AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
LOCATED AT 628 BOB-O-LINK
WHEREAS, Joseph C. Garelli (hereinafter referred to as Petitioner)
has filed an application for variations from Chapter 14 of the
Village Code of Mount Prospect, Illinois, for property commonly
known as 628 Bob-O-Link (hereinafter referred to as Subject
Property), legally described as:
Lot 17 in Block 1 in Prospect Meadows, a subdivision of
the west half of the southwest quarter of Section 27,
Township 42 North, Range 11, East of the Third Principal
Meridian, Cook County, Illinois;
and
WHEREAS, Petitioner seeks a variation from Section 14.1102 to allow
a front yard setback of 20 feet, instead of the minimum required 30
feet, in order to allow an existing porch to remain, and a
variation from Section 14.115.A to allow a second driveway to be
added to Forest Avenue; and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 44-V-93 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 24th day of
June, 1993, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 8th day of June, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variations
being the subject of ZBA 44-V-93 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variations.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grants to the Subject Property a variation
from Section 14.1102 to allow a front yard setback of twenty feet
(20') and a variation from Section 14.115.A to allow a second
driveway to be added off Forest Avenue. These variations are
granted subject to the condition that the owner of the Subject
Property, or future owner, shall remove the existing driveway off
Bob-O-Link within five years from the date this Ordinance is
passed, and if a second story is added to the existing house, the
front yard encroachment shall be removed at that time.
SECTION THREE: Except for the variations granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction

begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: The Village Clerk is hereby authorized and directed
to record a certified copy of this Ordinance so that the
requirement to remove the driveway shall be a matter of record to
all subsequent owners of the Subject Property.
SECTION SIX: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
