MAYOR'S REPORT
PROCLAMATIONS: Mayor Farley proclaimed the week of September 19 -
ART WEEK 25, 1993 as Illinois Art Week,
CHAMBER WEEK Mayor Farley also proclaimed the week of September
26 through October 2, 1993 as Mount Prospect
Chamber of Commerce Week.
AMEND CH. 13 /Mn Ordinance was presented for first reading that
would amend Chapter 13 by deleting the Class "A"
liquor license issued to Midwest Liquors doing
business as VIP Lounge and Ben's Cut Rate Liquors.
Both of these establishments have gone out of
business.
Trustee Wilks, seconded by Trustee Hoefert, moved
to waive the rule requiring two readings of an
Ordinance.

TRUSTEE COMMENTS
RECONSIDERATION: Trustee Corcoran, who was absent from the last
BURY UTILITY meeting of the Village Board, stated that he would
LINES-POLICE/FIRE like the Board to reconsider the action taken
BUILDING relative to burying the utility lines located at
the rear of the new Police and Fire Headquarters
Building, which action was to deny the request.
Trustee Corcoran stated that burying the utility
lines would give better security to the building
from either vandals or electric storms. He also
stated that the Village will be requiring
developers to bury utility lines and the Village
should conform to regulations imposed on others.
Trustee Corcoran, seconded by Trustee Skowron,
moved to reconsider the subject of burying the
utility lines.

Motion carried.
Trustee Hoefert stated that since it appears there
will be a budget deficit, the funds proposed to be
used for this project would better be used in other

areas. He also suggested that security won't be a
factor, since vandals could cause damage to lines
a half a block away, which lines remain above ground.
TTUstee Corcoran, seconded by Trustee Wilks, moved BURY UTILITY
to authorize the administration to negotiate with LINES
Kendon Electric, the only contractor to bid on this
project at $43,550, in an effort to reduce the cost
with the possibility of having this project done in
the spring; the results of the negotiations will be
brought back to the Village Board for final
decision on this project.

OLD BUSINESS
ZBA 58-V-93, 423 South Pine Street ZBA 58-v-93
/Ln Ordinance was presented for second reading that 423 S. PINE
would grant a variation to allow a six foot service
walk to encroach into the side yard. The Zoning
Board of Appeals recommended granting this
variation by a vote of 6-1.
Trustee Wilks, seconded by Trustee Hoefert, moved ORD.NO. 4583
for passage of Ordinance No. 4583
AN ORDINANCE GRANTING A VARIATION FOR
PROPERTY LOCATED AT 423 SOUTH PINE STREET

An Ordinance was presented for first reading that AMEND CH. 18
authorize the installation of STOP signs as TRAFFIC CODE
follows: northbound on Douglas Avenue at Lincoln
Street; northbound on Craig Court at Lincoln Street;
and, southbound on Leonard Lane at Lincoln Street
and reduce the speed limit within the Brentwood
Subdivision from 30 MPH to 25 MPH.
The Safety Commission recommended these amendments
to Chapter 18 by a vote of 8-0.
Trustee Hoefert, seconded by Trustee Wilks, moved
to waive the rule requiring two readings of an
Ordinance.

Another recommendation of the Safety Commission LIONS PARK

dealt with traffic safety around Lions Park School.
Discussion of this subject was remanded back to the
Safety Commission in order to determine if the
District 57 School Board and/or Lions Park School
officials had been involved in these
recommendations.
It was determined that the Lions Park School Safety
Committee had brought these recommendations to the
Village, therefore it would be appropriate for the
Village Board to consider these recommendations to:
Prohibit stopping, standing or parking on
Council Trail, north and south side of the
street, between Elm and School Streets;
Establish a school bus loading/unloading zone
on Council Trail between Elm and School
Streets; and
Prohibit northbound traffic on School Street,
between Council Trail and Sha Bonee Trail,
between the hours of 8:30 AM and 9:15 AM and
between 3:00 PM and 3:35 PM
/Ln Ordinance was presented for first reading
reflecting the above stated amendments to the
Traffic Code, Chapter 18.
Susan Ellen, representing Lions Park School, spoke
in support of the recommended amendments.
Trustee Wilks, seconded by Trustee Hoefert, moved
to waive the rule requiring two 'readings of an
Ordinance.

AN ORDINANCE AMENDING CHAPTER 18 (TRAFFIC
CODE) OF THE VILLAGE CODE

NEW BUSINESS
ZBA 62-V-93 ZBA 62-V-93, 950 N.Elmhurst Rd/150 W. Rand Rd.
950 N.ELMHURST RD/ The Petitioner is requesting a variation to
150 W. RAND RD allow 109 parking spaces, rather than the
minimum 132 required, for this office building. The
Zoning Board of Appeals recommended granting this
request by a vote of 6-0.
It was noted that the Petitioner is taking over the
entire building, which is surrounded by roadways,
Mc Donald's and single family and is unable to
provide the required spaces.

Trustee Clowes, seconded by Trustee Hoefert, moved
to concur with the recommendation of the Zoning
Board of Appeals and grant the variation requested
in ZBA 62-V-93.

ZBA 63-V-93, 300 South George Street ZBA 63-V-93
The Petitioner is requesting a variation to allow 300 S. GEORGE ST
a driveway width of 21 feet, rather than the
maximum of 15 feet permitted for a one-car
garage. The Zoning Board of Appeals recommended
granting this request by a vote of 6-0.
Trustee Wilks, seconded by Trustee Corcoran, moved
to concur with the recommendation of the
Zoning Board of Appeals and grant the variation
requested in ZBA 63-V-93.

ZBA 66-SU-93, 740 E. Rand Road (Courtesy Home Center
The Petitioner, Menards, is requesting an amendment
to the Planned Unit Development governing this property,
which amendment would delete the authorized self-storage
facility and permit an enclosure for outside storage
of building materials as an accessory use for Menard's
Home Improvement Center. The subject property is
currently occupied and owned by Courtesy Home Center.
The Zoning Board of Appeals recommended granting the
request by a vote of 6-0.
It was noted that the proposal includes outside storage
of building materials on wall-like shelving racks which
would surround the outside area in the form of a fence.
The.original proposal was for this wall to be 14 feet
in height, however, the proposal was amended at the
Zoning Board of Appeals to 10 feet at the property
line abutting single family homes.
Richard Benson, 220 Autumn Lane and President of the
Harvest Heights Homeowners Association presented a
Petition in opposition to the proposal. Some of the
concerns expressed by residents included:
Truck traffic and the fact that trucks leave
their motors running at all hours;
Lighting;
Landscaping at rear of property;
Garbage and hours of garbage pick-up; and
Setback of fence

Gary Colby, representing Menard's, stated that the
outside storage area will have gates and will be
accessible for deliveries only during hours of
operation; the height of the light poles would be
such as to eliminate any glare into the single
family home area; there would be security lighting
within the outside storage area; Menard's would
install the landscaping abutting the single family
homes and the home owners would agree to maintain
the landscaping; the garbage area will be located
within the security area therefore prohibiting
garbage pick-up until the gates are open, and will
also prohibit 'fly dumping'.
There was considerable discussion on the subject of
the setback at the rear of the building, between
'the commercial property and the single family lots,
noting that the distance between the rear of the
building and the lot line was not available, which
was important due to the required area for
emergency vehicle access. Based on that
information the setback could be 7 feet for the
entire length of the rear property line or 5 feet
behind the building and 10 feet for the balance of
the area.

Trustee Wilks, seconded by Trustee Clowes, moved to
concur with the recommendation of the Zoning Board
of Appeals and grant the request in ZBA 66-SU-93,
with the setback for the fence along the rear
property line to be determined by staff and to be
set forth in the Ordinance.

An Ordinance will be presented for first reading
at the September 21st meeting of the Village Board.
AMEND CH. 14 An Ordinance was presented for first reading that
ZONING would amend Chapter 14 "Zoning" in its entirety.
It was the recommendation of the Mayor that Article
XVII of the proposed Ordinance be amended to delete
"Physical culture, massage or tattoo parlor" as a
condition use. It was also recommended by Trustee
Hoefert the definition of "hardship" be included in
the text, however the word "physical" should be
deleted for clarity.
Members of the Village Board agreed with the
proposed amendments to the proposed Chapter 14.
This Ordinance, as amended, will be presented
September 21st for second reading.

An Ordinance was presented for first reading that APrEND CH. 15
would amend Chapter 15, Landscaping Requirements",
in its entirety by deleting it from the Village
Code, since the text will be included in the
new Chapter 14 "Zoning".
This Ordinance will be presented September 21st
for 2nd reading.
An Ordinance was presented for first reading that SELL VEHICLES
would authorize the sale of specified vehicles
through the Northwest Municipal Conference auction.
Ordinance No. 4580 authorized the sale of these
vehicles at the auction on October 9th, however,
the Northwest Municipal Conference has changed the
date from the 9th to the 23rd of October.

Ordinance.

an appeal from the revocation of a business

of the administration to accept the low qualified
bid submitted by Berthold Nursery for $16,978.90,
which includes 3 waterings and mulching.
