway, a sidewalk or upon any public path set aside tor the exclusive use of bicycles within the Village. Section 18-.1-8. License Required. No person who resides within the village shall ride or propel a bicycle upon ~ street or upon any public way within the Tillage unless such bicycle has been licensed and a license plate or sticker is attached thereto as provided herein. Section l8-A.-9. License Application. Application for a bicycle license and a license plate or sticker shall be made upon a form provided ~ the Tillage and shall be made to the Chief' of Police. Section l8-A-lO. Issuance ot Lictense. a) The Chief of Police upon receiTing proper application therefore is authorized to issue a bicycle license which / shall be effective until the next succeeding first day of May. b) The Chief of Police, or other person assigned such responsibility ~ the Chief of Police, shall not issue a license for any bicycle when he knows or has reasonable grounds to believe that the applic ant is not the owner or or entitled to possession or such bicycle. Page Three - 4 c) The Chief of Police, or other person assigned such responsibility by the Chief of Police, shall inspect each bicycle before licensing the same and shall refuse a license for ~ bicycle which he determines is in unsafe mechanical condition, or when the bicycle is not properly equipped in accordance with the provisions of this chapter. d) The Chief of Police shall keep a record of the number of each license, the date issued, the name and address mt the person to whom issued and the nUBer on the frame of the bicycle for which issued. e) The Chief of Police upon issuing a bicycle license shall also issue a license plate or sticker bearing the license number assigned to the bicycle, the name MOUNT PROSPErr and the period for which issued and such plate or sticker shall be firmly attached to the bicycle in such position as to be plainly visible fram the rear. / Section l8rA-ll. Transfer of Ownership. Bicycle licenses are not transferable. Upon the sale or transfer of a licensed bicycle the licensee shall notify the Chief of Police of saDIe. The purchaser or transferee, if he resides within the village, shall make application for a new license as provided herein. Section l8-A-12. Rental Agencies. A rental agency shall not rent or offer arJ)" bicycle for rent unless the bicycle is licensed and a license plate or sticker is attached thereto as provided herein and such bicycle is equipped in accordance with the provisions of this chapter. Section l8-A-13. Penalties. Any person found guilty of violating ~ provision of this chapter shall be punished by a fine of not less than one dollar nor more than $25.00 and or b.r suspensio n of the bicycle license for a period not to exceed ninety (90) days. Section 18-A-14. Publication. This ordinance shall be published in pamphlet form and shall be in full force and effect ten (10) days after publishing in pamphlet form. Such pamphlet shall haTe printed on the face of the cover the date of publication and the statement that it is publilled in pamphlet form by the authorities of the Village or Mount Prospect.- Section 2. That Section 18.613 of the Municipal Code of the Village of Mount Prospect is hereby repealed. PASSED this 27th day of February, 1962.
