" AN ORDINANCE GRANTING A SIDE YARD VARIATION SO AS TO PEru~IT THE BUILDING OF SINGLE FAMILY RESIDR~CES WITHIN FIVE FEET OF THE SIDE YARD LINE AS TO PROPERTY LOCATED IN THE VILLAG:E OF' MOUNT PROSPECT WHEREAS, the applicant Pioneer Trust and Savings Bank as Trustee under Trusts Nos. 11093, 11155, 11156 and 11157, re- cord owner of the property hereinafter described, has applied for a side yard variation so as to permit the construction of resi- dences within five feet of the side yard line of the property on which built, and WHEP~S, said residences are to have attached garages which are constructed as an integral part of said sing~e family residences, and WrlEREAS, the Zoning Board of Appeals did conduct a public hearing on said case (Case 62-23) on July 27, 1962; NOW, THEREFORE, BE IT ORDAINED by the President and Board of 'rrustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. 'llhat an ordinance entitled "An ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for speci- fied uses; regulating and limiting the height and bulk of build- ings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and sur- rounding such bui~dings; establishing the boundaries of districts for the said purposes; and prescribing pena~ties for the violation of its provisions," passed and approved December 4, 1923, and amendments thereto, and known as Ordinance No. 52, as amended by an ordinance known and cited as the Zoning Ordinance of Mount Prospect, passed and approved May 2, 1944, and as subsequently amended to date hereof, be varied so as to permit the construc- tion of single family residences with attached garages which form an integral part of said residences to be constructed within five feet of the side yard line, provided, however, that no por- tion of either the residence or the attached garage shall be con- structed closer than five feet from the side yard line on property legally described on the attached sheet hereto attached and made a part hereof. Section 2. That the aforementioned rea~ estate shall be subject to all other conditions and provisions placed upon it by the ordinances of the Village of Mount Prospect. Section 3. That the Building Department of the Village of Mount Prospect is directed to issue building permits for the construction of single family residences with attached garages on the aforementioned property, provided neither the building proper nor the attached garage are closer than five feet from the side yard line and provided all other ordinances of the Village are fully complied with. Section 4. That any person, firm ur corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this or- dinance shall be fined not more than One hundred (*:;100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense.
