The proposed 938 -square -foot business establishment will offer therapeutic massage services in various styles with the option of hot stones and herbal compresses. The proposed hours of operation are 10 AM to 10 PM Monday through Sunday. The petitioners indicated that services are provided by appointment only, and they would have a maximum of five clients and five therapists on the premises at any time. The petitioners are preparing plans for building permit submission for interior renovations including division of the suite into four massage rooms and a laundry room with a washer and dryer. The subject property, zoned B-4 Corridor Commercial, is a multi -tenant office condominium building with a mixture of professional and medical office uses. The associated parking lot has ample parking for the office tenants and their clients. Village staff has reviewed the petitioner's request and finds that it meets the standards for a conditional use. A building permit will be required for any proposed renovations. The Police Department confirmed that the petitioner has 1 met all ordinance standards to operate a massage establishment. The Planning and Zoning Commission held a public hearing on January 26, 2023 to review the request. A board member of the office condominium association attended the hearing to correct the parking analysis, stating that there is only one reserved parking spot for Suite 12, not three as stated in the staff report. The board member also requested information about the proposed water consumption for the massage establishment. The petitioners answered that they plan to use the on site laundry facility for roughly five loads of laundry per day, and stated that no showers would be on site. After considering all facts presented, the commission recommended approval of the conditional use by a 5-0 vote. The petitioners have submitted a letter requesting to waive the 2nd reading. Alternatives 1. Approval of a conditional use permit to operate a massage therapy establishment at 834 East Rand Road Suite 12, subject to the following conditions: a. All massage therapists employed at the business establishment shall hold a valid massage therapist license with the State of Illinois; and b. Compliance with all applicable Village Code requirements, including but not limited to, fire code and building regulations. 2. Action at the discretion of the Village Board. Massage therapy businesses require conditional use approval to operate. The subject property is zoned B-4 Corridor Commercial Planned Unit Development (PUD). Unit 12 is currently owned and occupied by American Taxi Dispatch Inc. The petitioners have operated a massage therapy business in Skokie since 2017 and would like to open a second location at the subject property. PROPOSAL The petitioners propose to operate a 938 -square -foot massage therapy establishment at the subject property, offering therapeutic massage services in various styles with the option of hot stones and herbal compresses. The petitioners each hold a massage therapy license from the State of Illinois and intend to hire additional licensed therapists once the new business location is established. The proposed hours of operation are 10 AM to 10 PM Monday through Sunday. The petitioners indicated that services are provided by appointment only, and they would have a maximum of five clients and five therapists on the premises at any time. The petitioners noted that the majority of their clients are healthcare workers. The petitioners are preparing plans for building permit submission for interior renovations including division of the suite into four massage rooms and a laundry room with a washer and dryer. The petitioners indicated that they would like to install a new sign; no other exterior renovations or parking lot alterations are proposed. The subject property is zoned B-4 Corridor Commercial Planned Unit Development (PUD). The subject property is a collection of office condominiums with adequate parking. The business is by appointment only and the petitioners expect to have up to ten persons on the premises at any time. The petitioners noted in their application that the parking lot has three parking spots reserved for their suite. The petitioners submitted a business license application and a massage therapy addendum according to the requirements of Village Code Chapter 11, Article 39 for Massage Establishments. COMPREHENSIVE PLAN DESIGNATION The Village Comprehensive Plan designates the subject property as corridor commercial. The proposed conditional use is consistent with the Comprehensive Plan's corridor commercial secondary uses including medical, entertainment, hotel, and office uses. CONDITIONAL USE STANDARDS The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and include seven specific findings that must be made in order to approve a conditional use. The following list is a summary of these findings: • The conditional use will not have a detrimental impact on the public health, safety, morals, comfort or general welfare; • The conditional use will not be injurious to the use, enjoyment, or value of other properties in the vicinity or impede the orderly development of those properties; • There is adequate provision for utilities, drainage, and design of access and egress to minimize congestion on Village streets; and • The request is in compliance of the conditional use with the provisions of the Comprehensive Plan, Zoning Code, and other Village ordinances. The petitioners indicate in their business description that their current location in Skokie has excellent reviews on Google, Yelp, and Groupon. The petitioners state that their business operations are confined to the unit and they will operate respectfully with all other businesses. The petitioners noted they will follow guidance to minimize traffic congestion on public streets. Village staff has reviewed the petitioners' request and finds that it meets the standards for a conditional use. A building permit will be required for the proposed renovations, and a sign permit may be required depending on the final design of the sign. The Police Department confirmed that the petitioners have met all ordinance standards to operate a massage establishment. As of the writing of this report, staff has not received public comments pertaining to this request. Staff finds that the conditional use complies with the standards as listed in the Village Zoning Ordinance and that granting such a request would be in the best interest of the Village. Staff recommends that the Planning & Zoning Commission make a motion to adopt staff's findings as the findings of the Planning & Zoning Commission and recommends approval of the following motion: 1. "A conditional use permit to operate a massage therapy establishment at 834 East Rand Road Suite 12, subject to the following conditions: a. All massage therapists employed at the business establishment shall hold a valid massage therapist license with the State of Illinois; and b. Compliance with all applicable Village Code requirements, including but not limited to, fire code and building regulations." The Village Board's decision is final for this case. Commissioner Miller made a motion seconded by Commissioner Szymczak to approve the minutes from the Planning and Zoning Commission meeting on December 8, 2022. The minutes were approved 5-0. Chairman Donnelly introduced case PZ -25-22, 834 East Rand Road Suite 12, a request for a conditional use permit to operate a massage therapy establishment at the subject property. The Village Board's decision is final for this case. Ms. Choi introduced the case and explained that the subject property is a multi -tenant office condominium building with a mixture of professional and medical office uses. She noted that Suite 12 is currently owned and occupied by American Taxi Dispatch Inc. Ms. Choi stated that adequate parking is available at the subject property. She reported that the proposed business is by appointment only and the petitioners expect to have up to ten persons on the premises at any time. Ms. Choi reported that the petitioners' application indicates three parking spots reserved for their suite. She described the petitioners' proposal to operate a 938 -square -foot massage therapy establishment offering therapeutic massage services in various styles with the option of hot stones and herbal compresses. Ms. Choi stated that the proposed hours of operation are 10 AM to 10 PM Monday through Sunday. She described the Planning & Zoning Commission Meeting — January 26, 2023 PZ -25-22 32 planned interior renovations including the division of the suite into four massage rooms and a laundry room with a washer and dryer. Ms. Choi noted that the petitioners submitted a business license application and a massage therapy addendum according to the requirements of Village Code, and that the Police Department confirmed that the petitioners have met all ordinance standards. Ms. Choi reported that staff found that the proposal meets the conditional use standards and that staff is supportive of the request. Ms. Choi recommended approval of the following motion: "A conditional use permit to operate a massage therapy establishment at 834 East Rand Road Suite 12, subject to the following conditions: 1. All massage therapists employed at the business establishment shall hold a valid massage therapist license with the State of Illinois; and 2. Compliance with all applicable Village Code requirements, including but not limited to, fire code and building regulations." Ms. Choi stated that the Village Board's decision is final for this case. Chairman Donnelly swore in the petitioners, Tsengelmaa Navaandorj and Altantsetseg Choijiljav, of 834 East Rand Road Suite 12. Ms. Navaandorj explained that their first massage business location opened in 2014 in Skokie at the yellow line station. She stated that the business is successful and has good reviews on Yelp and Google. Chairman Donnelly swore in Mariusz Folta, of 832 East Rand Road Suite 18. He stated that he owns a neighboring business and is a member of the Board of Directors of the office condominium association. Mr. Folta explained that there is only one reserved parking space per unit, so the proposed business will have only one reserved parking space, not three. He noted that the parking lot is large so there will not be any issues with the parking. Chairman Donnelly asked why American Taxi Dispatch had more parking spots. Mr. Folta replied that American Taxi Dispatch has more parking spots because they occupy multiple units. He asked if the petitioner will be using water for their services. Chairman Donnelly stated that their application included a laundry facility on site and asked if there is an issue with using the water. Mr. Folta explained that the water is included in the assessment so he would like to know if there will be excessive water usage by the petitioner. Ms. Navaandorj returned to the podium to respond. She stated the business does at least five loads of laundry per day. Ms. Navaandorj noted that they are still discussing whether to establish a laundry at the subject property or take the laundry to their other location. Chairman Donnelly asked if there will be showers at the subject property. Ms. Navaandorj replied there would be no showers, only laundry. Planning & Zoning Commission Meeting — January 26, 2023 PZ -25-22 33 Hearing no further comments or questions, Chairman Donnelly closed the hearing and asked for a motion. Commissioner Weir made a motion seconded by Commissioner Fitzgerald to approve the following motion: "A conditional use permit to operate a massage therapy establishment at 834 East Rand Road Suite 12, subject to the following conditions: 1. All massage therapists employed at the business establishment shall hold a valid massage therapist license with the State of Illinois; and 2.
