ORDINANCE NO. 855
AN ORDINANCE AMENDING ORDINANCE NO. 302 WHICH REGULATES
PUBLIC IMPROVEMENTS BY PRIVATE CONTRACT PROVIDING FOR
THE PAYMENTS THEREOF AND ESTABLISHING PERMIT FEES
NOW THEREFORE, BE IT ORDAINED by the Presidentand Board of
Trustees of the Village of Mount Prospect, Cook County, Illinois:
Section 1. That Section 2 of Ordinance #302 be and is hereby
amended to read as follows:
"Section 2. That at the time such application is made for such
permit, the appJican shall deposit a sum of money equal to the
cost of constructing the improvements covered by said permit, the
amount of which shall be determined by the engineer of Mount
Prospect's estimate of cost or the Cost of Improvement as set
forth in the contract documents providing for the improvement,
whichever be the lesser, such sum shall then be deposited:
1. In escrow in a bank designated by the President
and Board of Trustees, or
2. 2. With the Village Treasurer in a special fund
payableat the direction of the Village Board.
The foregoing deposit may be excused (1) by the
Village Manager provided there are sufficient financial guarantees
to insure the payment of all public improvements. In determining
the sufficiency of said guarantees he shall (a) require that all
funds pledged to pay for the improvements are specifically allo-
cated for the improvements and subject to Village control or in
lieu thereof require a surety bond in the form approved by the
Village Attorney, but in an amount sufficient to cover the entire
cost of the improvements; (2) in subdivisions of more than 100 lots
the Village Manager may approve a cash escrow of less than the
full amount necessary to pay for all public improvements but in
no event less than 20% of the cost of said improvements in whcih
event he shall assure himself that all work, labor and materials
are being paid for as the job progresses."
Section 2. That Section 5 of Ordinance 302 be and is hereby
amended to read as follows:
"That no improvements shall be constructed which do not conform
with the requirements as set forth in the Official Village Plan
of the Villa~~e of Mount Prospect as adopted; all such plans and
specifications shall be inspected by the Village Engineer and
approved by him; said inspections together with the on-job
inspection of the work as it progresses shall be paid for by the
applicant at a rate of $10.00 per hour."
Section 3. That Section 6 of Ordinance #302 is amended to read
as follows:
"No permit fee is required."
Section 4. That any person, firm or corporation violating any of
the provisions of this ordinance shall upon conviction thereof, be fined
not more than Two Hundred Dollars ($200.00) for each and every offense.
Section 5. That this ordinance shall be in full force and effect
from and after its passage, approval and publication, according to law.
