ORDINANCE NO.
AN ORDINANCE ANNEXING .PROPERTY REFERRED TO AS
"COLONIAL HEIGHTS" TO THE VILLAGE OF MOUNT .PROSl"ECT
WHEREAS, a written petition has been filed with the Vil-
lage Clerk of the Village of Mount Prospect by Doris W. Scully and
Coleaial Heights, Inc., an Illinois corporation, being the 80le
owners of record of the hereinafter described land and territory
(except the North 50 feet thereof which is the dedicated portion of
Lincoln Road) for anmexation to the Village of Mount Prospect, and
WHEREAS, said petitioners have agreed to dedicate an add-
itional 50 feet adjacent to the dedicated portion of Lincoln Road
so as to make Lincoln Road a full lOO-foot right of way along the
Northerly portion of their property; and
WHEREAS, said land and territory is not within the corpor-
ate limits of any municipality but is contiguous to the Village of
Mount Prospect, is uninhabited and has no electors residing thereon;
and
WHEREAS, said petition 1s under oath and in all respects
complies with the requirements of the statutes in such cases made
and provided, and
WHEREAS, the Village has and does seek to exercise author-
ity under Section 1-1-10 of Chapter 24 of the Illinois Revised
statutes t. annex roadways. The Village of Mount Prospect does
hereby exercise said authority by annexing the Berth 50 feet ef the
hereinafter described property, being the dedioated portion of Lin-
coln Road, in accordance with the provisions of said statutory
authority (said North 50 feet being included in the description
aoted below). and
WHEREAS, the President and Board of Trustees of the Vil-
lage of Mount Prospect have examined said petition, have considered
the questioR of annexation of the territory described therein, and
believe it to be to the best interests of the municipality that
such territory be in fact annexed thereto.
NOW, THEREFORE, BE !T ORDAINED by the President and Board
of Trustees of the Village of Mount Prospect, Cook County, IllinoiS:
Section 1. That all lands and territories described in
said petition, towit:
That part of Lots 2 and 3 taken as a tract in Owner's Division,
, being a Subdivision of the Southeast quarter (except the West half
j of the Southwest quarter thereo~) o~ Section 10, Townahip 41 North,
Range 11 East of the Third Principal Meridian, lying west of and
adjoining the West line of Hatlen Heights Estates Unit No.1, as
registered in the Office of the Registrar of Titles of Cook County,
Illinois, on May 13, 1951 as Document No. 1137169, and lying north
of and adjoining a line 2035.16 feet North of and parallel to the
South line of Lots 6 and 1 in Owner's Division aforesaid; ALSO
That part of Lots 2, 3 and ~ (taken as a tract) in Owner's Divi-
sion (hereinafter described) lying West of and adjoining the West
line of Hatlen Heights Estates Unit No.1, as registered in the
Office of the Registrar of Titles of Cook County, Illinois, on
May 13, 1951, as Document No. 1131169, lying East of and adjoining
a line drawn at right angles to the South line of Lot. 6 and 7 in
Owner's Division aforesaid from a point Sll.5~ feet East of the
Southwest corner or said Lot 7, lying South of and adjoining a
line 2035.16 feet North of and parallel to the South line of said
Lots band 1 and lying North of and adjoining a line described as
follews: Beginning at a point on a line drawn at a right angle
to the South line of said Lot 1 from a point 511.54 feet East of
the Southwest corner of said tot 1, and 1105.16 feet North of the

South line of said Lot 1; thence East parallel to the South line
of said Lots 6 and 1, lQ52.99 feet; thence North 000 31' QO. East
10.11 feet! thence East parallel to the South line of said Lots
6 and 1, 1~6.oo feet to the West line of Hatlen Heights aforesaid,
in Owner's Division, being a Subdivision of the Southeast quarter
(except the West half of the Southwest quarter thereof) of Sec-
tion 10, Township 41 North, Range 11 East of the Third Principal
Meridian; EXCEPTING FROM SAID TRACT that part thereof described
as follows: Beginning at a point on the South line of said tract
119.88 feet East of the Southwest corner of said tract, thence
East along the said South line 158.0 feet, thence North perpen-
dicular to said South line 132.0 feet, thence West parallel to
said South line 158.0 feet, thence South perpendicular to the
last described line 132.0 feet to the point of beginning; ALSO
Lots 1 to 10 inclusive in Colonial Heights Third Addition, being
a Subdivision of part of Lot 4 in Owner's Division, being a Sub-
!division of the Southeast quarter (except the West half of the
Southwest quarter thereof) of Seotion 10, Township 41 North,
Range 11 East of the Third principal Meridian, in cook County,
Illinois, as registered in the Office of the Registrar of Titles
of Cook county, Illinois, on June 26, 1962, as Document No.
2040893 J ALSO
The South 50.0 feet of the Northeast quarter of Section 10, Town-
ship 41 North, Range 11 East of the Third Principal Meridian, ly-
ing East of the West line of Lot 2 in Owners Division, being a
Subdivision of the Southeast quarter (except the West half of the
i Southwest quarter thereof) of Section 10, Township 41 North, Range

11 East of the Third principal Meridian, extended North, lying
West of the West line of Hatlen Heights Estates Unit No.1, as
registered in the Offioe of the Registrar of Titles of Cook county,
Illinois, on May 13, 1956 as Document No. 1131169, extended North;
which territory is contiguQus to the Village of Mount Prospect, is
not within the limits of any municipality, oontains no electors
and is not presently in any inoorporated municipality, be and the
same is hereby annexed to the Village of Mount Pros,ect so that
hereafter said territory shall be included within the boundary
lines and limits of said Village, as is by law in such case made
and provided..

section 2. That the Village Clerk of the Village of
Mount Prospect is hereby directed to reoord a certified copy of
this ordinance together with an accurate plat of saim territory
with the Recorder of Deeds of Cook County, Illinois.
Section 3. That this ordinance shall be in full force
and effect from and after its passage and approval according to law.
