Meeting April 5, 2023 - REGULAR MEETING OF THE MOUNT PROSPECT VILLAGE BOARD - Fiscal Impact true Dollar Amount $943,437.00 Budget Source Capital Improvements Fund Category VILLAGE MANAGER'S REPORT Type Action Item The Village of Mount Prospect is responsible to maintain several retention basins in the Kensington Business Park. Per an agreement with the business park in the 1980s, Village maintenance includes sediment dredging, slope erosion protection, and outlet structure upkeep. In 2022, the Village Board awarded an engineering contract for design of the Kensington Business Park Pond #1 Dredging Project to Christopher Burke Engineering, Ltd (CBBEL). Pond #1 encompasses an area of approximately 2.5 acres. The 2023 Village Budget has allocated funds for construction of the project. The scope of construction will include pumping water out of the retention basin, loading accumulated sediment, and hauling it to an offsite landfill. The bottom and sides of the retention basin will then be reshaped to conform to the original design. In addition, the contractor will make repairs as necessary to the outlet structures. At project's end, the shoreline will be stabilized with stone and the site restored with grass. Subsequent rainfall will naturally refill the retention basin. The specifications require the contractor to sequester any found fish, amphibians, or turtles found during the dewatering and to either reintroduce them into the pond or relocate. 1 A Notice to Bidders was posted on the Demandstar website and staff contacted local contractors. A bid opening for the project was held on March 27, 2023 at 1:00 p.m. Six (6) contractors submitted a bid. Below is a summary of the bids: Bidder Total Bid Earthwerks $857,670.00 Copenhaver Construction $971,985.00 Misfits Construction $1,198,970.00 Martam Construction $1,325,287.50 Lenny Hoffman Excavating $2,138,158.75 Lakes & Rivers Contracting $2,182,999.00 Engineer's Estimate $996,140.00 All bid submittals were checked for accuracy. The bidders submitted a bid bond in the amount of 10% of their total bids, as required in the bid proposal packet. All required forms were completed and signed. The low bidder, Earthwerks Land Improvement & Development Corporation of Lisle, Illinois, specializes in pond, creek and river restoration. The firm has not performed work for the Village in the past. However, they have extensive experience in pond dredging and restoration including recent work in Chicago, Naperville, Carol Stream, Burr Ridge, Libertyville and Northlake. Earthwerks completed a high profile pond restoration project in 2022 for the Chicago Park District and Chicago Land Conservancy that improved the 10 -acre North Pond near Lincoln Park Zoo. The Village's engineering consultant, CBBEL, provided inspection services for that project and indicated it was completed successfully, on time, and within budget. Earthwerks is prequalified with the Illinois Department of Transportation to bid on earthwork, drainage and landscaping projects. Staff recommends including a 10% contingency in the project award to allow for quantity variances and unanticipated construction conflicts. This results in a total 2 recommended award of $943,437 ($857,670 Total Bid + $85,767 10% Contingency) Alternatives 1. The Village will then issue a written Notice to Proceed, which starts the performance period. The work shall be completed between April 17, 2023 and September 1, 2023. Once work commences, the work must be continuous, to the extent weather allows, and all work (final completion) shall be completed within ten (10) consecutive weeks from date work commences. The Contractor shall achieve substantial performance within ei htj8 consecutive weeks after the Contractor commences work with final performance within two 2 consecutive weeks thereafter. Failure to complete the work in the designated time frame may result in the Director of Public Works withholding compensation due the Contractor for failure to complete the said work in the designated time frame, calling the bonds, or taking such other action as may be available.
