Information
The petitioner (PCRK IL Mt Prospect - Randhurst 1071 LLC) operates a "Massage
Envy" at Randhurst Village Shopping Center and is proposing to move to a newly
divided space at Mount Prospect Plaza (1212 East Central Avenue, Suite A).
Massage therapy licenses are non -transferable, and therefore the business must
obtain conditional use approval to move to a new location within the Village. The
petitioner will operate a 2,482 -square -foot "Massage Envy" establishment offering
various massage and skin care services. The new location will have 18 employees,
10 of whom hold state licensure for massage therapy. The proposed tenant
buildout includes 10 therapy rooms, restrooms, an employee lounge, an office, a
laundry room, and a reception area. Adequate parking is available; for a shopping
center of this size, Village code requires 911 parking spaces, and 1,321 spaces are
provided. Village staff has reviewed the petitioner's request and finds that it meets
the standards for a conditional use. A building permit will be required for any
proposed renovations. The Police Department confirmed that the petitioner has
met all ordinance standards to operate a massage establishment.
The Planning and Zoning Commission held a public hearing on December 8th to
review the request. No public comment was received before or during the hearing
on this matter. After considering all facts presented, the commission

recommended approval of the conditional use by a 5-0 vote.
Alternatives
1. Approval of a conditional use permit to operate a massage therapy
establishment at 1212 East Central Avenue, Suite A (1028 Mt Prospect Plaza
A-110) subject to the following condition:
a. Compliance with all applicable Village Code requirements, including but
not limited to, fire code and building regulations.
2. Action at the discretion of the Village Board.

BACKGROUND/PROPERTY HISTORY
The subject property is a shopping center with a mixture of retail, restaurant, banking, and personal
services. A vacant tenant space at the shopping center (1212 East Central Avenue) is being demised into two
tenant spaces which will have the address 1212 East Central Avenue, Suite A and Suite B. The petitioner is
proposing to relocate from their existing space at Randhurst Village Shopping Center to the newly demised
space at 1212 East Central Avenue, Suite A. Massage therapy licenses are non -transferable, and therefore
the business must obtain conditional use approval to move to a new location within the Village.
PROPOSAL
The petitioner proposes to operate a 2,482 -square -foot massage therapy establishment at the subject
property, offering various massage and skin care services. The location will have 18 employees, 10 of whom
hold state licensure for massage therapy. Hours of operation will be 8 AM — 9 PM Monday through Friday, 8
AM — 7 PM Saturday, and 9 AM — 6 PM Sunday. The petitioner has submitted to the Village a business
license application and a massage therapy addendum according to the requirements of Village Code
Chapter 11, Article 39 for Massage Establishments.
The landlord has applied for a building permit to demise the tenant space, which will include a new doorway
and replacement of two rooftop units for Suite A, and a new rooftop unit for Suite B. The proposed tenant
buildout includes 10 therapy rooms, restrooms, an employee lounge, an office, a laundry room, and a
reception area. Adequate parking is available; for a shopping center of this size, Village code requires 911
parking spaces, and 1,321 spaces are provided.
COMPREHENSIVE PLAN DESIGNATION
The Village Comprehensive Plan designates the subject property as corridor commercial. The proposed
conditional use is consistent with the Comprehensive Plan's vision for this area to have large format retail,
restaurants, and other commercial uses.
CONDITIONAL USE STANDARDS
The standards for conditional uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance and
include seven specific findings that must be made in order to approve a conditional use. The following list is
a summary of these findings:
• The conditional use will not have a detrimental impact on the public health, safety, morals, comfort
or general welfare;
• The conditional use will not be injurious to the use, enjoyment, or value of other properties in the
vicinity or impede the orderly development of those properties;
• There is adequate provision for utilities, drainage, and design of access and egress to minimize
congestion on Village streets; and
• The request is in compliance of the conditional use with the provisions of the Comprehensive Plan,
Zoning Code, and other Village ordinances.
The petitioner stated that all of their massage therapists are licensed and that their business will
complement the other businesses in the area by promoting health, stress relief, and overall well-being. The
petitioner contends that the site has adequate public utilities, access roads, and drainage and that the
property owners have taken measures to provide adequate ingress and egress to minimize traffic

congestion. Finally, the petitioner notes that their business will conform to all zoning regulations and the
use is not contrary to the Village's Comprehensive Plan.
Village staff has reviewed the petitioner's request and finds that it meets the standards for a conditional
use. A building permit will be required for any proposed renovations. The Police Department confirmed that
the petitioner has met all ordinance standards to operate a massage establishment.
Staff finds that the conditional use complies with the standards as listed in the Village Zoning Ordinance and
that granting such a request would be in the best interest of the Village. Staff recommends that the Planning &
Zoning Commission make a motion to adopt staff's findings as the findings of the Planning & Zoning
Commission and recommends approval of the following motion:
"A conditional use permit to operate a massage therapy establishment at 1212 East Central
Avenue, Suite A (1028 Mt Prospect Plz Suite A-110) subject to the following condition:
Compliance with all applicable Village Code requirements, including but not limited to, fire
code and building regulations."
The Village Board's decision is final for this case.

Chairman Donnelly called the meeting to order at 7:01 PM. Commissioner Beattie made a motion
seconded by Commissioner Mizwicki to approve the minutes from the Planning and Zoning Commission
meeting on September 8, 2022. The minutes were approved 5-0.
Chairman Donnelly introduced case PZ -24-22, 1212 East Central Road Suite A, a request for a conditional
use permit to operate a massage therapy establishment at the subject property.
Ms. Lalagos described the subject property as a shopping center with a mixture of retail, restaurant,
banking, and personal services, and stated that the petitioner, Massage Envy, is proposing to locate on the
south side of the shopping center, along Central Road. She reported that adequate parking is available,
and noted that for a shopping center of this size, Village code requires 911 parking spaces, whereas 1,321
spaces are provided. Ms. Lalagos explained that a vacant tenant space at the shopping center is being
divided into two tenant spaces which will have the address 1212 East Central Avenue, Suite A and Suite B.
She reported that the petitioner is proposing to relocate from their existing space at Randhurst Village
Shopping Center to the newly divided space at 1212 East Central Avenue, Suite A. Ms. Lalagos explained
that massage therapy licenses are non -transferable, and therefore the business must obtain conditional
use approval to move to a new location within the Village. She reviewed the petitioner's proposal to

operate a 2,482 -square -foot massage therapy establishment at the subject property, offering various
massage and skin care services. Ms. Lalagos stated that the location will have 18 employees, 10 of whom
hold state licensure for massage therapy, and noted the hours of operation. She described the proposed
tenant buildout which includes 10 therapy rooms, restrooms, an employee lounge, an office, a laundry
room, and a reception area. Ms. Lalagos reported that the petitioner submitted a business license
application and a massage therapy addendum and the Police Department confirmed that the petitioner
has met all ordinance standards.
Ms. Lalagos stated that staff found that the proposal meets the conditional use standards and
recommends approval of the following motion:
"A conditional use permit to operate a massage therapy establishment at 1212 East Central Avenue, Suite
A (1028 Mt Prospect PIZ Suite A-110) subject to the following condition:
a) Compliance with all applicable Village Code requirements, including but not limited to, fire code
and building regulations."
Ms. Lalagos stated that the Village Board's decision is final for this case.
Chairman Donnelly swore in a representative for the petitioner, Renee Busch, the general manager at the
Massage Envy location at 1052 Center Drive in Mount Prospect. Ms. Busch stated that Massage Envy has
been at the Randhurst Village location since 2014, and they are seeking a new space with more traffic and
more growth. She indicated that the business provides massage therapy and limited skin care services.
Hearing no further comments or questions, Chairman Donnelly closed the hearing and asked for a motion.
Commissioner Beattie made a motion seconded by Commissioner Weir to approve the following motion:
"A conditional use permit to operate a massage therapy establishment at 1212 East Central Avenue, Suite
A (1028 Mt Prospect PIZ Suite A-110) subject to the following condition:
a) Compliance with all applicable Village Code requirements, including but not limited to, fire code
and building regulations."
UPON ROLL CALL AYES: Szymczak, Weir, Mizwicki, Beattie, Donnelly
NAYS: None
The motion was approved by a vote of 5-0, with a positive recommendation to the Village Board for the
scheduled meeting on December 20, 2022.
After hearing three more cases, and seeing no citizens to be heard for non -agenda items, Commissioner
Beattie made a motion seconded by Commissioner Mizwicki and the meeting was adjourned at 8:35 PM.

Conditional Use —
1. The Massage Therapy Establishment will not be a detriment to, or endanger the public health,
safety, morals comfort, or general welfare because all therapists are licensed and professionally
regulated.
2. The Massage Therapy Establishment will not be injurious to the uses and enjoyment of other
property in the immediate vicinity for the purposes already permitted, nor substantially diminish
and impair property values within the neighborhood in which it is to be located. We feel our
business will compliment all other businesses in the area as we promote health, stress relief and
overall well-being.
3. The Massage Therapy Establishment will not impede the normal and orderly development and
improvement of the surrounding property for uses permitted in the district. Our focus is on
providing a calm and relaxed environment.
4. The Massage Therapy Establishment has adequate public utilities, access roads, drainage and or
necessary facilities as the property is currently being served by public water, electric, telephone,
gas, sanitary sewer and storm water drainage. No changes are proposed.

WHEREAS, the Petitioner proposes to move an established massage therapy establishment to a divided space at Mount
Prospect Plaza (1212 East Central Avenue, Suite A);
WHEREAS, a Public Hearing was held on the request for a Conditional Use permit being the subject of PZ -24-22 before the
Planning and Zoning Commission of the Village of Mount Prospect on the 8t" day of December, 2022, pursuant to proper legal
notice having been published in the Daily Herald Newspaper on the 23rd day of November, 2022; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the President and Board
of Trustees in support of the request being the subject of PZ -24-22; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request
herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional

Use permit would be in the best interest of the Village
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board
of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect grant a Conditional Use permit to
operate a massage therapy establishment subject to the following condition:
1. "Compliance with all applicable Village Code requirements, including but not limited to, fire code and building
regulations."
SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in
pamphlet form in the manner provided by law.
