AN ORDINANCE GRANTING A MODIFICATION FROM THE
DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY
COMMONLY KNOWN AS ESTATES ON MARCELLA SUBDIVISION
WHEREAS, Gettysburg Development (hereinafter referred to as
Petitioner) has requested a modification from the Development Code
(Chapter 16) of the Village of Mount ~o permit the roadway located
within this Estates on Marcella Subdivision-to taper from a width
of 67.11 feet to 45 feet; and
WHEREAS, the Plan Commission of the Village of Mount Prospect did
consider the proposed modification from the Development Code'
(Chapter 16) for subject property, which property iv legally
described as follows:
Lots 1, 2, 3 and 4 in the Estates on Marcelta in Mount
Prospect Subdivision, being a resubdivision in the West
Half of the Southeast Quarter of Section 35, Township 41
North, Range 11, East of the Third Principal Meridian, in
Cook County, Illinois;
and
WHEREAS, the Plan Commission has forwarded its recommendation
relative to the modification requested herein to the President and
Board of Trustees of the Village of Mount Prospect, and the
President and Board of Trustees have determined that the best
interests of the Village would be served in granting the
modification requested herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are
incorporate herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: That a modification from the Development Code
(Chapter 16) is hereby granted to the Subject Property to permit
the roadway located within the Estates on Marcella to taper from a
width of 67.11 feet to 45 feet.
SECTION THREE: Except for the modification from the Development
Code granted herein, all other requlremenns of said Development
Code shall apply to the Subject Property.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
