These updates were intentionally created to allow for modifications once a business need was identified. Since the adoption of the Ordinance change, Mount Prospect has had business inquiries requesting additional modifications to fit their business plan. Staff supports the requested modifications and the attached Ordinance reflects these modifications. Alternatives 1. Adopt amendments to Chapter 13 of the Village Code "Alcoholic Liquors". 2. Action at the Discretion of the Village Board. Staff Recommendation Staff and the Village Attorney recommends the Village Board approve the ordinance as presented and update Chapter 13 accordingly. The ordinance modifies liquor license classifications to optimize and fit future business plan requests. HOEFERT, LIQUOR COMMISSIONER MICHAEL CASSADY, VILLAGE MANAGER FROM: DOREEN JAROSZ, EXECUTIVE ASSISTANT DATE: FEBRUARY 15, 2023 SUBJECT: REVISIONS TO CHAPTER 13 ALCOHOLIC LIQUORS On January 18, 2022, the Village Board amended Chapter 13 "Alcoholic Liquors" due to State Legislative updates and the need to compete with surrounding suburbs and attract new businesses to the Mount Prospect area. These updates were intentionally created to allow for modifications once a business need was identified. Since the adoption of the Ordinance change, Mount Prospect has had business inquiries requesting additional modifications to fit their business plan. Below is a list of proposed modifications needed to the following classifications. • "Tap Room" Certification available to a Class S-4 license only was created reacting to the market allowing for wine and beer service only. A local distillery in town is proposing to open a second location where alcoholic beverages can be served as well as manufactured. State liquor code also allows for this service. Update Tap Room certification to include alcoholic beverages and allow for a Class S-8 Brewery/Distillery to obtain. • "Wine & Beer" Certification is available to a "Class P" license only. It was created reacting to today's grocery market. This certification allowed for grocers to have a beverage bar where patrons can purchase wine or beer while shopping will be modified to "Alcoholic Beverage" certification. Angelo Caputo grocers located in Addison, Bloomingdale, Naperville, South Elgin, Carol Stream, and Orland Park currently has a beverage counter where wine, beer and cocktails can be purchased while shopping. Additionally, this certification would allow for sampling and educational classes of alcoholic beverages. State liquor code also allows for this service. Update the title change to allow for service of alcoholic beverages. • Class S-2 Bowling Alley License- A state of the art indoor golf simulator experience will open this summer in Randhurst Village. Mount Prospect has no liquor license classification available to them. Their business plan fits the Bowling Alley license. Update the Class S-2 license name to Bowling Alley/Golf Gallery license to allow for this golfing facility. • Class S-4 Gourmet Beverage Shop License allows for service no more than 10 ounces of wine to be sampled during a day. In reaction to the market of wineries in surrounding suburbs, 16 ounces is allowed, in increments of 2 ounce sampling pours. Update sampling size from 10 ounces to 16 ounces. • Class F-8 Brew Pub License currently allows for the sale of growlers and howlers following State regulations. Under State liquor code, a Brew Pub can also sell manufactured packaged beer to go. Update classification to allow for sale of packaged beer as well. 3 In addition to the above modifications Sections 9 and 10 of the Ordinance are being struck due to a codification oversight. This was added to the "Class P" package license in error. 4 ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 13, ALCOHOLIC LIQUORS," OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS: Section 1: Subsection F(1), "Certifications," of Section 13.204.1, "Descriptions and Regulations," of Article II, "Licensing for Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended as follows: C. Taproom certification allowing the licensee for a gottrffiet beterage shop to serve 11'x 4� alcoholic beverages so long that snacks are provided by the licensee, and such certification shall require the payment of an additional annual fee. d 44rte acid beer sere ee Alcoholic beverage certifications are available to grocery stores that hold a P-2, P-3 and P-4 license with such certification requiring12ayment of an additional annual fee, and such certifications shall be governed by the applicable rules set forth by the Village Code and by state guidelines. A sampling endorsement shall be included with the alcoholic beverage certification. (Ord. 6401, 8-21-2018; amd. Ord. 6415, 11-20-2018; Ord. 6493, 12-10-2019; Ord. 6503, 2-4-2020; Ord. 2-1-2022). Section 2: Subsection C(2), `Bowling Alley License," of Section 13.204.1, "Descriptions and Restrictions, "of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended to read: `Bowling Alley/Golf Gallery." Section 3: Subsection C(2), `Bowling Alley/Golf Gallery," of Section 13.204.1, "Descriptions and Restrictions," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended as follows: a. The premises must operate as a bowling alley with full bowling facilities or as a golf gallery facili Section 4: Subsection C(2-1), `Bowling Alley" of Section 13.204.1, "Descriptions and Restrictions," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended to read: "Bowling Alley/Golf Gallery." 545669_1 5 Section 5: Subsection C(2-1), "Bowling Alley/Golf Gallery," of Section 13.204.1 "Descriptions and Restrictions," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended as follows: a. The premises must operate as a bowling alley with full bowling facilities or as a golf gallery facility. b. Alcoholic beverage service must be incidental to bowling or golfing. Section 6: Subsection C(4), "Gourmet Beverage Shop License," of Section 13.204.1, "Descriptions and Regulations," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended as follows: C. Glasses or flights of wine or beer may be served on the licensed premises under the following conditions: (2) No more than 9j sixteen 16) ounces of wine or twenty (20) ounces of beer may be served to any individual during any day. Section 7: Subsection C(8), "Craft Brewery or Distillery License," of Section 13.204.1, "Descriptions and Regulations," of Article II, "Licensing for Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code shall be amended by adding the following: h. A Class S-8 craft brewery or distillery licensee ma3: apply for a taproom certification that will require payment of an additional annual fee, See Appendix II, and allow for the consumption of all alcoholic beverages, including spirits. Section 8: Subsection H(4), "Brewpub License," of Section 13.204.1, "Descriptions and Regulations," of Article II, "Licensing for Regulated Service," of Chapter 13, "Alcoholic Beverages," of the Mount Prospect Village Code shall be stricken in its entirety and replaced with the following: (4) Retail sale of packaged beer in the original packagin�ggs permissible. Section 9: Subsection A(2)(b)(4), "Secondary Package License," of Section 13.204.1, "Descriptions and Restrictions," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code is stricken in its entirety. 545669_1 6 Section 10: Subsection A(2)(c)(3), "Secondary Package License," of Section 13.204.1, "Descriptions and Restrictions," of Article II, "Licensing For Regulated Service," of Chapter 13, "Alcoholic Liquors," of the Mount Prospect Village Code is stricken in its entirety.
