ORDINANCE NO. 869
AN ORDINANCE CREATING THE OFFICES OF VILLAGE COMPTROLLER
AND DIRECTOR OF FINANCE, ESTABLISHING A FINANCE DEPARTMENT
AND AMENDING CERTAIN PROVISIONS OF THE MUNICIPAL CODE
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Mount Prospect, Cook County, Illinois:
Section 1. That the Municipal Code of Mount Prospect is hereby
amended by adding to Chapter 4 thereof the following:
-Article VIII. Village Comptroller.
"Section 4.801. There is hereby created the office of Village
Comptroller who shall be appointed by the President with the advice and
consent of the Board of Trustees. The term of office of said Village
Comptroller shall be indefinite and until a successor is appointed and
confirmed.
"Section 4.802. Duties. The Village Comptroller shall have
such power and duties as are accorded to a comptroller by virtue of the
Illinois Municipal Code and such other power and duties as are assigned
to him by the President and Board of Trustees."
"Section 2. That the Municipal Code of Mount Prospect is hereby
amended by adding to Chapter 4 thereof the following:
"Article IX. Director of Finance.
"Section 4.901. There is hereby created the office of Director
of Finance who shall be appointed by the President with the advice and
consent of the Board of Trustees. The term of office of said Director
of Finance shall be indefinite and until a successor is appointed and
confirmed.
"Section 4.902. Duties. The Director of Finance shall be
the head of the Department of Finance and shall be ex-officio Village
Comptroller. In addition to the duties required by State law, he shall
have the followinp duties, functions and responsibilities:
"(a) Preparation of the tentative annual budget and preparation
of recommended annual appropriation and levy ordinances, in accordance
with the general policy directives issued him by the President and Board
of Trustees. He shall submit the recommended appropriation and levy
ordinances to the Village Attorney for approval as to form. He shall
submit the tentative annual budget to the President, Board of Trustees
and Village Manager by the first Tuesday of March preceding the commence-
ment of the fiscal year for which it is proposed. He shall have access
to all records of any department of the Village for the purpose of
preparing the foregoing.
"(b) Supervision of the Village treasury.
"(c) Maintain all accounting records and reports as to
Village finances in accordance with State law and generally accepted
accounting principles.
"(d) Report periodically on financial matters to the President
and Board of Trustees and Village Manager.

"(e) Establish all procedures relating to the collection,
encumbrance and disbursement of the Village's funds.
"(f) Make recommendations as to the financial condition of
the Village and suggestions as to its improvement.
"(g) Approve all building permits before issuance to insure
the applicant's financial compliance with Village ordinances.
"(h) Maintain an inventory of real and personal property owned
or leased by the Village together with tax exemption records.
"(i) Supervise all other offices of the Village insofar as they
relate to the collection or disbursement of Village funds.
"(j) Perform all duties and responsibilities charged to a
Village Comptroller, including the maintenance of special assessment
accounts and general obligation and revenue bond accounts.
"(k) He shall have all other duties, powers, functions and
responsibilities which are necessary to carry out any of the above
functions and as may from time to time be given him by direction of the
President and Board of Trustees. The Director of Finance, in the
performance of his duties, shall be subject to the supervision, control
and direction of the President and Board of Trustees."
Section 3. That the Municipal Code of Mount Prospect is
hereby amended by adding thereto Chapter 7-A, which shall read as
follows:
"Chapter 7-A. DEPARTMENT OF FINANCE.
"Section 7.101A. There is hereby created and established an
executive department of the Municipal Government of the Village which
shall be known as the Department of Finance and which shall include a
Director of Finance, Village Comptroller, Village Treasurer-Collector
and such other subordinates and assistants as the President and Board
of Trustees may hereinafter provide. The Village Treasurer-Collector,
Comptroller and said subordinates and assistants shall be under the
direction and supervision of the Director of Finance, and shall perform
such duties as shall be prescribed by State law, the Director of Finance
and the President and Board of Trustees."
Section 4. That subparagraphs B, C and D of Section 4.103
of the Municipal Code of Mount Prospect are hereby amended to read
as follows:
"B. Submit recommendations to the President and Board of
Trustees as to expenditures to be considered in the annual budget,
including salary and wage adjustments, capital expenditures, purchase
and contract services to be made in any fiscal year.
"C. Prepare and submit to the Village Board as of the end
of the fiscal year a complete report on the administrative activities
of the Village for the preceding year.
"D. Consolidate or combine offices, positions, departments
or units under his direction with the approval of the President and
Board of Trustees. The Village Manager may be the head of one or more
departments except the Department of Finance."

Section 5. That Section 3.104 and Section 3.105 of the
Municipal Code of Mount Prospect is hereby repealed.
Section 6. That paragraph A of Section 4.l03 of the Municipal
Code of the Village of Mount Prospect be amended to read as follows:
"A. Recommend to the Village President officers of the
village who are required to be appointed. He shall further recommend
the removal or suspension of any such officer to the Village President
when such removal or suspension will be consistent with the best interest
of the Village. All recommendations for appointment or removal shall be
based upon merit and upon qualifications or disqualifications of such
officer without regard to political belief or affiliations. Copies of
said recommendations either for appointment or removal shall be delivered
to Members of the Board of Trustees."
Section 7. Amend paragraph E and I of Section 4.103 to read
as follows:
"E. Recommend to the governing body the salary to be paid each
appointive officer and subordinate employee of the Village.
"I. Purchase of all materials, supplies and equipment, for
which funds are provided in the budget, but he may not purchase any
item which exceeds any budget appropriation until the Village Board has
increased the appropriation; provided that for purchase of more than
$500- he shall be required to receive sealed bids and shall present such
bids to the Village Board for approval or rejection. The Manager shall
advise the Village Board as to whether or not any contract offered is
desirable, or which of several contracts offered is most desirable for
the Village. In case of accidents or other circumstances creating an
emergency, the Village Manager may, with the consent of the Village Board,
award contract and make purchases for the purposes of repairing damages
caused by the said accident or meeting said public emergency; but he
shall file promptly with the Village Board a certificate showing such
emergency and the necessity of such action, together with an itemized
account of all expenditures."
Section 8. Section 4.603 of the Municipal Code of the Village
of Mount Prospect shall be amended by repealing the following language:
"and shall perform such other duties as may be required by
the Village Manager."
Section 9. Section 4.607 of the Municipal Code of the Village
of Mount Prospect is amended to read as follows:
"Section 4.607 Accounting. The Treasurer shall keep such books
and accounts as may be required by statute or ordinance and he shall
keep them in the manner required by law and good accounting principles
and as directed by the Director of Finance."
Section 9-A. That this ordinance shall be in full force and
effect from and after its passage and approval according to law, and all
other ordinances relating to finances in conflict with the above provision
be hereby repealed.
