AN ORDINANCE GRANTING A USE VARIATION TO
l'ERIV:I'll A TW{)-APAHT1\~EWI' BILEVEL TO BE BUILT
ON A LOT ON SOUTH PINE STI~ET, SOD~H OF
EL~lliURST RoAD, IN THE VILLAGE OF MOUNT PR{)S~ECT
WHEREAS, the applicant LaSalle National Bank, as Trustee
under Trust No. 24221 and Charlotte Jones, sole beneficiary under
said trust, have applied for a use variation so as to permit the
construction of a two-apartment bilevel in a zoning district desig-
nated as R-l, Single Family Residence, said building to be built
in accordance witll plans submitted to the Zoning Board and Build-
ing Department of the Village of Mount Prospect, copies of which
are hereto attached and made a part of this orainance as if fully
set forth, and
WHEREAS, the petitioners have promised that the exterior
of said building shall be of brick veneer rather than frame as
shown on the attached plans, and have further promised to commence
construction of said building within six months from date hereof,
completion to be within eighteen months from date hereof, and
WllliREAS, the Zoning Board of Appeals of the Village of
Mount Prospect, in case No. 62-17 heard May 25, 1962, did find
that, although the area in question was basically single family
residential in character, the refusal to permit the construction
of the building proposed would effect a practical hardship upon
the owner and would, if built as proposed, not alter the essential
single family residential character of the neighborhood, and
VffiEREAS, because of the Zoning Board of ApPBalfs recom-
mendation and a determination by the Village of Mount Prospect
that the construction of the proposed building would be to the
best interests of the Village and its residents, the President
and Board of Trustees believe it to the best interest of the Vil-
lage that the variation in zoning be granted,
NOW, THEREFORE, BE IT CRDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook county,
IllinoiS:
Section 1. That an ordinance entitled "An ordinance
classifying, regulating and restricting the location of trades
and industries and the location of buildings designed for speci-
fied uses; regulating and limiting the height and bulk of build-
ings hereafter ~rected or altered, regulating and limiting the
intensity of the use of lot areas and regulating and determining
the area of yards, courts and other open spaces within and sur-
rounding such buildings; establishing the boundaries of districts
for the said purposes; and prescribing penalties for the violation
of its provisions," passed and approved December 4, 1923, and
amendments thereto, and known as Ordinance No. 52, as amended by
an ordinance known and cited as the Zoning Ordinance of Mount
Prospect, passed and approved May 2, 1944, and as subsequently
amended to date hereof, be varied so as to permit the construc-
tion of a two-apartment bilevel building, in accordance with the
plans submitted and attached hereto and having its exterior of
brick veneer, on property described as follows:

Lot 30 in Block 4 in Prospect Park Subdivision
No.1, being a Subdivision o'f the West half of
the North 60 rods of the Southwest quarter of
Section 12, Township 41 North, Range 11 East
of the Third Principal Meridian, Village of
Mount Prospect, County of Cook, State of Illi-
nois;
provided that construction of the aforementioned building commence
within six months from date hereof and, if not so commenced, then
this variation shall be deemed null and void.
Section 2. That the aforementioned real estate shall be
subject to all other conditions and provisions placed upon it by
the ordinances aforementioned.
Section 3. That the Building Department of the Village
of Mount Prospect is directed to issue a building permit permitting
the erection of the aforedescribed building.
Section 4. That any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with or
who resists the enforcement of any of the provisions of this or-
dinance shall be fined not more than One hundred (:1}100) Dollars
for each offense, and each day that a violation is permitted to
exist shall constitute a separate offense.
Section 5. That this ordinance shall be in full force
and effect from and after its passage, approval and publication,
according to law.
