AN ORDINANCE AMENDING CHAPTER 14 "ZONING" OF THE VILLAGE CODE
OF MOUNT PROSPECT ILLINOIS
WHEREAS, the Village of Mount Prospect is a home rule municipality as defined by
Article VII, § 6 of the Illinois Constitution of 1970; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect desire
to make certain amendments to the Village Code of Mount Prospect as set forth below; and
WHEREAS, pursuant to the authority granted under the Illinois Municipal Code and in
accordance with home rule authority granted to home rule municipalities, the President and
Board of Trustees of the Village of Mount Prospect approve the amendments as set forth below.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: "Encroachments Permitted in Required Yards as Determined by the
Building Setback Line" of Subsection A of Section 14.319, "Permitted Obstructions," of Article
III, "General Provisions," to Chapter 14, "Zoning" to the Mount Prospect Village Code shall be
amended to read:
Unenclosed porches, not to encroach more than seven (7') P
into the required setback, excluding steps
SECTION 2: Land Use Table 1: "Residential and Recreational Zoning Districts," of
Section 14.604, "Land Use Tables," of Article VI, "Zoning Districts," to Chapter 14, "Zoning,"
to the Mount Prospect Village Code shall be amended to remove the following row:

SECTION 5: Land Use Table 2: "Commercial and Industrial Zoning Districts," of
Section 14.604, "Land Use Tables," of Article VI, "Zoning Districts," to Chapter 14, "Zoning,"
to the Mount Prospect Village Code shall be amended to add the following rows in the
appropriate alphabetical location:
SECTION 6: Section 14.2401, "Purpose," of Article XXIV, "Definitions," to Chapter
14, "Zoning," to the Mount Prospect Village Code shall be amended to remove the definitions of
"TOBACCO/VAPE LOUNGE" and "TOBACCO/VAPE SHOP"
SECTION 7: Section 14.2401, "Purpose," of Article XXIV, "Definitions," to Chapter
14, "Zoning," to the Mount Prospect Village Code shall be amended to include the following
definitions in the appropriate alphabetical locations:

TOBACCO LOUNGE: An establishment where patrons consume tobacco or alternative
nicotine products by using combustible tobacco products such as cigarettes, cigars, pipes,
and hookah / shisha.
TOBACCO SHOP: A retail establishment which offers the sale or distribution of
combustible tobacco products (cigarettes, cigars, pipe tobacco, hookah / shisha),
smokeless tobacco products, and dissolvable tobacco products.
VAPE LOUNGE: An establishment where patrons consume tobacco or alternative
nicotine products by utilizing vapes, vaporizers, vape pens, hookah pens, electronic
cigarettes (e -cigarettes or e-cigs), e -cigars, a -pipes and other electronic nicotine delivery
systems (ENDS).
VAPE SHOP: A retail establishment which offers the sale or distribution of vapes,
vaporizers, vape pens, hookah pens, electronic cigarettes (e -cigarettes or e-cigs), e -cigars,
e -pipes and other electronic nicotine delivery systems (ENDS). These products use an "e -
liquid" that may contain nicotine derived from tobacco, as well as flavorings, propylene
glycol, vegetable glycerin, and other ingredients. The liquid is heated to create an aerosol
that the user inhales.
SECT .C: N Sa Section 14.2401, "Purpose," of Article XXIV, "Definitions," to Chapter
14, "Zoning," to the Mount Prospect Village Code shall be amended to replace the current
definition of "EXTERIOR SIDE" and "REAR YARD" under "YARD" with the following
definitions:
YARD: The required minimum open space on a lot between a lot line and building
setback line which is unoccupied and unobstructed from grade upward, except as
provided in the general provisions of this chapter.
Exterior Side: A side yard abutting a street that extends to the rear lot line rather
than the rear setback line.
Front: A yard extending along the full width of the front lot line between the side
lot lines and the front building setback line.
Interior Side: A side yard adjacent to another lot or tract of land.
Rear: A yard extending along the full width of the rear lot line between the side
lot lines and the rear building setback line for typical interior lots, or, in the case
of a corner lot, a yard extending along the rear lot line between the side lot line
and the exterior side building setback line.
Side: A yard extending along the side lot line from the front yard to the rear yard
and measured between the side lot and building setback line of the property.

SECTION 9: Section 14.2401, "Purpose," of Article XXIV, "Definitions," to Chapter
14, "Zoning," to the Mount Prospect Village Code shall be amended to delete the current
definition of "EXTERIOR SIDE" and "REAR YARD" under "YARD" and replace with the
following definitions:
SECTION 10: "Required Yards Illustrated" of Subsection B of Section 14.2501,
"Illustrations," of Article XXV, "Appendix of Illustrations," to Chapter 14, "Zoning," to the
Mount Prospect Village Code shall be amended to delete the current graphic and replaced with
the following graphic:
SECTION 11: "Transitional Yards" of Subsection C of Section 14.2501, "Illustrations,"
of Article XXV, "Appendix of Illustrations," to Chapter 14, "Zoning," to the Mount Prospect
Village Code shall be amended to delete the current graphic and replaced with the following

SECTION 12: "Lot Types" of Subsection D of Section 14.250 1, "Illustrations," of Article
XXV, "Appendix of Illustrations," to Chapter 14, "Zoning," to the Mount Prospect Village Code
shall be amended to delete the current graphics and replaced with the following graphics:

SECTION 13: This Ordinance shall be in full force and effect from and after its approval,
adoption and publication in the manner provided by law.
