BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
That an ordinance entitled "An Ordinance classify-
ing, regulating and restricting the location of trades and
industries and the location of buildings designed for
specified uses; regulating and limiting the height and
bulk of buildings hereafter erected or altered, regulating
and limiting the intensity of the use of lot areas and
regulating and determining the area of yards, courts and
other open spaces within and surrounding such build.

and known as Ordinance No. 52, and amendments there.

hereafter be and read as follows:
Section 1 General. A. SHORT TITLE. This ordi-
nance shall be known and may be cited as the Zoning
Ordinance of Mount Prospect.
B. SCOPE OF REGULATIONS. Except as provided
by this ordinance and except after obtaining written per-
mission from the Superintendent of Building Construc-
tion it shall be unlawful in the Village of Mount Pros-
1. To establish any use of a building, structure or
land, either by itself or in addition to another
use.
2. To expand, change or re.establish any noncon.
forming use.
3. To erect a new building or structure or part
thereof.
4. To rebuild, structurally alter, add to or relocate
any building or structure or part thereof.
5. To reduce the open space or plot area below that
required for a building or structure or to include
any part of such required open space or plot area
as that required for an adjoining building or
structure.
C. INCIDENTAL USES. Unless otherwise pro-
hibited or restricted, a permitted use also allows uses,
buildings and structures customarily incidental thereto
if located on the same site or building. plot. However,
such incidental uses, buildings and structures shall not
be established or erected prior to the establishment or
construction of the principal use or building and shall
be compatible in character with that of the principal use.

D. TEMPORARY USES. Permitted anywhere are
temporary buildings and uses necessarily incidental to
residential development or construction work for not to
exceed one (1) year. However, such buildings shall be
removed and such uses shall be abandoned simultan-
eously with development or construction work which is
completed or abandoned in less than one (1) year.
E. OTHER RESTRICTIONS. This ordinance shall
not nullify the more restrictive provisions of covenants,
agreements, resolutions, other ordinances or laws but
shall prevail notwithstanding such provisions which are
less restrictive.
Section 2 Applications, Permits and Occupancy
Certificates.
A. Applications for permits, as required by Section
1-B shall be filed in written form with the Superintend.

cription of the property as of public record and the name
of the owner and applicant and shall describe the uses to
be established or expanded. Each application shall be
accompanied by two copies of a dimensioned drawing
of the building plot showing the location and size of
buildings and structures, lot areas to be used, and auto
parking areas or garage space. Both applications and
drawings shall give such other information as may be
required for the enforcement of this ordinance.
B. The Superintendent of Building Construction
shall issue a written permit, or denial thereof with rea.
sons in writing, wi.thin 15 days from the date of the
filing of the application. In the event the permit or
denial thereof is not issued within 15 days the applicant
may appeal directly to the Zoning Board of Appeals
which shall order the issuance of the permit or denial
thereof with reasons in writing.
C. Except where an extension has been obtained in
writing from the Superintendent of Building Construc.
tion, permits heretofore and hereafter issued shall ex.
pire within 90 days if a substantial beginning has not
been made in the construction or establishment of the
use applied for and within one year if not completed.
Permit and other fees shall be as established by resolu.

D. No permit for excavation for, or the erection or
alteration of, any building or structure shall be issued
until written application has been made to the SlJ.perin.

tificate. No land, building or structure now existing or
hereafter erected or structurally altered shall be oc.
cupied or used in whole or in part for any purpose
whatsoever, and no change of use shall be made in any
land, building or part thereof, until an occupancy cer.
tificate shall have been issued, stating that the building
and proposed use comply with the provisions of this
ordinance. Within ten (10) days after the erection or
alteration of a building or structure is completed, the
Superintendent of Building Construction shall issue an
occupancy certificate or a written denial thereof stating
the reasons therefor. In the event of a denial an appeal
may be taken as in the case of the building permit.
Nothing in this section shall prevent the continuance
of the present, lawful occupancy or use of any existing
building or structure.
Section a of an ordinance entitled "An ordinance
classifying, regulating and restricting the location of
trades and industries and the location of buildings de-
signed for specified uses; regulating and limiting the
height and bulk of buildings hereafter erected or altered,
regulating and limiting the intensity of the use of lot
areas and regulating and determining the area of yards,
courts and other open spaces within and surrounding
such buildings; establishing the boundaries of districts
for the said purposes; and prescribing penalties for the
violation of its provisions" passed December 4, 1923 and
known as Ordinance No. 52 as amended by an ordinance
approved May 2, 1944, and as sUbsequently amended and
supplemented is amended by adopting a booklet of Zon-
ing Maps, which is attached hereto and made a part
hereof as the official Zoning Plan of the Village of
Mount Prospect as of December 31, 1962.
Districts. For purposes of this ordinance, all land
within the Village of Mount Prospect is hereby divided
into the following districts:
R-X District - Single Family Residence
P.1 District - Off-Street Parking - Paved
P.2 District - Off-Street Parking - Paved for Fee
P-3 District - Off-Street Parking - Unpaved
P.4 District - Off-Street Parking. Unpaved for Fee
R-1 District - Single Family Residence
RA District - Single Family Residence
R-2 District - Duplex Residence
R-3 District - Apartment Residence
R-4 District - Residential Planned Development
G District - Golf Club
B-1 District - Business Shopping Center
B-2 District - Business - Office
a-3 District - Business - Retail and Service
1-1 District - Light Industrial
1-2 District - Railroad
The boundaries of such districts are hereby estab-
lished as shown on the Zoning Plan, which accompanies
and is hereby made a part of this ordinance. Any land
whose classification is not shown thereon and land here-
after annexed to the Village of Mount Prospect is hereby
classified as in the R-1 District until differently classi-
fied by amendment of this ordinance. An official copy of
the Zoning Plan as amended from time to time shall be
maintained and exhibited in the Village Building De-
partment.

Section 5 SPECIAL USES:
(a) Purpose. The development and execution of a
zoning ordinance is based upon the division of the Vil.
lage into districts, within which districts the use of land
and buildings and the bulk and location of buildings and
structures in relation to the land are substantially uni-
form. It is recognized, however, that there are special
uses which, because of their unique characteristics, can-
not be properly classified in any particular district or
districts without consideration, in each case of the im-
pact of those uses upon neighboring land and of the
public need for the particular use at the particular loca.
tion. Such special uses fall into two categories:
1. Uses publically operated or traditionally affected
with a pUblic interest.
2. Uses entirely private in character but of such an
unusual nature that their operation may give
rise to unique problems with respect to their im-
pact upon neighboring property or pUblic facil-
ities.
(b) Initiation of Special Use
Any person, firm or corporation owning or having
an interest in the subject property may file an applica-
tion to use such land for one or more of the special uses
provided for in this ordinance in the zoning district in
which the land is situated.
(c) Application for Special Use
An application for a special use or expansion of a
special use shall be filed with the Village Clerk on a
form prescribed by the Village Manager. The applica-
tion shall be accompanied by such plans and/or data
prescribed by the Village Manager and shall include a
statement in writing by the applicant and adequate evi-
dence showing that the proposed special use will con-
form to the standards set forth in paragraph (f) of this
Section.
(d) Hearing on Application.
Upon receipt in proper form of the application and
statement referred to in paragraph (c) of this section
the Board of Appeals shall hold at least one public hear-
ing after notice as provided in Section 30 (e) hereof.
(e) Authorization.
For each application for a special use the Board of
Appeals shall report to the President and Board of
Trustees its findings and recommendation, including the
stipulations of additional conditions, and guarantees that
such conditions will be complied with when they are
deemed necessary for the protection of the pUblic in-
terest. The Board of Trustees, subject to the require-
ments of this Section and the Statutes of the State of
Illinois, may grant or deny any application for a special
use. Special uses shall only become effective by an or-
dinance duly passed by the President and Board of
Trustees.
(f) Standards.
No special use shall be adopted by the Board unless
the following standards are found to exist:
1. That the establishment, maintenance or operation
of the special use will not be detrimental to or
endanger the public health, safety, morals, com-
fort, or general welfare.
2. That the special use will not be. injurious to the
use and enjoyment of other property in the im-
mediate vicinity for the purposes already per-
mitted, nor substantially diminish and impair
property values within the neighborhood.
3. That the establishment of the special use will not
impede the normal and orderly development and
improvement of surrounding property for uses
permitted in the district.
4. That adequate utilities, access roads, drainage,
and/ or other necessary facilities have been or
are being provided.
5. That adequate measures have been or will be
taken to provide ingress and egress so designed
as to minimize traffic congestion in the public
streets.
6. That the special use shall in all other respects
conform to the applicable regulations of the dis-
trict in which it is located, except as such regula-
tions may in each instance be modified by the
Board of Trustees pursuant to the recommenda-
. tion of the Board of Appeals.
(g) Conditionli and Guaranties.
Prior to the granting of any special use the Board
of Appeals may recommend, and the Board of Trustees
shall stipulate, such conditions and restrictions upon the
establishment, location, construction, maintenance, and
operation of the special use as deemed necessary for the
protection of the public interest and to secure com-
pliance with the standards and requirements specified
in paragraph (f) of this Section. In all cases in which
Special uses are granted the Board of Trustees shall re-
quire such evidence and guaranties as it may deem nec-
essary as proof that the conditions stipulated in con-
nection therewith are being, and will be, complied with.
(h) Requirements for Authorized Special Uses.
Each special use hereafter authorized shall be re-
quired to adhere to the off-street parking, heights and"
set-back regulations of this ordinance applicable to the
particular use district in which the special use is author-
ized.
(i) Revocation.
In any case where a special use has not been
established within one year after the date of the grant-
ing thereof, then without further action by the Board
of Appeals or Board of Trustees, the special use author-
ization shall be null and void.

Section 6 B.X District
In the R-X Districts the only uses which may here-
after be established are:
1. Single-family residence on a lot not less than
17,500 square feet in area.
2. Public school, elementary and high, or parochial
school without dormitory accommodations and
having a curriculum equivalent to a public ele-
mentary or high school.
3. Church.
4. Village park, library or museum excluding com-
mercial enterprises therein.
In District R-X the minimum dimensions of yards
shall be as follows:
FRONT YARD. Any building or structUre hereafter
erected shall be set back from the front line at least 40
feet. Exceptions: (a) open steps and terraces, (b) eaves,
chimneys, bay windows and other ordinary projections
extending into such yards not more than 18 inches.
SIDE YARD. The minimum side yard for District
R-X shall be the same as provided for in the R.1 Dis-
tricts.
REAR YARD. The minimum rear yard require-
ments for District R-X shall be the same as are now
required in the R-1 Districts.
Section 7 P.1 District
In the P-1 District the only use which may hereafter
be established is:
1. Paved off-street parking not for fee of moving
passenger vehicles.
Section 8 P.2 District
In the P-2 District the only use which may hereafter
be established is:
1. Paved off-street parking for fee of moving pas-
senger vehicles.
Section 9 P.3 District
In the P-3 District the only use which may hereafter
be established is:
1. Unpaved off-street parking not for fee of moving
passenger vehicles.
Section 10 P.4 District
In the P-4 District the only use which may hereafter
be established is:
1. Unpaved off-street parking for fee of moving pas.
senger vehicles.
Section 11 B.1 District. In the R-1 Districts the only
uses which may hereafter be established are:
1. Single family residence on inside lots of not less
than 8125 square feet; on corner lots, lot areas
per residence shall be not less than 9375 square
feet. Lot widths to be 65 feet if inside lots and
75 feet if corner lots. (see Section 4). Exception:
lots of record as of May 26, 1944.
2. Public school, elementary and high, or parochial
school without dormitory accommodations and
having a curriculum equivalent to a pUblic ele-
mentary or high school.
3. Church.
4. Village park, library or museum excluding com-
mercial enterprises therein.
5. Gardening but excluding operations causing
noise, odor or pollution to such an extent or in
such locations as to be detrimental to neighbor-
ing residential property.
Specifically excluded from this District are:
1. All signs except signs and advertising the premi-
ses upon which they are located for sale or lease
not exceeding 10 square feet in area.
2. Removal of black dirt or top soil, stone, gravel
or clay.
3. Raising of live stock.
4. Private garage housing more than two motor
vehicles, storage of trucks in the open or in
buildings, except that the occupant of the premi-
ses may store in a garage one truck not exceed-
ing 1% tons capacity.
5. A professional office except that of a surgeon,
physician, dentist, lawyer, clergyman or other
professional person using his residence for con-
sultation, emergency treatment, or performance
of religious rites only and not for general prac-
tice of his profession.
Section 12 BoA District. In the R-A District the
only uses which may hereafter be used are:
1. Single Family Residence on a lot not less than
60 feet wide and 7200 square feet in area.
2. All uses permitted in the R-l District.
3. All uses excluded from the R.l District are also
excluded from the R.A District.
Section 13 R.2 District. In the R-2 Districts the only
uses which may hereafter be established are:
1. Uses permitted in the R-l District.
2. Duplex residences on lots not less than 60 feet
wide and 8,000 square feet in area.
Uses specifically excluded from the R-l District are
also excluded from this District.
Section 14 R.3 District. In the R-3 District the only
uses which may hereafter be established are:
1. Uses permitted in the R-l and R-2 Districts.
2. Residential apartments in number not exceeding
one family living unit for eaGh 2,400 square feet
of lot area.
Uses specifically excluded from the R-l and R-2 Dis-
tricts are also excluded from this District except that a
private garage may be provided to meet the require-
ments of Section 25.
3. General hospitals for humans, orphanages,
homes for aged and similar institutions, with
sleeping rooms in number not exceeding one for
each 500 square feet of lot area.
Section 15
R-4 District-Residential Planned Development: In
the R.4 District the following use may hereafter be
established: A residential planned development for
apartments, in number not exceeding one family living
unit for each 1,400 square feet of lot area. The follow-
ing are specifically excluded: group houses, dead end or
private roadways, all other uses except accessory uses.
Section 16
Requirements to establish R-4 Residential Planned
Development: The Zoning Board of Appeals, to make a
favorable decision on an application zoning property to
the R-4 District, shall make the following required find-
ings:
1. That the proposed use is appropriate with re-
spect to the subject and surrounding property.
2. That the developer provide sufficient offstreet
parking (minimum of one parking space per
unit) .
3. That the developer has submitted a tentative
sub.division plat in accord with the plan of de-
velopment.
Section 17 B-1 Distrit't
In the B-1 District the only uses which may here-
after be established are:
1. Shopping Center with an adjoining paved, off-
street parking area to provide four (4) square
feet of parking area for everyone (1) foot of
floor area in said shopping center. (See Section
31.)
Section 18 B-2 District
In the B-2 District, the only uses which may here-
after be established are:
1. Uses permitted in the B.l District.
2. Professional or business office.
3. Village Hall, Police or Fire Station, or other mu-
nicipal building.
4. General hospitals for humans, orphanages,
homes for aged and similar institutions, with
Sleeping rooms in number not exceeding one for
each 500 square feet of lot area.
Section 19 B.3 District
In the B-3 District the only uses which may here-
after be established are:
1. Uses permitted in the B-2 Districts.
2. Lodging house or hotel, with sleeping rooms in
number not exceeding one (1) for each five
hundred (500) feet of lot area.
3. Retail business and.retail service establishments
except uses 2 to 13 inclusive of Section 22 and
except auto laundries, which shall be permitted
as a special use only.
4. Animal hospital.
5. Retail greenhouse or nursery.
6. Restaurant, tavern or confectionary.
7. Undertaking or funeral parlor.
8. Advertising sign, billboard or poster panel.
9. Private music, dancing, business, vocational or
other school or colleges.
10. Lodge hall, temple or private club.
11. Commercial swimming pool.
12. Theatre or commercial amusement place.
13. Bus passenger station.
14. Temporary carnival or circus, operating not long-
er than ten (10) days.
15. Parking lots for private self.propelled passenger
automobiles in operating condition.
Section 20
Oft-Street Parking Requirements Business Districts
No building shall hereafter be erected, altered or
extended for use for any of the business uses permitted
in the various B Use Districts except after establishing
off-street parking facilities having a total area of usable
parking space as equal to not less than 25% of the area
of the lot, tract or parcel upon which the primary busi-
ness use is conducted.
Section 21 G District
In the G District the only uses which may hereafter
be established are:
1. Golf Club inclUding golf course and clubhouse
with a portion of the area to include paved off-
street parking area of such parking space and
access thereto as the Village Board of Trustees,
after receiving recommendation of the Zoning
Board of Appeals and the Plan Commission shall
deem to be adequate for employees, members
spectators, visitors and others.
Section 22 1.1 District
A. In the 1-1 District the only uses which may here-
after be established are:
1. Bakeries.
2. Bottling Works.
3. Building material storage yard, but only when
such material is stored in a building or is en-
closed by a fence not less than eight (8) feet in
height and with openings representing less than
twenty.five (25%) per cent of the surface of the
fence.
4. Carting, express, hauling or storage yard.
5. Coal, coke or wood yard, but only where the ma-
terial is stored in a building or enclosed by a
fence as required in Item 3 of this section.
6. Dyeing and cleaning establishments.
7. Laundries.
8. Lumber yard, but only where the material is
stored in a building or is enclosed by a fence as
required in Number 3 of this section.
9. Milk distributing station.
10. Public utility sub-stations and facilities.
11. Storage warehouse.
12. Wholesale warehouse or business.
13. Industrial and manufacturing plans (not ex-
cluded by sub.section B hereof) where the pro-
cess of manufacturing, compounding, packaging
or treatment of materials is carried on in such
a manner as will conform to the performance
standards as set forth in sub-section F hereof
and which shall not be injurious or offensive to
the occupants of adjacent premises by reason of
the emission or creation of noise, vibration,
smoke, dust, fumes, odors, gases, fire hazards,
glare or heat.
14. Truck and bus terminals and the garaging and
parking of said vehicles as a special use only.
15. Auto Laundries as a special use only.

C. Height Regulations:
No building shall exceed three (3) stories or 30
feet in height; provided, however that municipal water
towers, chimneys or steeples may exceed 30 feet upon
variation after public hearing before the zoning boardeof appeals and upon approval of the corporate author-
i ties.
D. Parking Regulations
Parking space shall be provided on the lot or in a
building in the same zoning use district adequate to
accommodate the cars of the employees of any indus-
trial or manufacturing establishment permitted in this
district as well as the vehicles and trucks of the estab-
lishment in the following manner:
1. Building used for Light Industrial manufactur-
ing or storage purposes: at least one parking
space for each two persons employed on the
premises, based upon the maximum number em-
ployed on the premises;
2. For the purposes of this ordinance, a "parking
space" shall be interpreted to mean space in the
open, properly surfaced, having appropriate di-
mensions and an area of not less than 400 square
feet: such area shall be net, and all shall be
exclusive of access or maneuvering area, ramps,
columns or other obstructions and shall be kept
exclusively as a storage space for automobiles
(in operating condition); parking areas outside
of buildings shall be so surfaced, pitched drained
as to prevent the flow of water from such areas
onto adjoining property or to unpaved streets or
alleys.
E. Area Regulations
1. FRONT YARD: There shall be a front yard hav-
ing a depth of not less than 25 feet.
2. SIDE YARD: A side yard is not required ex-
cept on the side of a lot adjoining a dwelling dis-
trict in which case there shall be a side yard of
not ,less than twenty (20) feet.
3. REAR YARD: The minimum rear yard shall be
ten nO) feet except where a lot abuts upon a
dwelling district, in which case there shall be a
rear yard of not less than thirty (30) feet.
4. INTENSITY OF USE: The maximum ground
area of all buildings including parking facilities,
open or enclosed, is seventy-five (75) per cent of
the lot or area.
F. Performance Standards
The following requirements shall apply to any use
established or any lawful use altered or modified, after
the effective date of this amendment:
1. Noise. The sound pressure level, to be measured
as described below, shall not exceed the follow-
ing decibel levels in the designated octave bands
when adjacent to the designated types of use
districts.

Objectionable sounds of an intermittent nature
which are not easily measured shall be controlled as
not to become a nuisance to adjacent uses.
Methods of Measurement Measurement is to be
made at the nearest boundary of the nearest residential
area or at any other point along the boundary where the
level is higher. The sound levels shall be measured with
a sound level meter and associated octave band filter as
prescribed by the American Standards Association.
2. Smoke and Particulate Matter The emission of
smoke or dusts by manufacturing plants in an
amount sufficient to create a general nuisance to
adjOining properties shall be limited to the fol-
lowing:
(a) Ringelmann Requirement All smoke and the
emission of all other particulate matter in
quantities sufficient to produce an opacity at
any point greater than Ringelmann 3 is pro-
hibited. The only exception shall be a plume
consisting entirely of condensed steam. A
Ringelmann 1 unit is defined as twenty per
cent density for one minute. No more than
fifteen units of Ringelmann smoke shall be
permitted per hour and no smoke more in-
tense than Ringelmann 2 except that during
one hour of 24 hour day, thirty units of
smoke may be emitted but with no smoke
more intense than Ringelmann 3.
The total quantity of emitted solids shall not
exceed one pound per hour, per acre of lot
area.
3. Odors No overly objectionable or hazardous odor
shall be emitted by any use permitted in this dis-
trict in such quantities as to be readily detectable
by an average observer at any point on the boun-
dary line of the premises or beyond.
4. Noxious Cases Processes and operations of per-
mitted uses, capable of dispersing gases or toxic
particulates into the atmosphere must be hooded
or otherwise suitably enclosed. The emission of
such toxic gases or particulate matter shall be
from a stack, or in such a manner that they
create no hazard to persons or property.
~. Glare and Heat Operations producing intense
light or heat shall be performed within an en-
closed building and not be visible beyond any lot
line bounding the property whereon the use is
conducted.
6. Vibrations No uses shall be located and no
equipment shall be installed in such a way as
to produce intense, earth-shaking vibrations
which are noticeable at the property lines of the
subject premises.
Section 23 1-2 District. In the 1-2 District the only
uses which may hereafter be established are:
1. Railroad trackage and incidental equipment.
2. Necessary structure to carry trackage over or
under intersecting streets.
3. Signal system.
4. Drainage structure.
5. Leased wire.
6. Team track and incidental driveways.
7. Station, platform and means of access thereto.
8. Freight, baggage or mail handling facilities.
9. Ticket office.
10. Waiting room.
11. Station driveway.
12. Motor vehicle parking space.
13. Storage of maintenance tools, equipment and ma-
terials.
14. Watchman's shelter.
Section 24 Nonconforming Uses. Any use, lawfully
existing or under construction on the adoption date of
this ordinance or of a later amendment thereto, which
does not conform to the use provisions of said ordinance
or amendment shall be known as a nonconforming use.
Such nonconforming use, building or structure may be
continued, maintained, or changed to a nonconforming
use; but a nonconforming use shall not be (a) changed
to a use of a less restricted class, nor (b) expanded, nor
(c) reestablished if discontinued or changed to a con-
forming use for one year or more, nor (d) continued if
the building or structure be destroyed or damaged to the
extent of 50 per cent or more of its value.
A complete record of the location, value, nature and
extent of all nonconforming uses and variations shall be
shown by the Superintendent of Building Construction.
Section 25 Auto Parking or Garage Space. For
every one of the following uses hereafter established
there shall be provided on the same lot with the main
building adequate accessible automobile parking spaces
consisting of either garage or surfaced area in the fol-
lowing proportions:
1. Single family residence, Duplex residence, Resi-
dential Apartments, or Residential Planned De-
velopments-One automobile parking space for
each family living unit.
2. Hotel, Hospital, Orphanage, Home for Aged and
similar institutions - One automobile parking
space for each 500 square feet of lot area.
3. Theatre-One automobile parking space for each
two seats in the theatre.
Section 26 Maximum Heights. No building shall
hereafter be erected or structurally altered so that the
ceiling level of the uppermost story to be used for habi-
tation, assembly of persons, regular employment or
storage of merchandise or supplies exceeds 24 feet above
the average walk grade along the front of the lot oppo-
site the building. Steeples, chimneys, required parapets-
and necessary roof structures and appurtenances may
exceed 24 feet in height. Structures other than build-
ings shall not exceed 30 feet in height except water
towers.
Section 27 Minimum Side Yard. In the R-l, R-2,
R-3 and R4 Districts there shall be provided and main-
tained an open unoccupied space along each line of the
building plot which is a side line of either the lot used
or the lot adjoining, having a width of not less than 10
per cent of the width of the lot which need not exceed
10 feet in width. In the R-A District the side yard on
each side shall not be less than 5 feet. Excepted from
this regulation are:
(a) incidental or accessory buildings located more
than 75 feet from the front street line but such
buildings shall not be located within 20 feet of
the side street line of a corner lot, (b) steps,
open terraces and underground structures, and
(c) eaves, chimneys, bay windows or other or-
dinary projections extending into such yards
not more than 18 inches.
In the Business, I-I and 1-2 Districts side yards shall
not be required. If provided for the liB" Districts they
shall not be less than three (3) feet wide.
Section 28 Minimum Front Yard. Any building or
structure hereafter erected or relocated in the Village
shall be set back from the front lot line at least 30 feet,
if it is for a use allowable in the R-l, RA, R-2 or R-3
District, and at least 20 feet if it is for a use allowable
in the R-4. District. Exceptions: (a) a proposed resi-
dence building need not set back from a residence build-
..
ing existing in the same block on the adoption date of
this ordinance more than 1 foot for each 3 feet of dis-
tance between such buildings, (b) open steps and ter-
races, and (c) eaves, chimneys, bay windows and other
ordinary projections extending into such yards not more
than 18 inches.
Section 29 Minimum Bear Yard. Any building or
structure hereafter erected or relocated shall be set back
from the rear lot line at least 25 feet in the R-l, RA, R-2
and R-3 Districts, and at least 20 feet in the R4, Business
and I-I Districts. Excepted from this regulation are:
(a) incidental or accessory buildings in the R-l, R-2,
R-3 and R-4 Districts or interior lots and on corner lots
if located at least 5 feet from a rear lot line which is
also the sideline of the adjoining lot; (b) steps, open
terraces and underground structures, and (c) eaves,
chimneys, bay windows or other ordinary projections
extending into such yards not more than 18 inches.
Section 30 Board of Appeals
(A) CREATION AND MEMBERSHIP.
A Board of Appeals is hereby authorized to be es-
tablished. When used in this Section the word 'Board'
shall be construed to mean Board of Appeals. The said
Board shall consist of seven (7) members appointed by
the President by and with the consent of the Board of
Trustees. The members of the Zoning Commission in
office at the time of the adoption of this amendment
shall serve as members of the new Board for the period
of time remaining in their current terms and until their
successors are appointed and qualified. At the expira-
tion of the respective terms of office of the present mem-
bers or for any vacancy on said Board, the members of
the Board hereafter shall be appointed for terms of five
(5) years. The term of office shall expire on the fifteenth
(15th) day of Mayor until their successors shall have
been duly appointed and qualified. The President by and
with the consent of the Board of Trustees shall appoint
one of the members of the Board to serve as Chairman.
The Chairman shall be appointed to serve until May
15th of the following year. Thereafter the Chairman
shall hold office as Chairman for a period of one (1)
year and may be reappointed as Chairman. The Chair-
man shall serve until his successor has been duly ap-
pointed and qualified. All members of the Board shall
serve without compensation except that for any special
meeting of said Board there shall be paid from the fees
received for said special meeting the amount of $10.00
to the Chairman and $5.00 to each member of the Board
of Appeals present at said special meeting. Members of
the Board shall be subject to removal by the President
by and with the consent of the Board of Trustees for
cause and after a public hearing. The Board shall select
one of its members to be a Vice Chairman. A Secretary
shall keep the minutes and maintain the records of the
Board.
(B) JURISDICTION
The Board shall have jurisdiction in the following
matters:
1. It shall hold a hearing and decide appeals from
and review any order, requirement, decision, or
determination made by the Superintendent of
Building inthe administration or enforcement of
this Ordinance or upon which it is required to
pass by reason of the administration or enforce-
ment of this Ordinance.
2. It shall hold a hearing and submit recommenda-
tion to the President and Board of Trustees with
respect to any proposed variations (exceeding
25%) from this Ordinance. Amendments are de-
fined in Section 33 hereof.
3. It shall hold a hearing and submit recommenda-
tions to the President and Board of Trustees con-
cerning any proposed amendment to this Ordi-
nance. Amendments are defined in Section 19
hereof.
4. It shall hold a hearing and submit recommenda-
tions to the President and Board of Trustees con-
cerning applications for special uses in accord-
'\nce with Section 5 of the Zoning Ordinances
of the Village of Mount Prospect.
(C) APPEALS AND REVIEW.
1. From Ruling of Superintendent of Building. Any
person aggrieved by a ruling by the Superintend-
ent of Building respecting the interpretation of
this Ordinance, or any officer, department, board
or bureau of the Village affected by any ruling
of the Superintendent of Building concerning the
interpretation of this Ordinance, may take an
appeal to the Board. Such appeal shall be taken
within such time, as shall be prescribed by the
Board by general rules adopted by it, and shall
be taken by filing with the Superintendent of
Building and with the Board a notice of appeal,
specifying the grounds thereof, together with
such plats and exhibits as are reasonably neces-
sary for a proper determination of the question
presented. Such appeal shall be taken upon
forms provided by the Board. The Superintend-
ent of Buildings shall forthwith transmit to the
Board all the papers constituting the record upon
which the action appealed was taken.
2. Variations. Any property owner may file an ap-
plication for a variation under the provisions of
this Ordinance. The application for variation
shall be subject to the provisions and require-
ments of Section 34 hereof. The application shall
contain the legal description of the property and
the address by which the property is commonly
known, and shall set forth the variation reo
quested.
3. Amendments. Any property owner may file an
application for an amendment to this Ordinance
subject to the provisions of Section 33 hereof.
The application shall contain the legal descrip-
tion of the property and the address by which
the property is commonly known, and shall set
forth the amendment requested. Amendments
may also be proposed by the Board of Trustees.
4. Fees. Applicants filing appeals pursuant to this
Section shall pay such fees as may be from time
to time set and established by the President and
Board of Trustees.
5. Notice. In connection with appeals pursuant to
Section 1 hereof, the Board shall fix a reasonable
time and place for the hearing of appeals and
shall give notice thereof to the persons appealing
and to the officer from whom the appeal was
taken. In connection with matters presented to
the Board pursuant to subsections 2 and 3 here-
of, the Board shall fix the time and place of a
public hearing to be held in connection with an
application for variation or amendment, which
public hearing shall i)i.'! held only after a notice
of the time and place is published in a paper of
general circulation in the Village of Mount Pros-
pect not less than fifteen (15) days nor more
than thirty (30) days previous to the hearing;
such public notice shall contain the address or
location of the property for which a hearing by
the Board is sought, as well as a description of
the nature of the application.
(D) STAY OF PROCEEDINGS.
The appeal shall stay all proceedings in furtherance
of the action appealed from unless the Superintendent
of Building certifies to the Board after the notice of
appeal has been filed with him that by reason of facts
stated in the certificate a stay would, in his opinion,
cause imminent peril to life or property, in which case
the proceedings shall not be stayed otherwise than by a
restraining order which may be granted by the Board
or by any court of record on application with notice to
the officer from whom the appeal is taken and on due
cause shown.
(E) MEETINGS.
1. Procedure. All meetings of the Board of Appeals
shall be held at the call of the Chairman or at
such other times as four (4) of the members of
the Board may determine. The Chairman, or in
his absence, the acting Chairman, may adminis-
ter oaths and compel the attendance of witnesses.
All meetings of the Board shall be open to the
public. At the hearing parties of interest shall
appear in person or by agent or attorney. The
Board shall keep minutes of its proceedings,
showing the vote of each member upon every
question, or if absent or failure to vote indicating
that fact, and shall also keep records of its ex-
aminations and other official actions. Each mem-
ber is entitled to vote on each question unless a
member is absent or disqualifies himself. Every
rule, regulation, every amendment or repeal
thereof, and every order requirement, decision
or determination of the Board shall immediately
be filed in the office of the Board and shall be of
public record. The Board shall adopt its own
rules of procedure not in conflict with this Or-
dinance or with the Illinois statutes in such case
made and provided, a copy of said rules and
procedure shall at all times be on file in the
office of the Village Clerk. The minutes of the
Board shall be available to public examination
at reasonable hours.
2. Quorum. Four (4) members of the Board shall
constitute a quorum and must be present for any
public meeting.
(F) DECISIONS.
1. The Board shall hear and decide all matters pre-
sented to it within a reasonable time. The Board
may reverse or affirm wholly or partly or may
modify or amend the order, requirement, de-
cision or determination appealed from ta the
extent and in the manner that the Board may
decide to be fitting and proper in the premises
subject to the provisions contained in this Ordi-
nance or with the Illinois statutes in such cases
made and provided.
2. The concurring vote of four (4) members of the
Board is necessary to reverse any order, require-
ment, decision or determination of toe Superin-
tendent of Building or to decide in favor of the
applicant any matter upon which it is required
to pass under this Ordinance or to recommend
any variation from this Ordinance.
3. Where, in a specific case, after written denial of
permit by the Superintendent of Building, an
appeal is made in writing to the Board explain-
ing that because of certain exceptional conditions
peculiar to applicant's property or its environ-
ment that strict application of the regulations of
this Ordinance would result in practical difficul-
ties and particular hardship upon the order, the
Board shall consider the case at a public hearing
as prescribed herein, and shall determine and
record all the facts which sustain or fail to sus-
tain the granting of a variation from the require-
ments of this Ordinance. If the Board deter-
mines, by a concurring vote of not less than four
(4) members that a proposed variation or some
modification of it will not (1) reduce the mini-
mum area or dimensions nor increase the maxi-
mum dimensions by more than 25%, (2) impair
an adequate supply of light and air to adjacent
property, (3) increase the congestion in public
streets unreasonably, (4) increase the hazard of
fire, (5) endanger the public safety, (6) diminish
or impair the values of property within the sur-
rounding areas, (7) or in any other respect im-
pair the public health, safety, comforts, morals
and welfare of the people, it shall adopt a motion
embodying such findings and may direct the
Superintendent of Building to thereupon issue a
permit.
4. On any matter considered by the Board pursuant
to Sections 16 (B) (2 or 3) the Board's recom.
mendation shall be forwarded to the President
and Board of Trustees within fifteen (15) days
after the last public hearing held on any such
application.
Section 31 Definitions. For the purpose of this or-
dinance certain terms and words are hereby defined as
follows:
DUPLEX RESIDENCE: Two single family living
units arranged side by side separated from each other
only by a common wall. For purpose of this ordinance
a duplex residence shall be considered as one building.
FAMILY: Excepting domestic employees, any num-
ber of persons related by blood, marriage or adoption, or
not to exceed five persons not so related, living together
in a room or rooms comprising a single housekeeping
unit .shall be considered a family.
LOT: Land occupied or to be occupied by one main
use or one main building and its accessory buildings
together with such open spaces as are required by this
ordinance, and having its principal frontage upon a
street or public place shown on a plat of survey which
has been submitted to and approved by the Village
Board. A lot may be land so recorded by the Recorder
of Cook County, or registered by the Registrar of Titles
of Cook County, TIlinois, but it may include parts of or
a combination of such lots when adjacent to one an-
other.
STRUCTURAL ALTERATIONS: Any change in the
supporting members of a building or structure, includ-
ing among others, any change in the bearing walls,
columns, beams or girders.
STRUCTURES: Anything erected the use of which
requires permanent location on the ground, or attached
to something having a permanent location on the
ground, including but without limiting the generality of
the foregoing, advertising signs, billboards and poster
panels.
BULK is the term used to indicate the size of the
setbacks, the location of a lot with respect to adjoining
lots and street lines, and includes the follOWing:
(a) Amount of land per dwelling unit
(b) Front yard regulations
(c) Side yard regulations
(d) Rear yard regulations
(e) Height of building
(f) Floor area ratio
..
FLOOR AREA OF A BUILDING (for determining
Floor Area Ratio) is the sum of the gross horizontal
area of the several floors of a building measured from
the exterior face of the exterior walls. Such floor area
shall exclude garage and basement areas.
FLOOR AREA RATIO (F.A.R.) is the floor area of
a building divided by the area of the zoning lot. For
rapid calculation in determining allowable floor area in
square feet, multiply F.A.R. by lot size in square feet.
OFF-STREET PARKING SPACE shall be twenty
(20) feet x ten (10) feet. Such space shall be exclusive
of access drives, ramps and aisles, and shall be located
on the same lot that it serves, or an adjacent lot.
PLANNED DEVELOPMENT is a tract of land not
less than twenty-seven thousand (27,000) square feet
which is developed as a unit under single ownership or
control. Said tract may be composed of one or more
lots provided:
1. That each lot shall not have less than nine thou-
sand (9,000) square feet,
2. That the F.A.R. is observed as to each tract.
BASEMENT: A basement for the purpose of deter-
mining the floor area of a building shall be any floor
area of a building, the floor of which is twenty-four (24)
inches or more below curb grade.
GROUP HOUSE: A "group house" is anyone of
three or more one-family attached dwellings in a con-
tinuous row or rows.
LOT FOR PURPOSE OF PLANNED DEVELOP-
MENT: Land occupied or to be occupied by one use and
its accessory buildingg together with such open spaces
as are required by this ordjnanc,e, and having its princi-
pal frontage upon a street or pUblic place shown on a
plat of survey which has been submitted to and approved
by the Village Board, and recorded by the Registrar of
Titles of Cook County.
SHOPPING CENTER: A business development con-
taining four (4) or ,more offices or indoor retail stores,
connected by party 'wall~, developed under one owner-
ship, with an integrated, buiildi'llgarrangement, having
an aggregate floor area of mor:e than twenty thousand
(20,000) square feet, which development shall be con-
sidered as a single unit. The minimum area occupied
by a Shopping Center and its accessory off-street park-
ing facilities shall be not less than two and one-half
(21h) acres. The term Shopping Center shall not include
drive-ins and/or automotive service type or sale fa-
cilities.
Section 32 Enforcement and Penalties. This ordi-
nance shall be administered and enforced by the Super-
intendent of Building Construction, who is hereby desig-
nated as the enforcing officer. The Superintendent of
Building Construction may institute, in the name of the
Village, any appropriate action or proceedings against a
violator as provided by statute. Any person, firm or
corporation, or agents, employees or contractors of such,
who violate, disobey, omit, neglect, or refuse to comply
with, or who resi!!t enforcement of any of the provisions
of this ordinance, shall be subjected to a fine of not less
than ten (10) dollars nor more than one hundred (100)
dollars for each offense, each day that a violation is
permitted to exist shall constitute a separate offense.
Section 33 Amendments. The Regulations imposed
and the districts created by this Ordinance may be
amended from time to time by an Ordinance duly passed
by the President and Board of Trustees after a' public
hearing has been held by the Board of Appeals pursuant
to Section 30 hereof, and as authorized by and pursuant
to and subject to the requirements of Chapter 24 of the
Illinois Revised Statutes.
Section 34 Variations. The Village Board of Trus-
tees, by ordinance, after considering a recommendation
of the Board of Appeals, may authorize variations from
the provisions of this ordinance where there are prac-
tical difficulties or particular hardships in the manner
of carrying out the strict letter of any of the provisions
of this Ordinance relating to the use, construction or
alteration of buildings or structures, or the use of land.
However, no such variations shall be authorized by the
Village Board of Trustees, except in a specific case and
after a pUblic hearing before the Board of Appeals pur-
suant to notice and after a report with finding of fact
of the Board of Appeals as set out in this ordinance and
as provided by the laws of this State.
Section 35 Validity. Should a court of competent
jurisdiction dectpre any part of this ordinance to be in-
valid, such decision shall not affect the validity of the
remainder.
Section 36 When Effective. This ordinance shall be
in full force and effect from and after its passage, ap.
proval and publication according to law.
