Meeting March 7, 2023 - REGULAR MEETING OF THE MOUNT PROSPECT VILLAGE BOARD - Fiscal Impact true Dollar Amount $5,729,487.94 Budget Source Street Improvement Construction Fund, Motor Fuel Tax Fund, Water and Sewer Fund, and Rebuild Illinois Grant Category VILLAGE MANAGER'S REPORT Type Action Item The purpose of the Village's Street Resurfacing Program is to maintain all Village streets on an average 20 -year service life cycle. To meet this goal, at least 6.84 miles of Village streets must be resurfaced on an annual basis. The 2023 Street Resurfacing Program includes 9.21 miles of streets and is being funded through the Street Improvement Construction Fund, Motor Fuel Tax (MFT) Fund, Rebuild Illinois (RBI) Fund, and Water Main Replacement Fund. Attached are a map and list denoting streets targeted in this year's program. Of the 9.21 miles of streets included in this year's program, 2.46 miles will involve resurfacing the 2022 and 2023 Water Main Replacement streets. In the past, water main replacement projects included the asphalt street resurfacing as part of the contract. In order to reduce the asphalt cost and allow additional water main to be replaced, Village staff has included the street resurfacing portion in this bid. Because of the large amount of asphalt in the street resurfacing contract, the unit price per ton of asphalt with the street resurfacing contract is less expensive than the unit price per ton of asphalt with the water main replacement contract. Once the water main work is complete this summer, Village staff will coordinate to have the street resurfacing contractor install the asphalt soon after. A Notice to Bidders was posted on the Demandstar website on February 1, 2023 and in the IDOT Contractors Bulletin three times on February 2nd, 9th and 16th. Five (5) general contractors obtained the bid documents. Attached is a copy of the bid documents. 1 On February 20, 2023 at 1:00 pm, sealed bids for the 2023 Street Resurfacing Program were publicly opened and read aloud. Two contractors submitted bids for this project. The bids ranged from a low of $5,729,487.94 by Arrow Road Construction Company, to a high of $7,374,000.00 by A Lamp Concrete Contractors, Inc. Below is a summary of the bids: Bidders Total Bid Arrow Road Construction $5,729,487.94 Company A Lamp Concrete $7,374,000.00 Contractors, Inc. Engineer's Estimate $5,504,133.60 All bid submittals were checked for accuracy. All bidders submitted bid bonds in the amount of 5% of their total bids, as required. All bidders correctly signed their bids and bid bonds. Arrow Road Construction's resurfacing bid is $225,354.34 (4.09%) above the Engineer's Estimate. As evident in many sectors, construction prices rose throughout 2022 and the trend continues in 2023. Village staff monitored prices over the past year and anticipated higher material, equipment, and labor costs with this year's project. The Engineer's Estimate was submitted to IDOT in December 2022 and volatility in prices continued to the bid opening date. With this year's bid, there is a 28% increase in the cost of sidewalk removal and replacement, 20% increase in the cost of curb removal and replacement, and 18% increase in the cost of asphalt compared to last year's prices. Village staff reached out to two surrounding communities who recently opened bids for street resurfacing programs to compare prices. The asphalt and concrete prices they received were similar to those received with our project. This year's approximate cost to resurface one mile of roadway is $622,000. For comparison, the cost to resurface one mile of roadway in 2021 and 2022 was $571,000 and $648,000, respectively. The cost to resurface one mile of roadway is lower this year compared to last because less concrete work is anticipated. The low bidder, Arrow Road Construction Co. has previously completed street improvements for the Village, including the 2015 - 2022 Street Resurfacing Programs. The work from Arrow Road Construction Co. has been acceptable. For reference, a copy of Arrow Road's bid submittal is attached. 2 Village staff contacted the three contractors that picked up the bid documents but did not submit a bid. Committed work, scheduling, and high trucking costs were reasons why they did not submit a bid. Village staff does not believe rebidding the project will increase the number of bidders or decrease the prices. Village staff recommends awarding the contract up to the full bid amount to prevent falling behind on the program. The total contract amount would utilize the following funds: Street Improvement Construction $3,200,000.00 + Motor Fuel Tax $903,349.11 + Rebuild Illinois $1,196,650.89 + Water Main Replacement $429,487.94 = Total Recommended Award: $5,729,487.94. Alternatives 1. Accept the lowest cost, responsive bid for the 2023 Street Resurfacing Program. 2. Action at the discretion of the Village Board. Debt Delinquency. The bidder or contractor or subcontractor, respectively, certifies that it is not delinquent in the payment of any tax administered by the Department of Revenue unless the individual or other entity is contesting, in accordance with the procedure established by the appropriate Revenue Act, its liability for the tax or the amount of the tax. Making a false statement voids the contract and allows the Department to recover all amounts paid to the individual or entity under the contract in a civil action. 2. Bid -Rigging or Bid Rotating. The bidder or contractor or subcontractor, respectively, certifies that it is not barred from contracting with the Department by reason of a violation of either 720 ILCS 5/33E-3 or 720 ILCS 5/33E-4. A violation of section 33E-3 would be represented by a conviction of the crime of bid -rigging which, in addition to Class 3 felony sentencing, provides that any person convicted of this offense, or any similar offense of any state or the United States which contains the same elements as this offense shall be barred for 5 years from the date of conviction from contracting with any unit of State or local government. No corporation shall be barred from contracting with any unit of State or local government as a result of a conviction under this Section of any employee or agent of such corporation if the employee so convicted is no longer employed by the corporation: (1) it has been finally adjudicated not guilty or (2) if it demonstrates to the governmental entity with which it seeks to contract that entity finds that the commission of the offense was neither authorized, requested, commanded, nor performed by a director, officer or a high managerial agent on behalf of the corporation.
