Information
On September 7, 1982, the Village adopted Ordinance No. 3253 establishing a
Special Service Area Number 5. The revenue generated from the Special Service
Area no. 5 funded the infrastructure to bring Lake Michigan water to the Village of
Mount Prospect and also to pay for certain water related infrastructure
improvements in the Village. The original ordinance from 1982 had an end date
for the Special Service Area. The Special Service Area was established with a life
of 35 years, expiring in 2017. The Village acted accordingly and has terminated
the special service area as well as the associated annual levy of $1.5 million. Since
the expiration, the Village has not levied any taxes for the Special Service Area
no. 5.
Though the Special Service Area was terminated by the Village, Cook County still
shows the Special Service Area Levy on the property tax bill with $0. Staff has
asked Cook County multiple times about removing this line from the tax bills, but
due to staff turnover and other issues, the request stayed pending. Finally, Cook
County responded by asking the Village to provide a resolution or an ordinance
officially terminating the Special Service Area. Village staff recommends adopting
the attached ordinance that suffices Cook County's requirement.
This ordinance is submitted as a housekeeping item so property tax bills can stop
showing the Special Service Area no. 5 with $0 tax on the future tax bills.

Alternatives
1. Waive the rules requiring two reading of an ordinance and adopt the
ordinance authorizing the termination Special Service Area Number 5.
2. Action at the discretion of the Village Board.

ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE TERMINATION OF SPECIAL SERVICE AREA
NUMBER 5 IN THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Village of Mount Prospect is a home rule municipality as defined by
Article VII, § 6 of the Illinois Constitution of 1970; and
WHEREAS, special service areas may be established pursuant to Article VII, Sections 6(I)
and 7(6) of the Constitution of the State of Illinois, and pursuant to the provisions of the Special
Service Area Tax Law, 35 ILCS 200/27-5 et seq., as amended from time to time (the "Act") and
pursuant to the Property Tax Code, 35 ILCS 200/1-1 et seq., as amended from time to time; and
WHEREAS, special service areas are established pursuant to the Act and pursuant to the
Property Tax Code (35 ILCS 20011-1 et seq.); and
WHEREAS, on September 7, 1982, pursuant to Ordinance No. 3253, the Village Board of
Trustees enacted an ordinance which established an area known and designated as Special
Service Area Number 5 and by terms of the ordinance, Special Service Area No. 5 was terminated
in 2017 effective for the 2018 tax year.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That Special Service Area 5 of the Village of Mount Prospect is hereby
terminated effective for the 2018 tax year.
SECTION 2: A certified copy of this ordinance shall be filed with the County Clerk of Cook
County, Illinois.
SECTION 3: This Ordinance shall be in full force and effect from and after its passage
approval and publication in pamphlet form in the manner provided by law.
