ORDINANCE NO. 856
AN ORDINANCE AMENDINC THE MOUNT PROSPECT BUILDING
CODE OF 1957 AS AMENDED.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Mount Prospect, Cook County, Illinois:
Section 1. That paragraph (a) of Sec. 2.1 of Chapter I of the
Mount Prospect Building Code of 1957 is hereby amended to reas as follows:
"2.1 (a). The Provisions of the 1960 Edition of the Basic
Building Code, recommended by the Building Officials Conference
of America is hereby adopted as the regulations governing the
construction of buildings and other structures in the Village
in violation of or without compliance with these regulations."
Section 2. That paragraph (e) of Section 2.1 of Chapter I of the
Mount Prospect Building Code is hereby amended to read as follows:
"2.1 (e). In the event that any of the provisions of said
Code are in conflict with the provisions of the Building Code
or Zoning Code of the Village of Mount Prospect, the latter shall
prevail and the conflicting provisions of the adopted code
shall be of nr) effect."
Section 3. That paragraph (f) of Sec. 2.1, Chapter I of the
Mount Prospect Building Code of 1957 as amended is hereby repealed and
shall be of no force or effect.
Section 4. That Section 4 of Chapter II of the Mount Prospect
Building Code of 1957 be and is hereby amended to read as follows:
"4. In case of violation of any provisions of this code he
shall serve on the owner of the property in question a written
notice of any such violation and in the event that the work
or condition continues for a period of ten (10) working days (all
days except Sunday shall be considered working days) he shall
issue a stop order on all construction work. Stop order signs,
when posted for cause or otherwise may be removed only by the
Superintendent of Buildings or inspectors of the Building
Department. Removal of such sign or performing other than
corrective wok pursuant to such notice shall be deemed a
violation of this ordinance and the contractor and men working
in disregard of such posted notice shall be subject to the
penalt ies imposed by this ordinance. When it appears that public
health and safety require it, the Superintendent of Buildings is
authorized to stop work without first 1.6ving not ice. ."
Section 5. That Section 7 of Chapter III of the Mount Prospect
Building Code of 1957 be and is hereby amended by adding thereto the
following:
"Applicants shall not be chareed a fee for examination of
plans if the same have been used by him for building on any
lot located in the same or an adjacent subdivision."
Section 6. That Section 13 of Chapter III of the Mount Prospect
Building Code of 1957 shall be amended to read as follows:
"Structural mechanical and electrical plans must be provided
in addition to architectural plans for any buklding or
structure of fireproof, semi-fireproof or mill construction
or any building of unusual construction, structural design
or mechanical use."

Section 7. That Section 16 of Chapter III of the Mount Prospect
Building Code of 1957 is hereby repealed and shall be of no force and
effect.
Section 8. That the term "USE OF WATER" appearinf between
Section 23 and 24 of Chapter III of the Mount Prospect Building Code of
1957 be and hereby is amended to read: "USE or VILLAGE WATER".
Section 9. That Section 31 of Chapter III of the Mount Prospect
Building Code is hereby repealed and shall be of no force or effect.
Section 10. That Section 33.1 of Chapter III of the Mount Prospect
Building Code be and is hereby amended by adding thereto the following:
"The provisions of this Section shall not apply to Builders
who are subdividers and who have satisfied the provisions of
the subdivision control ordinance relating to public improve-
ments."
Section 11. That Section 2.1 of Chapter VI of the Mount Prospect
Building Code of 1957 be and is hereby amended by adding thereto the
folloVJing:
"(i) When electrical inspection is necessary as provided
for by the Electrical Code adopted by the Village."
Section 12. That Section 42 and 43 of Chapter VI of the
Mount Prospect Building Code of 1957 be and are hereby amended to read
as follows:
"Section 42-43. All electrical installations shall be made in
conformance with the Electrical Code adopted by the Village
of ~lount Prospect."
Section 13. That Section 59 of Chapter VI be and is hereby
repealed and shall be of no force and effect.
Section 14. That Chapter VII entitled "Heating appliances,
boilers, furnaces,fireplaces, chimneys, stacks and fire protection on
same, Chapter VIII entitlted "Types of Construction" of the Mount Prospect
Building Code of 1957 be and is hereby repealed.
Section 15. Pentalty for Violations:
1. Any person who shall violate any provision of this code or
fails to comply with any of the requirements thereof, or who shall erect,
construct,alter or repair a building or structure in violation thereof,
shall be guilty of misdemeanor punishable by a fine of not less than $25-
and not more than $200- each day such violation is permitted to exist shall
constitute a separate offense.
2. The imposition of the penalties herein prescribed shall not
preclude the Village Attorney from instituting an unlawful erection,
construction, reconstruction, alteration, repai~, conversion, ~aintenance
or use or to restrain, correct or abate a violation, or to prevent the
occupancy of a building, structure or premises, or to prevent an illegal
act, conduct, business or use in or about any premises.

Section 16. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
