AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 2004 EAST WOODVIEW
WHEREAS, Robert V and Carolyn D. Hauck (hereinafter referred to as
Petitioners) have filed an application for variations from Chapter
14 of the Village Code of Mount Prospect, Illinois, for property
commonly known as 2004 Woodview (hereinafter referred to as Subject
Property), legally described as:
Lot 530 in Woodview Manor Unit 4, being a subdivision of
part of the Southeast Quarter of Section 24, Township 42
North, Range 11, East of the Third Principal Meridian,
Cook County, Illinois;
and
WHEREAS, Petitioners seek variations from Section 14.1102.B.1 to
allow a reduced interior side yard of two feet ten inches (2' 10")
on the west and three feet (3') on the east, in order to construct
handicap ramps onto the existing deck; and
WHERF~, a public hearing was held on the variations requested
being the subject of ZBA Case No. 40-V-93 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 24th day of
June, 1993, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 8th day of June, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
being the subject of ZBA 40-V-93 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grant to the Subject Property a variation
from Section 14.1102.B.1 to allow a two foot ten inch (2' 10")
interior side yard setback on the west and three feet (3') on the
east, in order to allow handicap ramps onto an existing deck of
this single family home.
SECTION THREE: Except for the variations granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted here.in
shall be null and void unless permits are issued and construction

begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
