July , 1993 Published in pamphlet form by authority of the ¢orDorate authorities of the Village of Mount Prospect, Illinois, the . 6th day of July , 1993. 712/93 ORDINANCE NO. 4570 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE (CHAPTER 16) OF THE VILLAGE CODE OF MOUNT PROSPECT RELATIVE TO PROPERTY COMMONLY KNOWN AS MILLERS STATION SUBDIVISION WHEREAS, Kimball Hill (hereinafter referred to as Petitioner) has requested modifications from the Development Code (Chapter 16) for property commonly know/~as Millers Station Subdivision (hereinafter referred to as Subject Property), legally described as follows: Millers Station Subdivision, of part of the East Half of the Southeast Quarter of Section 33, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioner has requested the following modifications from the Development Code: 1. Slope of 4 to 1 beginning one foot (1') above the normal water level, rather than 10 to one; 2. Slope of 2 to 1 from one foot (1') above the normal water level to 3 feet below normal level; 3. A four foot (4') wide level ledge below the normal water line, rather 5 feet; and 4. Waive the requirement to install a sidewalk on the east side of Millers Lane and the west side of Cathy Lane. WHEREAS, the Plan Commission did consider the modifications from the Development Code, as set forth hereinabove, at their regular meeting held on June 16, 1993; and WHEREAS, the Plan Commission has forwarded its recommendation to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have determined that the best interests of the Village would be served in granting the modifications requested herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That modifications from the Development Code (Chapter 16) are hereby granted to the Subject Property as follows: 1. Slope of 6 to 1 beginning one foot (1') above the normal water level, rather than 10 to one; 2. Slope of 3 to 1 from one foot (1') above the normal water level to 3 feet below normal level; 3. A four foot (4') wide level ledge below the normal water line, rather 5 feet; and 4. Waive the sidewalk requirement on the east side of Millers Lane and the west side of Cathy Lane illers Station Modifications SECTION THREE: Except for the modifications granted herein, all other requirements of said Development Code shall apply to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
