AN OHDINANCE AMENDING CHAPTER 13 OF Th'"E MUNIC IPAL CODE
OF MOUNT PROSPECT (ALCOHOLIC LIQUOR DEALERS) AND
ADDING TO THE NUMBER AND KIND OF LICENSES
NOW~ THEHEF'ORE~ BE IT uRDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
III ino is :
Section 1. That Section 13.101 of the Municipal Code
of Mount Prospect is hereby amended by adding thereto the follow-
ing definitions:
"Spirits--means any beverage which contains alcohol ob-
tained by distillation, mixed with water or other substance in
solution, and includes brandy, rum, whiskey, gin, or other spiritu-
ous liquors, and such liquors when rectified, blended or otherwise
mixed with alcohol or other substances.
"Wine--means any alcoholic beverage obtained by the
fermentation of the natural contents of fruits, or vegetables,
containing sugar, including such beverages when fortified by the
addition of alcohol or spirits, as above defined.
"Beer--means a beverage obtained by the alcoholic fer-
mentation of an infusion or concoction of barley~ or other grain,
malt, and hops in water, and includes, among other things, beer,
ale, stout, lager beer~ porter and the like."
Section 2. That Section 13.106 of. the Municipal Code
of Mount Prospect is hereby amended by adding thereto the follow-
ing:
"Class E license which shall authorize the licensee to
sell and offer for sale at retail on the premises specified in
such license wine and beer in its original package only. The an-
nual fee therefor shall be One thousand ($1,000) Dollars."
Section 3. That Section 13.107 of the Municipal Code
of Mount Prospect is hereby amended to read as follows:
IISection 13.107. Number of Licenses. 'I'here shall be
issued in the Village no more than:
"(a) Three (3) Class A licenses
"(b) Three Class B licenses
II(C) Five class C licenses
"(d) One Class D license
lI(e) One Class E license,
lito be in effect at any time."
Section 4. That Section 13.121 of the Municipal Code
of Mount Prospect is hereby amended to read as follows:
"Section 13.121.... Minors - Sale To. It shall be unlaw-
ful for any person under the age of twenty-one (21) years to pur-
chase or obtain any alcoholic liquor in any tavern or other place
in the Village where alcoholic liquor is sold.
"It shall be unlawful for any person under the age of
twent"y--one (21) years to misrepresent his or her age for the pur-
pose of purchasing or obtaining alcoholic liquor in any tavern or
other place in the Village where the same is sold.
"In every ta.vern or other place in the Village where
alcoholic liquor is sold there shall be displayed at all times in
a permanent place a printed card which shall be supplied by the
Village Clerk and which shall read substantially as follows:
"WARNING TO MINORS
"YOU are subject to a fine up to f~200.00 under the ordi-
nances of the Village if you purchase alcoholic liquor,
or misrepresent your age for the purpose of purchasing
or obtaining alcoholic liquor.
"It shall be unlawful for any holder of a retail liquor
dealer's license, or his agent or employee, to suffer or permit
any minor to be or remain in any room or compartment adjoining or
adjacent to or situated in the room or place where such licensed
premises is located; provided that this paragraph shall not apply
to any minor who is accompanied by his or her parent or guardian,
or to any licensed premises which derives its principal business
from the sale of service or other commodities than alcoholic
liquor.
"In addition to all other fines and penalties the Vil-
lage President may suspend or revoke the retail liquor dealer'S
license for any violation of the above paragraph.
"It shall be unlawful for any parent or guardian to
permit any minor child of which he or she may be parent or guar-
dian to violate any provision of this section.
"It shall be unlawful to sell, give or deliver alcoholic
liquors to any minor.
"Section 13.121b. Sale to intoxicated persons - habitual
drunkards. It shall be unlawful for any holder of a retail liquor
dealer'S license to sell, deliver or give any alcoholic liquor to
any intoJcicated person or to any person known to him to be an
habitual drunkard, spendthrift or insane, feeble-minded or dis-
tracted person."
Section 5. That this ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
