AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 504 SOUTH MAIN STREET
WHEREAS, John and Margaret Puszka (hereinafter referred to as
Petitioners) have filed an application for a variation from Chapter
14 of the Village Code of Mount Prospect, Illinois, for property
commonly known as 504 South Main Street Lane (hereinafter referred
to as Subject Property), legally described as:
Lot 10 in block 7 in Prospect Park Subdivision Number 1,
being a subdivision of the West Half of the North 60 rods
of the Southwest Quarter of Section 12, Township 41
North, Range 11, East of the Third Principal Meridian, in
Cook County, Illinois
and
WHEREAS, Petitioners seek a variation from Section 14.102.B.1 to
allow a room addition to be located within 6.83 feet of an
accessory structure, rather than the required 10 feet; and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 57-V-93 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 15th day of
July, 1993, pursuant to due and proper notice thereof published in
the Mount Prospect Herald on the 29th day of June, 1993; and
WHERE,, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variation
being the subject of ZBA 57-V-93 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grant to the Subject Property a variation
from Section 14.102.B.1 to allow an 6.83 foot separation between
the principal structure, a room addition, and an accessory
structure, a detached garage, rather than the required 10 feet,
subject to the installation of Class X, fire-rated drywall in the
garage.
SECTION THREE: Except for the variation granted herein, all other
applicable Village of Mount Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604

of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction
begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
