AN ORDINANCE VARYING THE ZONING ORDINANCE OF
THE VILLAGE OF MOUNT i"ROS.I:'ECT AS IT RELATES
TO PROPERTY AT 100 EAST PROSPECT AVENUE
WHEREAS, the applicant wayne Kruse, record title owner
of the property hereinafter described, has applied for a varia-
tion of the zoning ordinances of Mount Prospect 80 as to permit
the enlargement of a building which is classified as nonconfor.m-
ing property in that, although the property is zoned B-3, Business,
it is also used for residential use, and
WHEREAS, the applicant has stated that the enlargement
of the building on the property hereinafter described is only for
the use of extending his business and tor office space and not
for the purpose of extending the residential use, and
WHEREAS, the Zoning Board of Appeals did conduct a pub-
lic hearing (being case No. 02-13) and did recommend the granting
ot the variation,
NOW, THEREFORE, BE IT ORDAINED \>y the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illin0is:
Section 1. That an ordinance entitled "An ordinance
classifying, regulating and restricting the location of trades
and industries and the location of buildings designed for speci-
fied uses; regulating and limiting the height and bulk of build-
ings hereafter erected or altered, regulating and limiting the
intensity of the use of lot areas and regulating and determining
the area of yardS, oourts and other open spaces within and sur-
rounding such buildings; establishing the boundaries of districts
tor the said purposes; and prescribing penalties for the violation
of its provisions," passed and approved December 4, 1923, and
amendments thereto, and known as Ordinance No. 52, as amended by
an ordinance known and oited as the Zoning Ordinance of Mount
prospect, passed and approved May 2, 1944, and as subse~uently
amended to date hereof, be varied so as to permit the enlargement
of a building located on the property hereinafter described, said
enlargement to be tor business and office use only on property de-
scribed as follows:
Lot 1 and the West 14 feet of Lot 2 (as measured on the North
line thereot); also that part of the West 31 feet of Lot 2 (as
measured on the North line thereot) and that part of Lots 3 and
4, all lying North of a line 102 feet North of and parallel with
the South line of Lot 43, (as measured on the West line thereOf),
together with that part of Lot 43 lying North of a line 102 feet
North of and parallel with the South line of said Lot (as measured
on the West line thereof), all in Waldemar Krause's Addition to
Mt. Prospect in the East halt of the Northwest quarter of Section
12, Township 41 North, Range 11 East of the Third principal Mer-
idian, Cook County, IllinoiS.
Section 2. That the aforementioned real estate shall
be subject to all other oonditions and provisions placed upon it
by the ordinances aforementioned.
Section 3. That any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with or
who resists the enforcement of any of the provisions of this or-
dinance shall be fined not more than One hundred ($lOO) Dollars
for each offense, and each day that a violation is permitted to
exist shall constitute a separate offense.
Section~. That the Building Department of the Village
of Mount Prospect is hereby directed to issue a building permit
in accordance with the foregoing.
Section $. That this ordinance shall be in tull force
and eftect from and after its passage, approval and publication
according to law.
