AN ORDINANCE A.MENDING THE VILLAGE OF MOUNT PROSPECT
ZONING ORDINANCE RELATING TO PROPERTY LOCATED ON THE
SOUTH 300 FEET OF SHOPPING CENTER PROPERTY AT GOLF
A.ND ELMHURST ROADS J MOUNT PROSPECT J ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount
Prospect, sitting as a Zoning Commission at a public meeting duly
called and held according to law (Appeal No. 62-6 ),
considered the question of reclassifying the real estate herein-
after described from B-I to B-3.
AND, vlHERSAS, the President and Board of Trustees of the
Village of Mount Prospect, having considered the recommendation of
said Zoning Board of Appeals,
AND, WHEREAS, the petitioner Salvatore DiMucci has agreed
to permit ,: . the rezoning of.' a parcel of property directly north
of the property in question (which is legally described on the at-
tached Exhibit A.), and has agreed that no more than twenty-five (25)
percent of the instant property being rezoned herein shall be used
f.'or building purposes,
The President and Board of Trustees of.' the Village of Mount Prospect
find and believe that the highest and best use of said real estate
is that of B-3
rrow, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois:
Section 1. That an ordinance entitled "An ordinance
classifying, regulating and restri.cting the location of trades
and industries and the location of buildings designed for speci-
fied uses; regulating and limiting the height and bulk of build-
ings hereafter erected or altered, regulating and limiting the
intensity of the use of lot areas and regulating and determining
the area of yards, courts and other open spaces within and sur-
rounding such buildings; establishing the boundaries of districts
for the said purposes; and prescribing penalties for the violation
of its provisions," passed and approved December 4, 1923, and
amendments thereto, and known as ordinance No. 52, as amended by
an ordinance known and cited as the Zoning Ordinance of Mount
prospect, passed and approved May 2, 1944, and as subsequently
amended to date hereof, be amended by reclassifying the following
described real estate from B-I to B-3

Section 3. That any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with or
who resists the enforcement of any of the provisions of this or-
dinance shall be fined not more than One Hundred ($100) Dollars
for each offense, and each day that a violation is permitted to
exist shall constitute a separate offense.
Section 4. That this ordinance shall be in full force
and effect from and after its passage, approval and ptilllication,
according to law.

The North 250 feet of the South 300 feet as measured on the Eas,t
and West lines thereof, of.' Lot 7 in Juhnke's Subdivision of that
part of the East 854.70 feet, of the Northeast quarter of Section
14, Township 41 North, Range II East of the Third Principal Meri-
dian, lying South of the center of Golf Road, Cook county, Illi-
nois,
commonly known as the 1000 block on South Elmhurst Road, or the
Juhnke farm.
